Adverse childhood experiences: post-traumatic "street" disorder.

This measure would recognize adverse childhood experiences (ACEs) , also known as post-traumatic "street" disorder in communities of color, as having lasting negative outcomes to both physical and mental health with growing implications for our state.

Cannabis use: location restrictions.

The Control, Regulate and Tax Adult Use of Marijuana Act (AUMA) , an initiative statute enacted by the approval of Proposition 64 at the November 8, 2016, statewide general election, authorizes a person 21 years of age or older to possess and use specified amounts of cannabis. AUMA specifies that possessing, smoking, or ingesting cannabis or cannabis products in or upon the grounds of a school, day care center, or youth center while children are present is prohibited. AUMA makes a violation of this location restriction punishable as an infraction or a misdemeanor, as specified. AUMA authorizes the Legislature to amend its provisions with a 23 vote of each house of the Legislature, if the amendments are consistent with and further the purposes and intent of the act. This bill would prohibit the possession, smoking, or ingesting of cannabis or cannabis products in or upon the grounds of a school, day care center, or youth center, regardless of whether children are present. By expanding the scope of a crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Murder: peace officers.

Under existing law, a murder perpetrated by specified means or under certain circumstances, including a killing that is willful, deliberate, and premeditated, is defined as murder of the first degree. All other kinds of murder are of the 2nd degree. Under existing law, a person convicted of first degree murder is subject to a punishment of death, life in prison without the possibility of parole, or confinement in the state prison for a term of 25 years to life. Under existing law, the 2nd degree murder of a peace officer, as specified, is punishable by imprisonment in the state prison for a term of 25 years to life, and the 2nd degree murder of a peace officer, if specified facts are charged and found true, is punishable by imprisonment in the state prison for a term of life without the possibility of parole. This bill would state the findings and declarations of the Legislature that the unlawful killing of a peace officer, as defined, that is deliberate, willful, and premeditated is murder of the first degree for purposes of the gravity of the offense and the support of the survivors. The bill would identify these findings as declaratory of existing law.

State property acquisition: West Coyote Hills project site: funding.

Existing law generally authorizes the Director of General Services to acquire title to real property in the name of the state whenever the acquisition of real property is authorized or contemplated by law, if no other state agency is specifically authorized and directed to acquire it. Existing law establishes the State Coastal Conservancy and prescribes the membership, functions, and duties of the conservancy with regard to the protection, preservation, restoration, and enhancement of specified coastal lands. Existing law establishes the Coastal Trust Fund in the State Treasury. This bill would require that the $15,000,000 appropriated in the Budget Act of 2017 for the purposes of SB 714 of the 2017–18 Regular Session be deposited in the West Coyote Hills Conservancy Program Account in the Coastal Trust Fund to be used for the purchase of specified property and related projects. The bill would make findings and declarations regarding funding under the bill for the Wildlife Conservation Board to open up, operate, and maintain the Robert E. Ward Nature Preserve. The bill would state the intent of the Legislature in enacting this act to specify the particular uses of the appropriated funds.

Relative to the 135th anniversary of the Chinese Exclusion Act.

This measure would mark May 6, 2017, as the 135th anniversary of the enactment of the Chinese Exclusion Act in order to recognize the harm caused by racially discriminatory immigration measures, and to honor the contributions of all immigrants and refugees who have enriched our communities. The measure would also declare the opposition of the Legislature to recent executive orders signed by President Trump relating to immigration, call upon the President to revoke those orders, condemn the expansion of deportations being undertaken under the current presidential administration, and reaffirm that the state is open and welcoming to immigrants and refugees who are integral to life in our state.
