Sen. Will Espero

Limits the Director of Public Safety's ability to transfer convicted felons to any federal correctional institution or a correctional institution in another state to only those felons incarcerated for violent crimes under HRS section 351-32. Requires that all felons incarcerated in an out-of-state correctional institution or an out-of-state federal correctional institution for a crime that is not a violent crime under HRS section 351-32 be returned to Hawaii no later than July 1, 2020. Repeals the Governor's authority to negotiate or contract for expansion or construction of private correctional facilities.

Requires department of health to update how it obtains information for the birth defect registry with respect to pesticides, develop a comprehensive pesticide testing program, require reporting of pesticide use, ban pesticide use near public areas, and ban use of chlorpyrifos.

Requires the Department of Commerce and Consumer Affairs to conduct a study of the effectiveness and enforcement issues relating to the State's foreclosure statutes under chapter 667, Hawaii Revised Statutes. Requires the Department of Commerce and Consumer Affairs to determine the provisions to be included in a proposed homeowners' bill of rights. Requires the Department of Commerce and Consumer Affairs to submit a report of its findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2019.

Amends Hawaii Revised Statutes and Hawaii Administrative Rules to substitute references to "marijuana" with "cannabis". Reschedules cannabis from a schedule I drug to a schedule III drug.

Requires the department of agriculture, in collaboration with the department of health, to create a restricted use pesticide amnesty program and provide restricted use pesticide amnesty bins within each county for the anonymous and proper disposal of illegal or unused restricted use pesticides.

Establishes an application screening fee that a landlord may charge an applicant to obtain information about the applicant and establishes the applicant's right to review the credit report obtained by the landlord if the applicant paid the application screening fee.

Requires long-term care facilities to continue providing care for individuals after they receive acute medical care from a hospital. Requires a long-term care facility that provides care to an individual who leaves the facility to receive acute medical services at a hospital to readmit and continue providing care for the individual. Requires an individual who is receiving care in a hospital and is recommended by the hospital for transfer to a licensed long-term care facility for continued care to transfer to only that long-term care facility recommended by the hospital.

Codifies sustainable development goals based on the United Nations' Global Goal twelve, responsible consumption and production.

Exempts victims of labor trafficking, sex trafficking, and prostitution from those offenses for which the crime victim compensation commission may reduce a victim's compensation based on the victim's behavior. Elevates the offense of prostitution to a misdemeanor if an individual pays, agrees to pay, or offers to pay a fee to another to engage in sexual conduct and amends the penalties. Elevates the offenses of loitering for the purpose of advancing prostitution and advancing prostitution to a petty misdemeanor and misdemeanor, respectively. Amends the offense of sex trafficking to include solicitation of a minor for prostitution. Makes traveling for prostitution where the victim is a minor a class A felony. Repeals the offense of soliciting a minor for prostitution. Makes clarifying and conforming amendments.

Proposes amendments to the state constitution to provide for direct initiative.
