This measure would recognize April 23, 2012, to April 30, 2012, inclusive, as Black April Memorial Week, and April 2012 as Vietnamese American month.
This measure would acknowledge the month of April 2012 as Child Abuse Prevention Month, and encourage the people of the State of California to work together to support youth-serving child abuse prevention activities in their communities and schools.
Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law requires a health care service plan to reimburse providers for emergency services and care provided to its enrollees until the care results in stabilization of the enrollee, except as specified, and to reimburse providers for poststabilization care in specified circumstances. Existing law requires group health care service plans to authorize and permit assignment of a Medi-Cal beneficiary's right to reimbursement for covered services to the State Department of Health Care Services, except as specified. This bill would impose that assignment requirement on a group or individual health care service plan, except a plan providing benefits under a specialized health care service plan contract, as defined, and would also require those plans to authorize and permit assignment of an enrollee's or subscriber's right to reimbursement for covered services to the provider furnishing those services, except as specified. The bill would require the provider to provide the plan with certain information in order to receive reimbursement. Because a willful violation of those provisions would be a crime, the bill would impose a state-mandated local program. Existing law provides for the direct payment of group insurance medical benefits by a health insurer to the person or persons furnishing or paying for hospitalization or medical or surgical aid or, in the case of a Medi-Cal beneficiary, to the State Department of Health Care Services, as specified. Existing law requires that the amount of the reimbursement not exceed the amount of the benefit provided by the policy or the amount of expenses incurred on account of the hospitalization or medical or surgical aid. This bill would provide for the direct payment of individual insurance medical benefits by a health insurer, except an insurer providing benefits under a specialized health insurance policy, as defined, to the person who provided the hospitalization or medical or surgical aid where that person has submitted certain information to the insurer for reimbursement. The bill would limit the amount of the reimbursement to the amount of the benefit covered by the policy. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
This measure would call upon all Californians to observe César Chávez's birthday, March 31, as a day of public service, to recognize the hard work and self-sacrifice that farmworkers go through to feed all the families in our state, and to learn from César Chávez's life and his mission of nonviolence, social justice, and selfless service to others.
This measure would designate the month of November 2012 as California Runaway and Homeless Youth Month and would recognize the need for individuals, schools, communities, businesses, local governments, and the state to take action on behalf of runaway and homeless youth in California.
Existing law prohibits employers from ordering a mass layoff, relocation, or termination, as defined, of an industrial or commercial facility employing a prescribed number of people, without first giving 60 days' notice to affected employees and specified government agencies. This bill would make these provisions applicable to a call center employer that employs, or has employed within the preceding 12 months, 50 or more persons. The bill would require a customer service representative who receives or makes a telephone call to a customer residing in the state to identify to the customer the location of the call center from which the customer service representative is calling. The bill would require the customer service representative to transfer the customer to a call center located within the United States, upon request of the customer.
This measure would proclaim California as a Purple Heart State, honoring the service and sacrifices of our nation's men and women in uniform wounded or killed by the enemy while serving to protect the freedoms enjoyed by all Americans.
This measure would proclaim April 15 through April 22, 2012, as California Holocaust Memorial Week and would urge Californians to observe these days of remembrance for the victims of the Holocaust in an appropriate manner.
Existing law authorizes various reports, including reporting missing persons, to be submitted to local law enforcement agencies by mail. This bill would authorize, at the discretion of the local law enforcement agency, a report that is required or authorized by the Penal Code, which is required to be submitted to a local law enforcement agency by mail, to be submitted by a secure electronic mail message.
