MEDICAID-ALLKIDS-CHIPS-PCCM

Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Medical Assistance Article of the Illinois Public Aid Code. Provides that at least 70% (rather than 50%) of recipients eligible for comprehensive medical benefits in all medical assistance programs or other health benefit programs administered by the Department of Healthcare and Family Services, including the Children's Health Insurance Program Act and the Covering ALL KIDS Health Insurance Act, shall be enrolled in a care coordination program by no later than January 1, 2015. Provides that the Department of Healthcare and Family Services' primary care case management program shall be considered a care coordination program. Effective immediately.

VEH CD-SPECIAL PLATE:IL NURSES

Amends the State Finance Act and Illinois Vehicle Code to provide for the issuance of Illinois Nurses license plates. Creates the Illinois Nurses Foundation Fund as a special fund in the State treasury. Provides that the applicant shall pay an additional fee of $35 for original issuance of the plates, of which $20 shall be deposited into the Illinois Nurses Foundation Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. Provides that an additional fee of $22 shall be charged for each renewal, of which $20 shall be deposited into the Illinois Nurses Foundation Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund. Provides that moneys in the Illinois Nurses Foundation Fund shall be paid as grants to the Illinois Nurses Foundation, to promote the health of the public by advancing the nursing profession in Illinois.

DCFS-CHILD ABUSE-INTERVIEW

Amends the Abused and Neglected Child Reporting Act. Provides that certain interviews of a child who is alleged to be an abused child may not be conducted unless the interview is videotaped and audiotaped by the Department of Children and Family Services. Requires that the Department preserve those videotapes and audiotapes and other materials until all judgments in legal proceedings relating to the victim-sensitive interview are final and all direct and habeas corpus appeals are exhausted or such legal proceedings are barred by law. Provides for access to copies of the preserved materials by a party to a proceeding relating to the materials. Effective immediately.

DCFS-ID/DD KIDS-PROVIDR EVALUA

Amends the Children and Family Services Act, the Mental Health and Developmental Disabilities Administrative Act, and the School Code. Permits residential services providers that contract with the Department of Children and Family Services or the Department of Human Services to provide services to children age 5 to 22 with a developmental or intellectual disability to conduct a 60-day evaluation and residential assessment to facilitate a child's successful transition to a community-based children's group home, when indicated. Provides that the 60-day evaluation and assessment period must commence upon admission and must be conducted in a campus-based residential program where the child will be assessed and evaluated to determine his or her functioning and overall performance. Provides that specified disciplines may be completed during the evaluation and assessment period, including education or classroom support, speech or language, occupational therapy and physical therapy, and behavioral health services. Adds similar provisions to the School Code as to residential facilities that accept students age 5 to 22 with a developmental or intellectual disability for services paid for by an Illinois public State agency. Effective immediately.

SCH CD-ST TESTING ALIGNMENT

Amends the School Code. Requires the State Board of Education to align the State assessment tests administered in grades 3 through 8 with the Prairie State Achievement Examination to better prepare students to take the Prairie State Achievement Examination. Effective immediately.

Amends the State Employees Group Insurance Act of 1971, the Alcoholism and Other Drug Abuse and Dependency Act, the Children and Family Services Act, the Illinois Commission on Volunteerism and Community Service Act, the Department of Human Services Act, the Domestic Violence Shelters Act, the Illinois Youthbuild Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the Interagency Coordinating Council Act, the State Finance Act, the School Code, the Specialized Care for Children Act, the Abused and Neglected Child Reporting Act, the Early Intervention Services System Act, the Interagency Board for Children who are Deaf or Hard-of-Hearing and have an Emotional or Behavioral Disorder Act, the Community Services Act, the Reduction of Racial and Ethnic Health Disparities Act, the Illinois Family Case Management Act, the Hearing Screening for Newborns Act, the Prenatal and Newborn Care Act, the Problem Pregnancy Health Services and Care Act, Developmental Disability Prevention Act, the WIC Vendor Management Act, the Renal Disease Treatment Act, the Juvenile Court Act of 1987, the Cannabis Control Act, the Narcotics Profit Forfeiture Act, the Probation and Probation Officers Act, and the Illinois Domestic Violence Act of 1986. Transfers various programs, powers, and funding to the Department of Public Health. Creates the Office of Community Health, Prevention, and Wellness within the Department of Public Health. Repeals certain provisions of the Department of Human Services Act. Repeals the Prenatal and Newborn Care Act and the Problem Pregnancy Health Services and Care Act. Provides that the bill may be referred to as the Illinois Maternal and Child Health Leadership and Excellence Act of 2012.

INS CD-TOBACCO DEPENDENCE LAW

Amends the Illinois Insurance Code. Provides that the provision concerning tobacco use cessation programs does not apply to short-term travel, disability income, long-term care, accident only, or limited or specified disease policies. Creates the Tobacco Dependence Coverage Law. Provides that group and individual accident and health policies and managed care plans issued to a resident of the State must provide coverage or reimbursement of up to $500 annually for a tobacco use cessation program for insureds who are 18 years of age or older. Provides that notice of the availability of coverage shall be delivered to the insured. Provides that an insurer may not deny eligibility or continued eligibility to enroll or renew coverage solely for the purpose of avoiding the requirements of the Law. Provides that an insurer may not penalize or reduce or limit the reimbursement of an attending provider or provide incentives to induce the provider to provide care that is inconsistent with the Law. Amends the Health Maintenance Organization Act, Limited Health Service Organization Act, and Voluntary Health Services Plans Act to provide that those Acts shall be subject to the provisions of the Illinois Insurance Code concerning tobacco use cessation programs.

Amends the Hospital Licensing Act. Provides that a copy of the written staffing plan for nursing care services shall be provided to any member of the general public upon request.

HOME BIRTH SAFETY ACT

Creates the Home Birth Safety Act. Provides for the licensure of midwives by the Department of Financial and Professional Regulation. Creates the Illinois Midwifery Board. Sets forth provisions concerning qualifications, grounds for disciplinary action, and administrative procedures. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2022. Amends the Medical Practice Act of 1987 and the Nurse Practice Act to make related changes. Effective January 1, 2012.
