Relative to California Holocaust Memorial Week.

This measure would proclaim April 12 through April 18, 2010, as California Holocaust Memorial Week and would urge Californians to observe these days of remembrance for the victims of the Holocaust in an appropriate manner.

Relative to 34th Defense Match for the America's Cup.

This measure would recognize that Californians would benefit from the immense, positive economic impact of hosting the 34th Defense of the America's Cup in San Francisco, California. The measure would petition the BMW ORACLE Racing Team representing the Golden Gate Yacht Club to designate San Francisco, California, to be the host of the 34th Defense of the America's Cup in 2013 or 2014. The measure would urge the state to support San Francisco's bid to host the 34th Defense of America's Cup and to execute the formation of a single face of state government for securing state permits for the America's cup in San Francisco or other state documents.

Income taxes: business tax incentives: reporting information and recapture.

The Personal Income Tax Law and the Corporation Tax Law authorize various credits, deductions, exclusions, exemptions, and other tax benefits with respect to the taxes imposed by those laws. This bill would require a taxpayer, as described, doing business in California that claims a business tax incentive, as provided, to submit to the Franchise Tax Board on the original return specified information, including the number of employees employed by the taxpayer in the state. The bill would also require, in cases in which a taxpayer has a disqualifying event resulting in a net decrease in the number of full-time employees for a business tax incentive added by statute on or after January 1, 2011, the business tax incentive to be recaptured, and the taxable amount computed in accordance with specified procedures.

Vehicles: high-occupancy vehicle lanes.

(1) Existing law authorizes the Department of Transportation to designate certain lanes for the exclusive use of high-occupancy vehicles (HOVs) , which lanes may also be used, until January 1, 2011, or until the Secretary of State receives a specified notice, by certain low-emission, hybrid, or alternative fuel vehicles not carrying the requisite number of passengers otherwise required for the use of an HOV lane, if the vehicle displays a valid identifier. A violation of provisions relating to HOV lane use by vehicles with those identifiers is a crime. This bill would revise that provision to provide that it shall remain in effect only until January 1, 2015, or until the Secretary of State receives that specified notice, with respect to a vehicle that meets California's super ultra-low exhaust emission standard and the federal inherently low-emission evaporative emission (ILEV) standard and a vehicle produced during the 2004 model-year or earlier that meets the California ultra-low emission vehicle standard and the ILEV standard. With respect to all other vehicles described above, this provision shall be operative only until July 1, 2011, or only until the Secretary of State receives that specified notice, whichever occurs first. Existing law requires the Department of Transportation to remove individual HOV lanes, or portions of those lanes, during periods of peak congestion, after making certain findings, including, among other things, a finding that the department demonstrate the infeasibility of alleviating the congestion by other means, including, but not limited to, reducing the use of the lane by noneligible vehicles or further increasing vehicle occupancy. This bill would delete this required finding. The bill, between January 1, 2012, and January 1, 2015, would require the Department of Motor Vehicles to issue up to 40,000 identifiers, that are distinguishable from the identifiers issued for low-emission, hybrid, and alternative fuel vehicles, to vehicles that meet California's enhanced advanced technology partial zero-emission vehicle (enhanced AT PZEV) standard, except the department's authorization to do so would end if the secretary receives the specified notice before then. The bill would authorize vehicles with that identifier to use HOV lanes until January 1, 2015, or until the Secretary of State receives a specified notice, whichever occurs first. By extending and changing the definition of a crime, the bill would impose a state-mandated local program. The bill would make technical and conforming changes. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Relative to Filipino World War II veterans.

This measure would have the Legislature join the Congress of the United States in further acknowledging the service of Filipino World War II veterans in the Armed Forces of the United States by recognizing that these veterans should be reunited with their children during their golden years, and would request that the President and the Congress of the United States pass S. 1337 and H.R. 2412, which would exempt children of certain Filipino World War II veterans from the numerical limitations on immigrant visas, thus allowing for family reunification.

