Beginning on 7/1/2024, requires that the state supplemental payment for type 1 adult residential care homes, licensed developmental disabilities domiciliary homes, community care foster family homes, and certified adult foster homes not exceed $1,136. Beginning on 7/1/2024, requires that the state supplemental payment for type II adult residential care homes not exceed $1,334.
Clarifies the level of environmental restoration owners and operators of underground storage tanks or tank systems that had a confirmed release must satisfy by requiring the removal of all jet fuel, including fuel additives and all compounds resulting from the degradation of jet fuel or jet fuel additives or the reaction of jet fuel or jet fuel additives with water or other chemicals. Establishes a rebuttable presumption that the detection of these contaminants in the vicinity of an underground storage tank or a tank system after a confirmed release is a result of the confirmed release.
Appropriates funds for the continued implementation of the return-to-home pilot program, established pursuant to Act 94, Session Laws of Hawaiʻi 2023, to provide eligible homeless individuals with assistance in reuniting with family and relatives in their home state.
Requires defendants convicted of causing the death of a parent or legal guardian of a minor child by the operation of a vehicle in a negligent manner while under the influence of drugs or alcohol to make restitution in the form of financial support to each surviving child of the victim.
Amends requirements for an owner or lessee of a native Hawaiian sailing canoe to moor at a small boat harbor. Defines "native Hawaiian sailing canoe".
Establishes that it shall be unlawful for any person to use nets made of or using netting with a stretched mesh of less than two inches, except that aquarium fish collectors with a valid aquarium fish permit may use traps and nets for aquarium fish and other aquatic life in conformance with the permit; provided that non-commercial aquarium fish collectors shall be limited to a combined total of five fish or aquatic life specimens per person per day. Establishes penalties.
Clarifies that the Board of Land and Natural Resources shall not unilaterally amend the terms and conditions of any lease of public lands being extended pursuant to Act 149, Session Laws of Hawaiʻi 2018, except as otherwise provided therein; and if the Board of Land and Natural Resources wishes to amend the terms and conditions of any lease of public lands being extended to reflect the Board's most current lease form, the lease form must be included in the rules of the Board. Defines "lease of public lands".
Exempts the instream use of water for commercial kalo cultivation conducted in a manner consistent with traditional and customary Native Hawaiian practices and on traditional kalo lands from the existing process for the disposition of water rights.
Establishes the Sustainable Food Systems Working Group within the Office of Planning and Sustainable Development to develop a plan for a more sustainable, resilient local food economy and to report to the Legislature. Appropriates funds to establish the working group, develop the plan, and fund an unspecified number of sustainability specialist positions within the Office of Planning and Sustainable Development's Statewide Sustainability Program.
