PEN CD-ART 3 & 4-VARIOUS

Amends the Pension Impact Note Act. Requires that a pension impact note for legislation affecting downstate police and downstate firefighter pension funds must demonstrate the fiscal impact of the legislation on at least 25 municipalities with the pension funds. Amends the Illinois Pension Code. Makes changes concerning prohibited transactions by fiduciaries of a pension fund established under the Downstate Police or Downstate Firefighter Article (Article 3 or 4), examinations of pension funds, and witnesses and adds provisions concerning consulting services, prohibitions on gifts for members of a board of trustees of a pension fund established under Article 3 or 4, fraudulent claims for disability pensions by police officers and firefighters, award of benefits, publication of a notice regarding the fiscal status of a pension fund established under Article 3 or 4, and a report by the Commission on Government Forecasting and Accountability on pension funds established under Article 3 or 4. Makes other changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

CNTY CD-FARMLAND PRESERVATION

Amends the Counties Code. Provides that a county with a population of less than 1,000,000 may levy an annual tax for farmland preservation easement purposes. Provides that the tax may not exceed 0.05% of the equalized assessed value of taxable property in the county. Provides that the tax must be approved by referendum. Provides that the tax may be discontinued by referendum.

NORTH MORAINE WASTEWATER DIST

Amends the Sanitary District Act of 1917. Provides that the Northern Moraine Wastewater Reclamation District shall be governed by a 5-member board of trustees (instead of a 3-member board). Provides for the appointment and terms of the additional members. Effective immediately.

INC TX-ACCOUNTING

Amends the Illinois Income Tax Act. In a Section authorizing the Director of Revenue to make certain adjustments to base income if it appears to the Director that any agreement, understanding, or arrangement exists between any persons that causes any person's base income allocable to this State to be improperly or inaccurately reflected, limits the provision to non-business income and provides that the Director may not make these adjustment before the Department of Revenue adopts rules concerning the adjustments. Provides that, unless the principal purpose of the agreement, understanding, or arrangement is for the avoidance of federal or Illinois income tax, any adjustment made by the Director and the rules required to be adopted must be in accordance with certain provisions of the Internal Revenue Code. Effective immediately.

HUNTING-ACTIVE DUTY MILITARY

Amends the Wildlife Code. Provides that, if a person is currently serving on active-duty in the U.S. Armed Forces or Reserves and has a valid Firearm Owner's Identification Card, or the equivalent from another state, then there is no fee for a hunting license. Requires verification of active-duty service.

FIN REG-AFFILIATES

Amends the Corporate Fiduciary Act. Adds provisions concerning investments and participation by affiliates of any bank or trust company acting in its fiduciary capacity. Provides that any bank or trust company may purchase services or products from an affiliate, provided that the purchase is otherwise prudent and not prohibited by the instrument governing the fiduciary relationship. Provides that the compensation for the service or product may be in addition to the compensation that the bank or trust company or its affiliate is otherwise entitled as a fiduciary. Provides that the bank or trust company must disclose, in a specified manner, any purchase authorized by the new provisions. Provides that the new provisions apply to any bank or trust company doing banking or trust business in this State, including any national bank or national trust company or any of its affiliates.

REVENUE-TAX EXPENDITURES

Amends various Acts, if and only if Senate Bill 1544 of the 95th General Assembly becomes law. Reinstates the provisions of those Act as they were prior to that Senate Bill 1544. Effective immediately.