Sentencing.

Existing law provides that the Secretary of the Department of Corrections and Rehabilitation or the Board of Parole Hearings or both may, for specified reasons, recommend to the court that a prisoner's sentence be recalled, and that a court may recall a prisoner's sentence. This bill would authorize a prisoner who was under 18 years of age at the time of committing an offense for which the prisoner was sentenced to life without parole to submit a petition for recall and resentencing to the sentencing court, and to the prosecuting agency, as specified. The bill would establish certain criteria, at least one of which shall be asserted in the petition, to be considered when a court decides whether to conduct a hearing on the petition for recall and resentencing and additional criteria to be considered by the court when deciding whether to grant the petition. The bill would require the court to hold a hearing if the court finds that the defendant's statement is true, as specified. The bill would apply retroactively, as specified. This bill would incorporate amendments to Section 1170 of the Penal Code proposed by AB 2263, contingent on the prior enactment of that bill.

Relative to the Filipino Veterans Equity Compensation Fund.

This measure would urge the President of the United States, Congress, and the United States Department of Veterans Affairs to expedite funding, and lessen the amount of required documentation necessary to allow eligible Filipino and Filipino American veterans to receive payments provided under the Filipino Veterans Equity Compensation Fund.

Charter schools: freedom of speech and of the press.

Existing law grants to public school pupils the right to exercise freedom of speech and of the press, as specified. Existing law requires each governing board of a school district and each county board of education to adopt rules and regulations in the form of a written publications code that includes reasonable provisions for the time, place, and manner for conducting expressive activities within the agency's jurisdiction. Existing law also prohibits school districts operating one or more high schools and private secondary schools from making or enforcing a rule that subjects a high school pupil to disciplinary sanctions solely on the basis of conduct that is speech or other communication that is protected by specified provisions of the United States Constitution and the California Constitution. The Charter Schools Act of 1992 requires a charter school to comply with the act and all of the provisions of the school's charter, but provides that a charter school is otherwise exempt from the laws governing school districts, except for specified provisions. This bill would make those provisions regarding free speech and expressive activities applicable to charter schools. By requiring charter schools to perform additional duties, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Osteopathic Medical Board of California: Naturopathic Medicine Committee.

(1) Existing law, the Osteopathic Act, requires the Governor to appoint 7 licensee members to the Osteopathic Medical Board of California, including 5 osteopathic physicians and surgeons and 2 naturopathic doctors. This provision is repealed on January 1, 2013, at which time the licensee membership of the board will be reduced to 5 osteopathic physicians and surgeons. Existing law also requires the Governor to appoint 2 public members to the Osteopathic Medical Board of California. This bill would exclude those naturopathic doctors from the membership of the board, thereby reducing the licensee membership of the board to 5 osteopathic physicians and surgeons. The bill would add 2 additional public members to the board and would require the Senate Committee on Rules and the Speaker of the Assembly to each appoint one public member. The bill would specify that public members are to receive specified per diem and expenses. (2) Existing law, the Naturopathic Doctors Act, provides for the licensure and regulation of naturopathic doctors by the Naturopathic Medicine Committee within the Osteopathic Medical Board of California. The committee consists of 3 licensed naturopathic doctors, 3 licensed physicians and surgeons, and 3 public members who are appointed by the Governor. Existing law authorizes the committee, with the approval of the board, to appoint an executive officer and authorizes the board to employ other officers and employees as necessary. This bill would change the membership of the committee to 5 licensed naturopathic doctors, 2 licensed physicians and surgeons, and 2 public members. The bill would authorize the committee to appoint an executive officer and other officers and employees as necessary. The bill would make the committee responsible for reviewing the quality of practice by licensed naturopathic doctors and solely responsible for implementing the Naturopathic Doctors Act. The bill would require protection of the public to be the highest priority for the committee.
