Workers' compensation: employees of the City and County of San Francisco: leaves of absence.

Existing workers' compensation law generally requires employers to secure the payment of workers' compensation, including medical treatment, for injuries incurred by their employees that arise out of, or in the course of, employment. Existing law generally provides that whenever certain public employees, who are employed on a regular, full-time basis, are disabled, whether temporarily or permanently, by injury or illness arising out of, and in the course of, their duties, they are required to become entitled, regardless of their period of service with the public employer, to a leave of absence while so disabled without loss of salary in lieu of temporary disability payments or maintenance allowance payments, if any, that would be payable for the period of disability, but not exceeding one year, or until that earlier date as the employee is retired on permanent disability pension, and is actually receiving disability pension payment, or certain advanced disability pension payment. Existing law specifies certain public employees to whom the above-described provisions shall not apply, including certain employees of the City and County of San Francisco. This bill would provide that the above-described provisions shall apply to certain employees of the City and County of San Francisco. This bill would declare that it is to take effect immediately as an urgency statute.

Disclosure of improper governmental activities: universities: damages.

Existing law, the California Whistleblower Protection Act, authorizes a California State University employee or applicant for employment to have an available action for damages caused by intentional acts of reprisal, retaliation, threats, or coercion under a specified procedure. This bill would authorize an available action for damages or other legal remedies arising on or after January 1, 2011, for a University of California employee or applicant for employment under the same procedure.

Relative to juvenile justice.

This measure would acknowledge the role that substance abuse plays in the lives of juvenile offenders and would set forth the rights of all juveniles in the juvenile justice system. The measure would urge each facility in the state that houses wards or is responsible for the oversight of wards to adopt these rights into the regulations and common practices of the facility.

Relative to Asian Pacific American Mental Health Day.

This measure would recognize May 10, 2010, and each May 10 thereafter, as Asian Pacific American Mental Health Day, and acknowledge the importance of raising awareness about mental health in the Asian Pacific American community.

Relative to secondhand goods.

This measure would urge the Department of Justice to ensure compliance with a requirement that the department develop a standard format to be used statewide for purposes of reporting secondhand dealer transactions.
