Rep. Michael J. Zalewski

Amends the Illinois Vehicle Code. Provides that a person shall not drive or be in actual physical control of any vehicle within this State while there is any amount of a drug, substance, or compound in the person's breath, blood, or urine resulting from the use or consumption of a controlled substance listed in the Illinois Controlled Substances Act in excess of the prescribed amount in the person's prescription for the controlled substance.

Amends the Election Code. Requires the State Board of Elections to establish and maintain a system for online voter registration, which will allow applicants to register to vote and to change their existing registration.

Makes application to Congress for the calling of a convention for proposing amendments to the United States Constitution.

Amends the Property Tax Code. Makes a technical change in a Section concerning the tax exemption for property used for religious purposes.

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that if an allegation that a child is an abused or neglected child is made in a custody or visitation proceeding, the court may request that the Department of Children and Family Services or a local law enforcement agency conduct an investigation of the allegation. Provides that if upon completion of the investigation, the Department or the local law enforcement agency finds that the allegation is unfounded, the court shall hold a hearing to review all available evidence regarding the allegation. Provides that if the court determines that an allegation that a child is an abused or neglected child is false, the person who made the allegation knew it to be false, and intended the allegation to influence a court ruling in the custody or visitation proceeding, the court may impose monetary sanctions and hold the person who made the false allegation in civil or criminal contempt. Provides that if a person has made a second false allegation, the court may also prohibit the person from receiving custody or visitation rights with regard to the child involved in the allegation. Requires the provision of written notice of the new provisions to parties in all proceedings in which custody or visitation is in issue.

Amends the Unified Code of Corrections. Requires as a condition of probation, conditional discharge, and supervision that the defendant provide the court with satisfactory proof of his or her level of education and requires the defendant, at his or her expense, to make a good faith effort to raise his or her level of education. Provides that failure to achieve the educational goal shall not be grounds for revocation of probation, conditional discharge, or supervision. Provides that, if the defendant has a child, a condition of his or her sentence shall be to attend a course on strengthening families and parenting. Provides that a credit of up to 180 days shall be given toward completion of probation and conditional discharge for achieving specified goals. Defines "good faith effort". Effective immediately.

Amends the Criminal Code of 2012. Provides that one of the aggravating factors for a violation of the statute concerning aggravated unlawful use of a weapon is that the person possessing the weapon was previously adjudicated a delinquent minor under the Juvenile Court Act of 1987 for an act that if committed by an adult would be a forcible felony (rather than a felony).

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that the Department may revoke a certificate of registration, permit, or license of an entity that is in default for moneys due to the Department. Amends the State Finance Act to provide that the Department of Revenue may maintain a petty cash fund not to exceed $2,000. Amends the Illinois Income Tax Act. Provides that payments received from the assignment of a prize under the Illinois Lottery Law are allocable to this State. Amends the Use Tax Act. Provides that retailers that do not possess a valid certificate of registration at the time the sale are not entitled to a vendor's discount under the Act. Amends the Retailers' Occupation Tax Act. Provides that the Department may deny a certificate of registration to any applicant if any owner, partner, manager, or member is in default of a tax or fee Act administered by the Department. Allows the Department of the Lottery to designate specific lottery game drawings to benefit the various scratch-off game funds. Provides that each special drawing designation shall be publicly announced by the Department in advance of the drawing date, along with the name of the fund that will benefit from the drawing and any special criteria for the transfer of moneys to the beneficiary fund.

Amends the Code of Criminal Procedure of 1963. Provides an electronic recording made of an accused for any offense may be admissible as evidence against the accused in any criminal proceeding, if the recording was made in a custodial interrogation while the accused is in custody for a murder, homicide, second degree murder, involuntary manslaughter, reckless homicide, or aggravated DUI resulting in a death. Additionally, the recording must be substantially accurate and not intentionally altered.

Amends the Code of Criminal Procedure of 1963. Provides that as a condition of being released by personal recognizance, the court may order a defendant to be placed under the supervision of the Pretrial Services Agency, Probation Department, County Department of Corrections, or Court Services Department in a pretrial bond home supervision capacity with the use of an approved electronic monitoring device. Provides that as a condition of bail, the court may require the defendant to remain or be placed in the custody of such designated person or organization agreeing to supervise his or her release, with or without the use of an approved electronic monitoring device administered by a Pretrial Services Agency, Probation Department, County Department of Corrections, or Court Services Department. Amends the Unified Code of Corrections. Provides that applications for electronic home detention may include as a condition of bail, as a condition of release on own recognizances, or in lieu of bail.
