CLINICAL PSYCHOLOGISTS-SUNSET

Amends the Regulatory Sunset Act. Extends the repeal of the Clinical Psychologist Licensing Act from January 1, 2017 to January 1, 2027. Amends the Clinical Psychologist Licensing Act. Requires applicants or licensees to inform the Department of Financial and Professional Regulation of any change of address within 14 days after the change. Authorizes the Department to prescribe forms to be issued for the administration and enforcement of the Act and to conduct investigations related to possible violations of the Act. Removes language requiring that the Secretary of Financial and Professional Regulation issue a report to the Clinical Psychologists Licensing and Disciplinary Board if he or she takes action contrary to the recommendation of the Board. Provides that a person licensed in another state or jurisdiction of the United States or Canada, holds a doctoral degree in clinical, school, or counseling psychology, and has no disciplinary action taken against his or her license in any jurisdiction may be licensed at the Department's discretion. Provides that a person licensed in any foreign country or province whose standards were substantially equivalent on the date of his or her licensure in the other jurisdiction may be licensed at the recommendation of the Board. Includes the Department in certain disciplinary proceedings. Makes changes to provisions concerning investigations and hearings. Removes the requirement that the Board review reports from a hearing officer within 60 days. Makes changes to provisions concerning rehearings and final orders. Makes other changes. Effective immediately.

MANAGED CARE-NOTICE OF DENIAL

Amends the Managed Care Reform and Patient Rights Act. Provides that if a health carrier or insurer denies a request for coverage of a prescription drug, then the health carrier or insurer must give a covered person's pharmacist, along with the prescribing provider, the reason for denial of coverage of the prescription drug, along with an alternative covered medication, if applicable, and information regarding the procedure for submitting an appeal to the denial. Effective immediately.

RESPIRATORY CARE-DURABLE EQUIP

Amends the Respiratory Care Practice Act. Makes changes in the definitions of "basic respiratory care activities", "licensed health care professional", and "respiratory care". Allows individuals without a license to practice respiratory care to perform basic screening spirometry if certified by the National Institute for Occupational Safety and Health, the American Association for Respiratory Care, or other similarly accepted certification programs. Allows respiratory care practitioners licensed in other jurisdictions to provide respiratory care in this State (i) in a declared emergency in this State, (ii) as a member of an organ procurement team, or (iii) as part of a medical transport team that is transporting a patient into or out of this State. Provides that unlicensed and non-credentialed individuals who deliver respiratory care equipment may deliver, set up, calibrate, and demonstrate the mechanical operation of the device to patients, family, and caregivers if the individuals received training and demonstrated competency using the specific devices under the supervision of a respiratory care practitioner licensed by this State or some other licensed practitioner operating within his or her scope of practice. Provides that patients, family, and caregivers must be taught to use the equipment for the intended clinical application by a licensed respiratory care practitioner or other licensed health care professional operating within his or her scope of practice. Provides that instructions to the patient regarding the clinical use of equipment, patient monitoring, patient assessment, or any other procedure used with the intent of evaluating the effectiveness of the treatment must be performed by a respiratory care practitioner licensed by this State or any other licensed practitioner operating within his or her scope of practice. Makes other changes.

LIQUOR-SALE AT PUBLIC LIBRARY

Amends the Liquor Control Act of 1934. Provides that alcoholic liquors may be delivered to and sold at retail in any building owned by a public library district, provided that the delivery and sale is approved by the board of trustees of that public library district and is limited to library fundraising events or programs of a cultural or educational nature. Provides that before the board of trustees of a public library district may approve the delivery and sale of alcoholic liquors, the board of trustees of the public library district must have a written policy that has been approved by the board of trustees of the public library district governing when and under what circumstances alcoholic liquors may be delivered to and sold at retail on property owned by that public library district. Provides that any public library district that has alcoholic liquor delivered to or sold at retail on property owned by the public library district shall provide dram shop liability insurance in maximum insurance coverage limits so as to save harmless the public library district from all financial loss, damage, or harm. Makes a conforming change.

ANESTHESIOLOGIST ASSISTANT ACT

Creates the Anesthesiologist Assistant Practice Act. Provides for the licensure of anesthesiologist assistants by the Department of Financial and Professional Regulation. Sets forth provisions concerning qualifications, grounds for disciplinary action, and administrative procedures. Preempts home rule. Makes conforming changes in the Ambulatory Surgical Treatment Center Act and the Hospital Licensing Act. Amends the Regulatory Sunset Act to provide for repeal of the Anesthesiologist Assistant Practice Act on January 1, 2026. Effective immediately.

EYELASH TECH CERTIFICATION

Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides that a person not licensed as a cosmetologist or an esthetician under the Act may become certified as an eyelash technician upon application to the Department of Financial and Professional Regulation, completion of an eyelash extension application training program, and payment of the required fee. Provides that the eyelash extension application training program must include at least 320 hours of classroom instruction and practical experience and include instruction in recognizing infectious or contagious diseases of the eye and allergic reactions to materials, proper sanitation practices, occupational health and safety practices, eyelash extension application procedures, and eyelash extension isolation and separation procedures. Provides that an instructor at an eyelash extension application training program must be a licensed cosmetology teacher or cosmetology clinic teacher. Provides that the Department of Financial and Professional Responsibility shall adopt rules regarding eyelash extension application training programs and may establish or designate approved training programs.

INC TX-R AND D CREDIT

Amends the Illinois Income Tax Act. Provides that the research and development credit applies on a permanent basis. Provides that the credit may be carried forward for a period of 20 years (instead of 5 years). Increases the amount of the research and development credit by providing that the increase in qualifying expenditures shall be an increase over 50% (instead of 100%) of the average of the qualifying expenditures for each year in the base period. Effective immediately.

INTELLECTUAL DISABILITIES CARD

Amends the Department of Human Services Act. Provides that, beginning 6 months after the effective date of the amendatory Act, upon the request of a person diagnosed with an intellectual disability or a developmental disability or the guardian or caregiver of the person, the Department shall issue a certification card denoting that the person has been diagnosed with an intellectual disability or a developmental disability. Provides that the certification card and the person's driver's license may be presented to law enforcement officers as necessary. Requires the Department to establish by rule the proof required to be produced by a person diagnosed with an intellectual disability or a developmental disability who requests a certification card and permits the Department to collect a reasonable fee for the issuance of the certification card as determined by the Department. Effective immediately.

PROP TX-MANUFACTURING ABATE

Amends the Property Tax Code. Provides that any county, municipality, village, or township may abate all or a portion of the taxes levied by that county, municipality, village, or township on the property of a qualified tool and manufacturing business located within that county, municipality, village, or township. Provides that, if a county, municipality, village, or township passes an ordinance or resolution providing for such an abatement, any taxing district located in whole or in part within that county, municipality, village or township may also abate all or a portion of the taxes levied by the taxing district on that property. Effective immediately.
