SCH CD-SUSPEND/EXPEL-ELEC THRT

Amends the School Code. Provides that the gross disobedience or misconduct for which a school board (except Chicago) may expel pupils includes that perpetuated by electronic means. Provides that a school board (including Chicago) may suspend or by regulation authorize the superintendent of the district or the principal, assistant principal, or dean of students of any school to suspend a student for a certain period of time or may expel a student for a definite period of time if (i) that student has been determined to have made an explicit threat on an Internet web site against a school employee, a student, or any school-related personnel, (ii) the Internet web site through which the threat was made is a site that was accessible within the school at the time the threat was made or was available to third parties who worked or studied within the school grounds at the time the threat was made, and (iii) the threat could be reasonably interpreted as threatening to the safety and security of the threatened individual because of his or her duties or employment status or status as a student inside the school.

PENSION-GARS-SALARY LIMITATION

Amends the General Assembly Article of the Illinois Pension Code. Requires the System to make a quarterly report to the Commission on Government Forecasting and Accountability, which shall include (1) the name and current salary, according to data in the possession of the System, for each participant in the System who (A) first became a member of the System before August 22, 1994; (B) has not begun receiving a retirement annuity under this Article; and (C) is employed in a position covered by a participating system under the Retirement Systems Reciprocal Act and the name of his or her current employer and (2) beginning with the second quarterly report after the effective date, the name of each participant who has begun receiving a retirement annuity under the Article since the preceding quarterly report and, if the salary used to calculate his or her proportional annuity under the Article is higher than his or her highest salary for annuity purposes would have been if he or she were not exempted from the earnings limitation, the salary level used to calculate his or her proportional annuity and the name of his or her employer under the other participating system. Amends the Commission on Government Forecasting and Accountability Act to require that the Commission on Government Forecasting and Accountability submit a quarterly report to the General Assembly that contains information submitted to the Commission by the General Assembly Retirement System. Effective immediately.

SCH CD-ALT SCH-FELONY CHARGE

Amends the Safe Schools Law of the School Code. Provides that a "disruptive student" includes suspension or expulsion eligible students and students against whom juvenile or criminal proceedings alleging the commission of a felony are pending (instead of just suspension or expulsion eligible students). Provides that a student against whom juvenile or criminal proceedings alleging the commission of a felony are pending may be immediately transferred to an alternative program. Effective immediately.

SCH CD-SCOLIOSIS SCREENING

Amends the School Code. Requires all children in the third and seventh grades of any public, private, or parochial school to have a scoliosis screening. Provides that each of these children shall present proof of having been examined by a chiropractor before May 15th of the school year. Provides that the Department of Public Health shall establish, by rule, a waiver for children who show an undue burden or a lack of access to a chiropractor. Requires each public, private, and parochial school to give notice of this scoliosis screening requirement to the parents and guardians of students at least 60 days before May 15th of each school year. Effective July 1, 2009.

LOCAL INITIATIVE-REVIEW

Creates the Local Initiative Sunshine Act. Defines "gubernatorial or legislative member initiative". Creates the Local Initiative Review Board. Authorizes the Board to review initiatives for compliance with applicable State laws, rules, and practices governing the award and monitoring of gubernatorial and legislative member initiatives. Sets forth the membership of the Board. Provides for review and comment upon proposed agency rulemaking.

SCH CD-DISRUPTIVE BEHAVIOR

Amends the Safe Schools Law of the School Code and the Juvenile Court Act of 1987. Changes the definition of "disruptive student" to include suspension or expulsion eligible students and students in any of grades 6 through 12 against whom juvenile or criminal proceedings alleging the commission of a forcible felony are pending or against whom juvenile or criminal proceedings alleging the commission of a sex offense are pending (instead of suspension or expulsion eligible students in any of grades 6 through 12). Provides that a student whom the school district has deemed to pose a continued and substantial disruption to the school environment may be immediately transferred to an alternative program. Provides that transfer to an alternative program shall take place only after a student is allowed to access the due process procedure established by the school district. Requires this process to include a notice presented to the student's parents or guardian stating the intent to transfer the student to an alternative program and an opportunity for the parents or guardian to respond. Provides that pending an adjudication of delinquency for the commission of a forcible felony or for the commission of a sex offense, the State's Attorney shall ascertain whether the minor respondent is enrolled in school and, if so, request permission of the presiding judge of the juvenile court to disclose to the principal or chief administrative officer of the school the portion of the juvenile petition or supplemental petition that is sufficient to bring the minor under the jurisdiction the Juvenile Court Act of 1987. Effective immediately.

PEN CD-GA-MEMBER DEFINITION

Amends the General Assembly Article of the Illinois Pension Code. In the definition of "member", removes the phrase "for the period of service in such office". Effective immediately.

EDGE-INCENTIVE PAYMENTS

Amends the Economic Development for a Growing Economy Tax Credit Act. Provides that an applicant who has been awarded a Credit under the Act may, in the applicant's sole discretion, opt to retain taxes withheld under the Illinois Income Tax Act in lieu of an income tax credit. Provides that the amount of withheld taxes retained by the applicant in a taxable year may not exceed the amount of the Credit awarded by the Department of Commerce and Economic Opportunity for that taxable year. Provides that each employee whose taxes were withheld by an employer who retains amounts under this subsection must receive credit for 100% of the taxes withheld from his or her pay. Requires the Department to report annually to the Governor and the General Assembly on the progress of the incentive payment program. Amends the Illinois Income Tax Act to make corresponding changes concerning tax withholding. Effective immediately.

LOCAL INITIATIVE-PROCEDURES

Creates the Local Initiative Sunshine Act. Defines "gubernatorial or legislative member initiative". Provides that executive branch State agencies processing gubernatorial or legislative member initiatives must establish and maintain a file for all applications. Specifies the information an agency must obtain during the application or review process. Provides that an agency that processes grants shall develop guidelines and monitoring procedures. Specifies the required guidelines and procedures. Provides for public disclosure of grant information.
