Establishes the startup agriculture business and farms special fund to provide seed capital for and venture capital investments in private sector projects for startup agricultural businesses and farms. Establishes the value added startups special fund to provide seed capital for and venture capital investments in private sector projects for value added startups. Appropriates moneys.
Adds an exception to mandatory disclosure of government records for deliberative and pre-decisional government inter-agency or intra-agency records concerning an agency decision about a government action. From July 1, 2023, through June 30, 2027, requires agencies to report their use of the exception to the Office of Information Practices. Effective 7/1/2112. (SD1)
Requires governmental bodies to obtain written approval from the Administrator of the State Procurement Office to cancel invitations for bids, requests for proposals, or other solicitations, or reject bids or proposals. Prohibits post-award remedial actions to be taken unless approved in writing by the Administrator of the State Procurement Office.
Establishes a criminal penalty and monetary fines for aquarium fishing violations. Clarifies that each fish or aquatic life specimen taken in violation of certain fishing laws regarding aquarium fish and the possession and use of prohibited explosives, electrofishing devices, and poisonous substances constitutes a separate offense.
Establishes a framework to regulate controllers and processors with access to personal consumer data. Establishes that a violation of the consumer data privacy act constitutes an unfair method of competition and unfair and deceptive acts or practices in the conduct of any trade of commerce. Authorizes a person injured by a violation of the personal consumer data act to bring a civil action against a controller or processor.
Prohibits the construction, modification, or expansion of any waste or disposal facility for hazardous waste or solid waste on land that is near or above a significant aquifer as determined by the Department of Health in consultation with the Commission on Water Resource Management. Appropriates $5 million dollars to the Department of Agriculture for the Compost Reimbursement Program.
Temporarily exempts affordable housing projects under certain circumstances from specific state and county fees and exactions related to discretionary approval or ministerial permitting, except fees and costs payable to the Hawaiʻi Housing Finance and Development Corporation and the rates and fees of the various boards of water supply. Repeals 6/30/2028. Effective 6/30/3000. (HD2)
Requires that appropriations allocated to Department of Education programs that provide instructional services directly to students shall remain within the budget of the program to which they were originally allocated and that the retention of an appropriation shall not be used by the department as a basis for reducing a program's future budget requirements.
