Specific Medical Diagnoses in Child Protective Investigations; Providing an exception to the requirement that the Department of Children and Families immediately forward certain allegations to a law enforcement agency; requiring a child protective investigator to inform the subject of an investigation of a certain duty; requiring Child Protection Teams to consult with a licensed physician or advanced practice registered nurse with specified pediatric experience when evaluating certain reports; authorizing a parent or legal custodian of a child who is the subject of certain orders to request specified medical examinations of the child within a specified timeframe, etc.

Public Records/Uterine Fibroid Research Database; Providing an exemption from public records requirements for certain records and personal identifying information submitted to the Department of Health for inclusion in the uterine fibroid research database; providing for future legislative review and repeal; providing a statement of public necessity, etc.

Uterine Fibroid Research Database; Deleting a prohibition on the inclusion of personal identifying information in the uterine fibroid research database, etc.

Historic Cemeteries Trust Fund/Department of State; Creating the Historic Cemeteries Trust Fund within the Division of Historical Resources of the Department of State; requiring that moneys be deposited into the trust fund and disbursed by the division as provided in a specified provision, etc.

Health Care Practitioner Maternal Mental Health Continuing Education Requirements; Providing curriculum requirements relating to maternal mental health for the required continuing education hours for licensure renewal; requiring a board, or the Department of Health if there is no board, to periodically update specified curriculum and accept the successful completion of such curriculum as credit toward continuing education requirements, etc.

Nonparticipating and Out-of-network Nurse Registries and Home Health Agencies; Prohibiting state group health insurance plans and state-contracted health maintenance organizations, the Agency for Health Care Administration, Medicaid managed care plans, individual health insurers, and health maintenance organizations, respectively, and any persons responsible for administering claims on behalf of such plans, organizations, agency, or insurers, from restricting participants, recipients, enrollees, policyholders, and subscribers from obtaining care from nonparticipating or out-of-network licensed nurse registries or home health agencies; revising applicability for group health insurance, blanket health insurance, and franchise health insurance, etc.

Mental Health; Citing this act as the “Tristin Murphy Act”; expanding the programs and diversion initiatives supported by implementation or expansion grants to include training for 911 public safety telecommunicators and emergency medical technicians for certain purposes and to include veterans treatment court programs; encouraging communities to apply for specified grants to establish misdemeanor or ordinance violation mental health diversion programs; encouraging communities to apply for specified grants to establish pretrial felony mental health diversion programs; expanding eligibility for the Forensic Hospital Diversion Pilot Program to include Hillsborough County, etc. APPROPRIATION: $794,880

Home Health Aide for Medically Fragile Children Program; Providing requirements for the annual assessment of the home health aide for medically fragile children program; revising the utilization cap of a Medicaid fee schedule; requiring a home health aide for medically fragile children who works more than 40 hours per week to provide specified justification; requiring the agency to seek federal approval and implement federal waivers and state plan amendments for specified purposes, etc.

Harming or Neglecting Children; Revising the definition of the term “harm” as it relates to a child’s health or welfare; revising the definition of the term “neglect of a child”, etc.

Public Records/Criminal Acts that Evidence Prejudice; Requiring the Attorney General, rather than the Governor, through the Department of Law Enforcement, to collect and disseminate specified information; expanding a public records exemption to include the collection and dissemination of data on incidents of criminal acts that evidence prejudice pursuant specified provisions; providing for future review and repeal of the expanded exemption; providing a statement of public necessity, etc.
