Establishes an office of the housing advocate within the office of the governor.
Defines "pre-contact historic property". Clarifies that the historic preservation program includes the development, publication, and distribution of materials about protections for burials, historic sites, and archaeological resources. Increases civil and administrative fines for certain violations of historic and preservation requirements and makes violators liable for costs associated with mitigation or restoration measures. Requires procurement officers to document whether to pursue a design professional or contractor for damages in the event of construction cost overruns. Requires the chief procurement officer to compile a public list of construction companies or design professionals that are in noncompliance with the procurement code or owe penalties. Makes construction cost overruns a tort for purposes of the design claim conciliation panel. Requires bids for a contract under the competitive sealed bidding process to include a liability contingency fund. Requires the state procurement office to include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards. Makes cost overruns a construction defect for the purposes of the contractor repair act. Establishes a procurement professional standards task force. Effective 7/1/2112. (HD1)
Extends the date on which the temporary commission on the thirteenth festival of pacific arts shall cease to exist to August 31, 2025. Permits the commission members to discuss matters relating to official board business without regard to chapter 92, Hawaii Revised Statutes, to enable them to perform their duties faithfully. Establishes a road connectivity task force to assess and identify ways of improving road access in rural areas and in subdivisions with substandard roads. Requires a report to the legislature.
Allows boards to use interactive conference technology to remotely conduct public meetings under the sunshine law in conjunction with in-person meetings, even when no emergency has been declared by government authorities. Authorizes boards to exclude the public from nonpublic locations, such as homes, where board members are physically present when remote board meetings are held by interactive conference technology. Establishes requirements for the conduct of remote meetings. Establishes a new notice requirement to provide the board's contact information for the submission of written testimony by electronic or postal mail. Amends existing option to hold in-person meetings at multiple public meeting sites connected by interactive conference technology to require termination of meeting only if audio communication is lost and cannot be reestablished within an hour and the board had not provided reasonable notice of how the meeting would be continued. Allows for additional courtesy sites open to the public for remote and in-person meetings held by interactive conference technology. Allows for contact tracing and social distancing during states of emergency caused by contagious diseases. Effective 7/1/2050. (HD1)
