VEH CD-EXCESSIVE IDLING FINES

Amends the Vehicle Code, State Finance Act, and Clerks of Courts Act. Increases the fine for an excessive idling violation from $50 to $250 for the first conviction and from $150 to $500 for a second or subsequent conviction within a 12 month period. Specifies how the fines collected shall be distributed and provides alternate distribution procedures for circuit clerks for excess idling violations. Creates the Trucking Environmental and Education Fund as a special fund in the State Treasury. Provides that all money deposited into the Trucking Environmental and Education Fund shall be paid, subject to appropriation by the General Assembly, to the Illinois Environmental Protection Agency for the purpose of educating the trucking industry on air pollution and preventative measures specifically related to idling. Effective immediately.

GUBERNATORIAL BOARD COMMISSION

Amends the Illinois Governmental Ethics Act. With respect to applicants for gubernatorial appointment to boards, commissions, authorities, and task forces, requires that (i) an applicant must provide specified documents to the Governor's Office of Boards and Commissions, (ii) the Office must hold a public hearing before appointing or nominating an applicant, (iii) the Office must provide to the Senate specified information on any applicant nominated for Senate confirmation, and (iv) the Office must post specified information on its website about appointment requirements, applicants, and appointees. Requires all applicants and appointees, whether or not the position requires Senate confirmation, to file statements of economic interests (now, nominees for and appointees to positions requiring Senate confirmation must file statements). Effective immediately.

REVENUE-RETURNS

Amends the Department of Revenue Law of the Civil Administration Code of Illinois to authorize the Department of Revenue to adopt rules requiring the electronic filing of certain tax returns. Amends the Illinois Income Tax Act. Authorizes spouses who file federal joint returns to file separate State returns. Amends various provisions concerning the joint and several liability of spouses who file joint returns. Provides that certain publicly traded partnerships may not claim a deduction for income distributable to an entity subject to the Personal Property Tax Replacement Income Tax. Amends the Use Tax Act. Requires purchasers to file a return and pay use tax on cigarettes within 30 days after acquiring the cigarettes (now, the tax must be paid by the last day of the month following the calendar month in which the cigarettes were purchased). Amends the Environmental Protection Act. Provides that, beginning on January 31, 2010, quarterly tax returns submitted by tire retailers are due by April 20, July 20, October 20, and January 20 of each year (now, returns are due by April 30, July 31, October 31, and January 31). Effective immediately.

EQUAL PAY ACT-RECORDS, ACTIONS

Amends the Equal Pay Act of 2003. Provides that an employer subject to the Act shall preserve specified records for not less than 5 (rather than 3) years. Provides that an action to collect a wage claim under the Act shall be brought within 5 years from the date of the underpayment (rather than within 3 years from the date the employee learned of the underpayment).

CHARITY-FIN STMT TO ATTGEN

Amends the Solicitation for Charity Act. Provides that a charitable organization registered pursuant to the Act that receives in any 12 month period ending upon its established fiscal or calendar year contributions in excess of $300,000 shall file a written report with the Attorney General which shall include a financial statement covering the immediately preceding 12 month period of operation (now, in excess of $150,000).

INC TX-FOREIGN INCOME

Amends the Illinois Income Tax Act. Makes changes to the calculation of the credit for income tax that is paid by a resident to another state on income that is also subject to the Illinois Income tax. Effective immediately.

DCFS FOSTER CARE PAYMENT RATE

Amends the Children and Family Services Act. Provides that by July 1, 2012, the per child payment rate for various categories of foster care expenditures allowable under federal law shall be up to 100% of the "foster care minimum adequate rates for children", established in a specified October 2007 technical report (now, up to 100% of an adjusted specified federal cost index). Effective immediately.

CRIME VICTIMS COMP-LEAVE SCENE

Amends the Crime Victims Compensation Act. Includes in the definition of "crime of violence" leaving the scene of a motor vehicle accident involving death or personal injury if the victim was a pedestrian or was operating a vehicle moved solely by human power or a mobility device at the time of contact. Provides that the death of a felon who is serving a term of parole, probation, or mandatory supervised release shall be considered a discharge from that sentence (making the felon eligible to be a victim under the Act). Effective immediately.

ENERGY ASST-SUBSIDIZED HOUSING

Amends the Energy Assistance Act. Provides that if a participant in the energy assistance program resides in publicly supported housing, the compensation paid under the Act to the energy provider who supplied winter energy to the participant shall be paid on behalf of the owner of that publicly supported housing. Provides that "publicly supported housing" includes housing subsidized or developed with public funds provided under the Rental Housing Support Program Act. Effective immediately.
