Professional land surveyors: surveying practices: monuments and corner accessories.

The Professional Land Surveyors' Act provides for the licensure and regulation of land surveyors by the Board for Professional Engineers, Land Surveyors, and Geologists, which is within the Department of Consumer Affairs, and requires any person practicing, or offering to practice, land surveying in the state to submit evidence that they are qualified to practice and to be licensed under the act. Among other things, the act requires a land surveyor, when filing a corner record with the county surveyor or engineer of the county where the corner is situated, to ensure a corner accessory or monument is reconstructed or rehabilitated so that it remains permanently fixed, as specified. This bill would instead require a land surveyor, when using a monument with a physical condition that is less than permanent and durable as control in any survey, to reconstruct or rehabilitate the monument to a permanent condition, as specified.

Civil service: veterans' preference.

Existing law, the State Civil Service Act, requires the Department of Human Resources to administer the Personnel Classification Plan of the State of California, including allocating every position to the appropriate class. Existing law requires the allocation of a position to a class be derived from, and determined by, ascertaining the duties and responsibilities of the position, and be based on the principle that all positions are to be included in the same class if certain qualifications apply, including, but not limited to, that the positions are sufficiently similar in respect to duties and responsibilities that the same descriptive title may be used, and substantially the same requirements as to education, experience, knowledge, and ability are demanded of incumbents. Existing law also prescribes a comprehensive civil service personnel system for the state and specifically provides certain preferences for veterans. Existing law grants to a person retired from the United States military, honorably discharged from active military duty with a service-connected disability, or honorably discharged from active duty eligibility for civil service examinations for which they meet the minimum qualifications for the classification. Existing law requires that, in evaluating minimum qualifications, related military experience be considered state civil service experience in a comparable class, based on the duties and responsibilities assigned. This bill would require the department, on or before January 1, 2026, to review the department Personnel Classification Plan of the State of California and identify which classes are compatible with creating a waiver for a bachelor's degree requirement for a veteran, as defined, who has served at the level of E-6 or higher for more than 2 years. For a class identified by the department, where a bachelor's degree is required as a minimum qualification for a civil service examination, the bill would require the department to, commencing July 1, 2026, waive the bachelor's degree requirement for a veteran who has served at the level of E-6 or higher for more than 2 years.

Crime: fentanyl trafficking.

Existing law authorizes the Attorney General or a district attorney to make an application, as specified, to a judge of a superior court, for an order authorizing the interception of wire or electronic communications. Existing law authorizes a judge, upon a finding of probable cause as that an individual is committing, has committed, or is about to commit offenses involving a substance containing fentanyl or its precursors or analogs that exceeds 10 gallons by liquid volume or 3 pounds of solid substance by weight, to issue an order authorizing the interception. This bill would reduce the above-described amounts for an order authorizing interception to 1.67 gallons by liquid volume and 8 ounces of solid substance by weight of a substance containing fentanyl or its precursors or analogs.

Income taxation: exclusion: military survivor benefits.

The Personal Income Tax Law, in modified conformity with federal law, generally defines "gross income" as income from whatever source derived, except as specifically excluded, and provides various exclusions from gross income for purposes of computing tax liability. Existing law requires any bill authorizing a new tax expenditure to contain, among other things, specific goals, purposes, and objectives that the tax expenditure will achieve, detailed performance indicators, and data collection requirements. This bill, for taxable years beginning on or after January 1, 2025, and before January 1, 2035, would provide an exclusion from gross income for survivor benefits or payments, not to exceed $20,000 per taxable year, received during the taxable year under the federal Survivor Benefit Plan. Existing law requires any bill authorizing a new tax expenditure to contain, among other things, specific goals that the tax expenditure will achieve, detailed performance indicators, and data collection requirements. This bill would include additional information required for any bill authorizing a new tax expenditure. This bill would take effect immediately as a tax levy.

School districts: reorganization.

Existing law authorizes the State Board of Education to approve proposals for the reorganization of school districts if the state board has determined, with respect to the proposal and the resulting school districts, that specified conditions, including, among others, that the reorganized school districts will be adequate in terms of number of pupils enrolled and that the school districts are each organized on the basis of a substantial community identity, are substantially met, except as otherwise provided for exceptional situations. This bill would require the state board to make its decision regarding a proposal for a reorganization pursuant to these provisions within 24 months of receiving the application.

Public contracts: Small Business Procurement and Contract Act.

The Small Business Procurement and Contract Act permits a state agency to award a contract for goods, services, or information technology with a value of between $5,000 and $250,000 to a certified small business, including a microbusiness and a disabled veteran business enterprise, without complying with specified competitive bidding requirements. This bill would increase the maximum amount of a contract awarded pursuant to the act from $250,000 to $500,000.

Crimes: Grant program for identifying, apprehending, and prosecuting resale of stolen property.

Existing law, as amended by the Safe Neighborhoods and Schools Act, enacted as an initiative statute by Proposition 47, as approved by voters at the November 4, 2014, statewide general election, makes it a crime to buy, receive, conceal, sell, or withhold any property that has been stolen or that has been obtained in any manner constituting theft or extortion, knowing that the property has been so obtained. Under existing law, this offense is punishable as either a misdemeanor or a felony, unless the value of the property does not exceed $950, in which case an offense is punishable as a misdemeanor. Existing law establishes the Board of State and Community Corrections to provide statewide leadership, coordination, and technical assistance to promote effective state and local efforts and partnerships in California's adult and juvenile criminal justice system, as specified. Under existing law, the board administers several grant programs, including a mentally ill offender crime reduction grant program, a medication-assisted treatment grant program, and a violence intervention and prevention grant program. This bill would, until January 1, 2030, create the Identifying, Apprehending, and Prosecuting Resale of Stolen Property Grant Program to be administered by the board. The bill would require the board to award grants, on a competitive basis, to county district attorneys' offices and law enforcement agencies, acting jointly to investigate and prosecute receiving stolen goods crimes and criminal profiteering. The bill would require the board to prepare and submit a report to the Legislature, as specified, regarding the impact of the grant program. The bill's provisions would be operative only to the extent that funding is provided, by express reference, in the annual Budget Act or another statute.

State parks: armed services: free access.

Existing law requires the Department of Parks and Recreation to issue a park pass for free use of all park facilities in the state park system to a veteran, as described, who presents to the department proof of a disability, proof of being held captive as a prisoner of war, or proof of being a recipient of a Congressional Medal of Honor, and proof of an honorable discharge from service. This bill would require the department to grant to a resident of this state who is a veteran or current active duty or reserve military personnel for the United States Armed Forces or the California National Guard free access to a unit of the state park system that is operated by the state and accessible with a vehicle day use annual pass, if proper proof of military service is provided, as specified.
