RESIDENTIAL PROP DISCLOSE-MOLD

Amends the Residential Real Property Disclosure Act. Adds to the items in the disclosure list a statement concerning whether the owner is aware of the existence of toxic mold on the property.

CRIM CD - STOLEN MATERIALS

Amends the Criminal Code of 1961. Creates the offense of possession or transportation of stolen ferrous or nonferrous metal, including but not limited to copper, HVAC components, and catalytic converters. Provides penalties from a Class C misdemeanor to a Class 2 felony. Makes it unlawful to cut, mutilate, deface, or otherwise injure personal or real property for the purpose of obtaining ferrous or nonferrous metal. Provides penalties of a Class 4 or Class 3 felony depending on the value of the property damage involved. A violation that results in disruption of communication or electrical service to critical infrastructure or for more than 10 customers of the service is a Class A misdemeanor. A violation of any provision that results in great bodily harm, permanent disability, disfigurement, or substantial risk of death to another is a Class 1 felony. A violation of any provision that results the death of another is a Class X felony. Provides exemption from civil liability for public or private owners to a person injured during or by a dangerous condition created in an offense or an attempted offense under this Section.

PEN CD-NEW HIRE-RETIREMENT AGE

Amends the Illinois Pension Code. Provides that a member or participant who first becomes a member of one of the specified pension or retirement systems on or after January 1, 2011 is entitled to a retirement annuity upon written application if he or she has attained age 62 (rather than 67), has at least 10 years of service credit, and is otherwise eligible under the requirements of the applicable Article. Provides that if such a person has attained age 57 (rather than 62), has at least 10 years of service credit, and is otherwise eligible under the requirements of the applicable Article, then he or she may elect to retire early and receive a lower retirement annuity. Exempts these benefit changes from the new benefit increase provisions added by Public Act 94-4 in each of the affected Articles. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

DHFS-CHILD SUPPORT ORDERS

Amends the Illinois Public Aid Code and the Income Withholding for Support Act. Provides that when determining a responsible relative's ability to provide support, the Department of Healthcare and Family Services shall use its subpoena power to obtain a copy of the relative's most recent Federal Income Tax return to verify all sources of income. Provides that if it is determined upon receipt of the relative's most recent Federal Income Tax return that the responsible relative receives income from more than one employer, the Department shall serve an income withholding notice upon each of the relative's employers pursuant to the Income Withholding for Support Act. Provides that to ensure against a responsible relative's overpayment when more than one employer has been served with an income withholding notice, the Department shall assess the relative's support obligation among the multiple income withholding orders on a proportionate basis. Effective immediately.

MOTOR VEH INS FRAUD & THEFT

Amends the Illinois Motor Vehicle Theft Prevention Act. Changes the short title of the Act to the Illinois Motor Vehicle Insurance Fraud and Theft Prevention Act. Changes the name of the Illinois Motor Vehicle Theft Prevention Council to the Illinois Motor Vehicle Insurance Fraud and Theft Prevention Council. Changes the name of the Motor Vehicle Theft Prevention Trust Fund to the Motor Vehicle Insurance Fraud and Theft Prevention Trust Fund. Makes conforming changes concerning the changes of the names of the Act, the Council, and the Trust Fund. Amends the Illinois Vehicle Code. Changes the name of the Motor Vehicle Theft Prevention Program to the Motor Vehicle Insurance Fraud and Theft Prevention Program. Makes conforming changes concerning change of the name of the Program. Amends the Illinois Criminal Justice Information Act and the State Finance Act to make conforming changes concerning the changes of the names of the Illinois Motor Vehicle Theft Prevention Act and the Motor Vehicle Theft Prevention Trust Fund. Effective January 1, 2013.

PROP TX-SENIOR EXEMPTION

Amends the Property Tax Code. Provides that, in counties with 3,000,000 or more inhabitants, taxpayers who have been granted a Senior Citizens Homestead Exemption must reapply every 2 years (instead of annually). Provides that the county board of a county with less than 3,000,000 may not require the person to reapply more frequently than every 2 years. Effective immediately.

CRIM CD-FIREARMS-WAITING TIME

Amends the Criminal Code of 1961. Exempts a petitioner who is protected by an order of protection issued under the Domestic Violence: Order of Protection Article of the Code of Criminal Procedure of 1963 or under the Illinois Domestic Violence Act of 1986 from the waiting period for purchase of a firearm.
