CRIM PRO&CORR-UNFIT DEFENDANT

Amends the Code of Criminal Procedure of 1963 concerning unfit defendants. Provides that if the report to the court, the State, and the defense indicates that the defendant is not fit to stand trial or to plead because of a disability, the report shall include an opinion as to the likelihood of the defendant attaining fitness within a period of time from the date of the finding of unfitness (rather than one year) if provided with a course of treatment. Provides that for a defendant charged with a felony, the period of time shall be one year. Provides that for a defendant charged with a misdemeanor, the period of time shall be no longer than the maximum term of imprisonment for the most serious offense. Provides that the facility director shall provide a report to the court on the defendant's status toward restoration of fitness every 60 days from the date of the initial court order and thereafter. Provides that not more than 30 days after admission and every 90 (rather than 60) days thereafter so long as the initial order remains in effect, the facility director shall file a treatment plan report in writing with the court and forward a copy of the treatment plan report to the clerk of the court, the State's Attorney, and the defendant's attorney, if the defendant is represented by counsel, or to a person authorized by the defendant under the Mental Health and Developmental Disabilities Confidentiality Act to be sent a copy of the report. Effective January 1, 2017.

SCHOOL DRUG FREE ZONE

Amends the Cannabis Control Act, Illinois Controlled Substances Act, and the Methamphetamine Control and Community Protection Act. Requires that enhanced penalties for certain drug violations committed in a school, on or near school property, or in a conveyance used to transport students to school for school-related activities, must be committed when persons under the age 18 are present, the offense is committed during school hours, or the offense is committed at times when persons under the age of 18 are reasonably expected to be present in the school, in the conveyance, on the real property, or on the public way, such as when after-school activities are occurring. Deletes provision stating that the time of day, time of year, and whether classes were in session are irrelevant for controlled substance violations committed in a school or on or within 1,000 feet of school property.

TAX TRIBUNAL-JURISDICTION

Amends the Illinois Independent Tax Tribunal Act of 2012. Adds the taxes imposed under the following Acts to the list of taxes over which Tribunal has jurisdiction: the Illinois Hydraulic Fracturing Tax Act; the Cannabis and Controlled Substances Tax Act; the Live Adult Entertainment Facility Surcharge Act; the County Motor Fuel Tax Law; certain provisions of the Illinois Vehicle Code; certain provisions of the Metropolitan Pier and Exposition Authority Act; certain provisions of the Environmental Protection Act; certain provisions of the Illinois Municipal Code; and the Drycleaner Environmental Response Trust Fund Act. Effective immediately.

CRIM CD-RICO-FORFEITURE

Amends the Criminal Code of 2012 concerning the Illinois Street Gang and Racketeer Influenced and Corrupt Organizations Law. Extends the date of repeal of the Law from June 11, 2017 to June 11, 2022. Establishes specific forfeiture and protective order provisions for violations of the Law (rather than the provisions in the money laundering statute). Provides for distribution of moneys and the sale proceeds of all other property forfeited and seized under the Law to various units of government. Effective immediately.

CRIM CD&CORR-RETAIL THEFT

Amends the Criminal Code of 2012 and the Unified Code of Corrections. Provides that a person sentenced for retail theft of property the full retail value of which does not exceed $300, other than motor fuel or $150 for motor fuel, who has 2 or more prior convictions (rather than one prior conviction) of any type of theft, robbery, armed robbery, burglary, residential burglary, possession of burglary tools, home invasion, unlawful use of a credit card, or forgery commits a Class 4 felony and shall be required to make full restitution to the merchant.

PENCD-CHGO FIRE-TIER2 BENEFITS

Amends the Chicago Firefighter Article of the Illinois Pension Code. In a Section relating to a person who first becomes a fireman on or after January 1, 2011, provides for payment of a minimum widow's annuity, child's annuity, parent's annuity, and duty death benefit. Applies without regard to whether (i) the death of the deceased fireman may have occurred prior to the effective date of this amendatory Act or (ii) the fireman was in service on or after that effective date. Effective immediately.
