Sickle Cell Disease Awareness Month.

This measure would recognize September 2020 as Sickle Cell Disease Awareness Month and encourage the Legislature to appropriate funds for research, treatment, and monitoring of sickle cell disease, and for related education and outreach.

Relative to Chinese American Day.

This measure would designate October 23, 2020, as Chinese American Day in California to highlight the important historical contributions of Chinese Americans to California and to the United States of America.

Relative to mental health and substance use treatment.

This measure would urge specified state departments and the Attorney General to use their authority to ensure that health care service plans and health insurers subject to their authority comply with the federal Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008.

Used Mattress Recovery and Recycling Act.

The Used Mattress Recovery and Recycling Act, administered by the Department of Resources Recycling and Recovery, authorizes a mattress recycling organization to be established by a qualified industry association to develop, implement, and administer a mattress recycling program in the state. The act requires the organization to develop and submit to the department for approval a plan, including a budget to implement the plan, for the recovery and recycling of used mattresses. The act requires the organization to submit to the department and make publicly available annual reports relating to the program. The act requires the department's director to appoint an advisory committee to be part of the organization. The act requires the organization to set the amount of a state mattress recycling charge to fund the recycling of used mattresses under the act that is added to the purchase price of a mattress, and authorizes the organization to change the amount of the charge. The act requires a mattress retailer to give a consumer the option to have a used mattress picked up, at no additional cost, at the time a new mattress is delivered. A violation of the act may be subject to an administrative civil penalty. This bill would revise and recast provisions of the act, including requiring the organization to review the plan and determine whether amendments to the plan are necessary every 5 years. The bill would require the organization to include additional specified information and goals in the plan, the budget, and the annual reports, and would require the advisory committee to prepare written recommendations for the organization. The bill would prohibit, commencing January 1, 2027, the organization's financial reserve from exceeding 60% of its annual operating expenses, except as specified. The bill would prohibit the revenue from the charge from being expended for a specified purpose. The bill would also require the department to establish a process and schedule for an orderly transition of responsibility from a decertified mattress recycling organization to a successor organization, as specified.

Traffic safety: work zones: positive protection measures.

Existing law authorizes traffic to be restricted through or around the work on streets and highways whenever the traffic would endanger the safety of workers or the work would interfere with, or endanger the movement of, traffic through the work zone. Existing law authorizes traffic in work zones to be regulated by warning signs, lights, appropriate control devices, or by a person or persons controlling and directing the flow of traffic. This bill would require the Department of Transportation to update guidance by July 1, 2021, to specify the appropriate use of positive protection measures with the goal of isolating workers or work zones from traffic. The bill would require the department to provide compensation for the use of a safety device where the updated guidance allows, but does not require, the optional safety device when requested by a contractor on a public works project. The bill would require the department to submit a report to the Legislature by January 1, 2024, that includes findings and recommendations on the use of positive protection measures used pursuant to these provisions. The bill would make legislative findings and declarations in support of these provisions.

Self-generation incentive program: community energy storage systems: high fire threat districts.

Existing law requires the Public Utilities Commission to require the administration, until January 1, 2026, of a self-generation incentive program to increase the development of distributed generation resources and energy storage technologies. Existing law authorizes the commission, in administering the program, to adjust the amount of rebates and evaluate other public policy interests, including, but not limited to, ratepayers, energy efficiency, peak load reduction, load management, and environmental interests. This bill would require the commission, in administering the self-generation incentive program, to allocate at least 10% of the annual collection for the program in the 2020 calendar year for the installation of energy storage and other distributed energy resources for customers that operate critical facilities or critical infrastructure serving communities in high fire threat districts to support resiliency during a deenergization event. The bill would require the commission, when allocating these funds, to prioritize funding to projects for eligible customers meeting specified criteria. The bill would require the commission to include an evaluation of the performance and impact of projects funded in a relevant self-generation incentive program evaluation report no later than December 31, 2022.

Pest control: Pierce's disease.

Existing law establishes the Pierce's Disease Control Program in the Department of Food and Agriculture and requires the Governor to appoint a statewide coordinator. Existing law establishes the Pierce's Disease Management Account in the Food and Agriculture Fund and allows certain money in this account to be expended to combat Pierce's disease and its vectors, including the glassy-winged sharpshooter, and for purposes relating to other designated pests and diseases, as provided. Existing law makes these provisions inoperative on March 1, 2021, and repeals them on January 1, 2022. This bill would extend to March 1, 2026, the date on which the above provisions become inoperative, and would repeal those provisions on January 1, 2027. The bill would require the Secretary of Food and Agriculture to appoint a statewide coordinator. By extending the operative date for a partially continuously appropriated fund, this bill would make an appropriation. Existing law creates in the department the Pierce's Disease and Glassy-winged Sharpshooter Board, which consists of specified members, and prescribes the functions and duties of the board with respect to implementation of the Pierce's disease program. Existing law provides for an annual assessment to be paid by grape processors, as defined, into the Food and Agriculture Fund and continuously appropriates the collected funds for the purposes of, among other things, research and other activities related to the Pierce's disease program. Existing law repeals these provisions on March 1, 2021. This bill would extend the repeal date of these provisions to March 1, 2026, and would make related conforming changes. By extending the date until which the assessments are collected, the bill would make an appropriation.

Horse racing: state-designated fairs: employees.

Existing law requires any revenues deposited into the Fair and Exposition Fund, a continuously appropriated fund established in the State Treasury containing, among other things, a percentage of gross receipts for sales and use taxes on state-designated fair property, to only be allocated to a state-designated fair if nonmanagement employees at that state-designated fair, or nonmanagement employees at any real property of that state-designated fair that is leased to another party, are provided certain working conditions, including that the employees receive a meal period of not less than 30 minutes, as provided. This bill would provide that an employee, for purposes of the above paragraph, does not include an employee covered by a valid collective bargaining agreement if the agreement expressly provides for certain things, including meal periods for those employees. By expanding the use of continuously appropriated funds, the bill would make an appropriation. This bill would declare that it is to take effect immediately as an urgency statute.

Relative to Leyte Landing Commemoration Day.

This measure would designate October 20, 2019, and each 20th day of October thereafter, as Leyte Landing Commemoration Day in recognition of the significance of the Leyte landing in liberating the Philippines from Japanese occupation and would also honor the significant contributions to California made by generations of Filipino Americans since that time.
