Relative to Family Justice Centers.

This measure would declare March 5, 2020, as Family Justice Center Day in California and would recognize the lifesaving and hope-giving work of the California Family Justice Center Network and its member Family Justice Centers as they work with rape crisis centers, domestic violence shelters, human trafficking agencies, prosecutors' offices, law enforcement agencies, and other professionals and community-based organizations to ensure that adult and child survivors of trauma can access all of their services in one setting.

Relative to California Arbor Day.

This measure would recognize March 7, 2020, as California Arbor Day, and would urge California residents to observe the day with appropriate tree-planting activities and programs.

Civil rights crimes.

Existing law makes it a misdemeanor to, by force or threat of force, willfully injure, intimidate, interfere with, oppress, or threaten another person in the free exercise or enjoyment of a right or privilege secured by the Constitution or laws of this state or by the Constitution or laws of the United States in whole or in part because of one or more of specified actual or perceived characteristics of the victim, including disability, gender, religion, race, or sexual orientation. Existing law also makes it a misdemeanor to knowingly deface, damage, or destroy the real or personal property of another person for the purpose of intimidating or interfering with the free exercise or enjoyment of a right or privilege secured by the Constitution or laws of this state or by the Constitution or laws of the United States, in whole or in part because of one or more of the same actual or perceived characteristics of the victim. This bill would make the above crimes punishable either as a misdemeanor or as a felony, to be served in county jail for 18 months, or 2 or 3 years. By increasing the punishment for a crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Greenhouse Gas Reduction Fund: recycling: appropriation.

The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The act authorizes the state board to include use of market-based compliance mechanisms. Existing law requires all moneys, except for fines and penalties, collected by the state board as part of a market-based compliance mechanism to be deposited in the Greenhouse Gas Reduction Fund and to be available upon appropriation. Existing law continuously appropriates 35% of the annual proceeds of the fund for transit, affordable housing, and sustainable communities programs, 25% of the annual proceeds of the fund for certain components of a specified high-speed rail project, and 5% of the annual proceeds of the fund, up to the sum of $130,000,000 annually, until June 20, 2030, for transfer to the Safe and Affordable Drinking Water Fund. This bill, beginning in the 2020–21 fiscal year, would continuously appropriate $100,000,000 from the fund annually to the Department of Resources Recycling and Recovery for in-state organic waste recycling projects that reduce greenhouse gas emissions and achieve certain organic waste disposal goals, as specified. The bill, beginning in the 2020–21 fiscal year, would also continuously appropriate $100,000,000 from the fund annually to the department for in-state recycling projects that reduce greenhouse gas emissions and help achieve a specified state policy relating to solid waste, as specified.

Vehicle history reports: liability.

Existing law prohibits a dealer from displaying or offering for sale at retail a used vehicle unless the dealer first obtains a vehicle history report from the National Motor Vehicle Title Information System (NMVTIS) . The NMVTIS data provider may include in the vehicle history report additional history information obtained from resources other than NMVTIS. This bill would provide that a dealer is not liable to a party to an actual or potential vehicle sale or lease for the accuracy of, or any errors or omissions contained in, a vehicle history report, as defined, if the inaccuracies, errors, or omissions contained in the report are not based on information provided to the vehicle history report provider by that dealer.

Genealogy companies: advertising.

The California Consumer Privacy Act of 2018 grants a consumer various rights regarding personal information held by a business, including the right to request a business to disclose specific pieces of personal information it has collected and to have information held by that business deleted, as specified. The act also requires a business to make specified disclosures in its privacy policy or on its internet website, as specified, regarding a consumer's rights under the act. Existing law requires that specified sellers make certain factual disclosures to consumers. This bill would require a genealogy company, as defined, to display a notice in all advertising, it's privacy policies, at the point of sale of the product, and on product packaging. The bill would require the notice to state, in part, that aggregate data that is not reasonably linkable to an individual person may be sold to third parties. The bill would require the notice to meet specified requirements that vary depending on the method of dissemination.

Workers' compensation.

Existing law establishes a workers' compensation system, administered by the Administrative Director of the Division of Workers' Compensation, to compensate an employee for injuries sustained in the course of employment. This bill would make these provisions gender neutral, correct or delete erroneous cross-references, update obsolete terms, delete obsolete and invalid provisions, correct technical errors, and make clarifying and conforming changes.

Relative to Maternal Health Awareness Day.

This measure would proclaim January 23, 2020, as Maternal Health Awareness Day, to draw attention to the efforts that have improved maternal health in California and to highlight the need for continued improvement of maternal health for all women.
