DHS-GRANTS-HUNGER RELIEF

Amends the Department of Public Aid Law of the Civil Administrative Code of Illinois and the State Finance Act. Creates the Hunger Relief Fund as a special fund in the State treasury. Provides that, from appropriations to the Department of Healthcare and Family Services from the Fund, the Department shall make grants to members of the Illinois Food Bank Association for the purpose of making capital improvements, purchasing food, or acquiring other assets. Effective immediately.

$DPH-ACCESS DUPAGE

Appropriates $325,000 to the Department of Public Health from the General Revenue Fund for a grant to Access DuPage. Effective July 1, 2009.

ELEVATOR SAFETY-PRIVATE RESIDE

Amends the Elevator Safety and Regulation Act. Removes references to private residences in the definition of "elevator contractor's license" and in a Section concerning inspector's licenses and inspection company licenses. Repeals Section concerning elevators in private residences. Effective immediately.

SCH CD-COUNSELING CONFIDENTIAL

Amends the School Code. Provides that except as provided in specified provisions, specified information must not become part of the pupil's record without the written consent of the pupil who disclosed the confidential information to the school counselor or school counselor intern. Specifies circumstances under which information may be disclosed. Provides that a school counselor or school counselor intern may not disclose information deemed to be confidential pursuant to specified provisions to the parents of the pupil when the school counselor or school counselor intern (1) has reasonable cause to believe that the disclosure would result in a clear and present danger to the health, safety, or welfare of the pupil or (2) is ordered by a court of law to disclosure specified information. Provides that nothing in specified provisions shall be deemed to limit access to a pupil's records. Provides that it is the intent of the General Assembly that school counselors use the privilege of confidentiality to assist the pupil whenever possible to communicate more effectively with parents, school staff, and others. Amends the State Mandates Act to require implementation without reimbursement.

CONDOS-BYLAW-RENT PROHIBITIONS

Amends the Condominium Property Act. Provides that if a condominium association's bylaws permit the leasing of an owner's condominium unit and the bylaws are changed to prohibit the leasing of a unit and a unit owner, incorporated under 26 USC 501(c)(3), is leasing the unit at the time that the bylaw goes into effect, then the unit owner may continue to rent the unit until the unit owner voluntarily sells the unit and no fine, fee, dues, or penalty shall be assessed against the unit owner for leasing its unit. Amends the General Not For Profit Corporation Act of 1986. Provides that if a common interest community or homeowners' association that currently permits leasing amends its governing documents to prohibit leasing, that prohibition may not affect a unit owner, incorporated under 26 USC 501(c)(3), then leasing the unit from continuing to rent the unit until the unit owner voluntarily sells the unit and no fine, fee, dues, or penalty shall be assessed against the unit owner for leasing its unit.

CRIM CD-AGG ID THEFT

Amends the Criminal Code of 1961. Provides that a person convicted of aggravated identity theft for specified non-financial violations relating to identity theft is guilty of a Class 2 felony.

EPA-EXEMPT-COMPOST FACILITY

Amends the Environmental Protection Act. Provides that the term "pollution control facility" does not include the portion of a site or facility (i) that is used for the composting of food scrap, livestock waste, crop residue, uncontaminated wood waste, or paper waste, including, but not limited to, corrugated paper or cardboard and (ii) that meets a list of specified requirements. Replaces a provision that required the Agency to develop and make recommendations to the Board concerning (i) performance standards for organic waste compost facilities and (ii) testing procedures and standards for the end-product compost produced by organic waste compost facilities with a provision that authorizes the Agency to draft those standards. Redefines "organic waste" to include, among other things, food scrap (now, "food waste"), livestock waste, crop residue, and paper waste.

SILVER ALERT PROGRAM

Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Creates the Silver Alert System. The Silver Alert System provides for the rapid dissemination of information regarding a missing person who is believed to be suffering from dementia or a similar cognitive impairment. Specifies the requirements and procedures for the alert system. Creates the Silver Alert System Task Force. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that the Department of Transportation, in coordination with the Department of State Police, shall use electronic message signs to provide critical information to the public regarding missing persons believed to be suffering from dementia or a similar cognitive impairment. Effective immediately.
