Medi-Cal: antipsychotic drugs.

Existing law establishes the Medi-Cal program, administered by the State Department of Health Care Services and under which health care services are provided to qualified low-income persons pursuant to a schedule of benefits. The Medi-Cal program is, in part, governed and funded by federal Medicaid program provisions. Existing law provides for the provision of prescription drugs as a Medi-Cal benefit, subject to the list of contract drugs and utilization controls. Existing law limits prescribed drugs under the Medi-Cal program to 6 drugs per month, unless prior authorization is obtained, and except under specified circumstances. This bill would prohibit requiring prior authorization for an antipsychotic drug to treat the serious mental illness of a Medi-Cal enrollee for 365 days after the initial prescription has been dispensed, and would require automatic approval of an antipsychotic drug to treat the serious mental illness of a Medi-Cal enrollee if the department verifies a paid claim that documents a diagnosis of a serious mental illness within 365 days before the date of that prescription. The bill would exclude an antipsychotic drug to treat serious mental illness from the Medi-Cal program's limit of 6 drugs per month. The bill would require the department to allow a pharmacist to dispense a 90-day supply or early refill of a prescribed antipsychotic drug if specified criteria are met.

Veterans: education.

Existing law establishes the California Veterans' Educational Institute, which is under the management and control of the Department of Veterans Affairs, for the purpose of providing opportunities for veterans to continue their education. Existing law allows qualifying veterans who desire to continue their education to apply for admission to the institute and, if the Department of Veterans Affairs determines the educational needs of the veteran will be met, directs the department to assume state wardship over the education of the veteran. Existing law permits the department to provide for a veteran's education in California, in other states, and in other countries. This bill would limit the department's ability to provide for a veteran's education to educational institutions in California. This bill would make other technical, nonsubstantive changes to the provision.

Relative to Family Justice Centers.

This measure would declare March 5, 2020, as Family Justice Center Day in California and would recognize the lifesaving and hope-giving work of the California Family Justice Center Network and its member Family Justice Centers as they work with rape crisis centers, domestic violence shelters, human trafficking agencies, prosecutors' offices, law enforcement agencies, and other professionals and community-based organizations to ensure that adult and child survivors of trauma can access all of their services in one setting.

Relative to California Arbor Day.

This measure would recognize March 7, 2020, as California Arbor Day, and would urge California residents to observe the day with appropriate tree-planting activities and programs.

Rosa Parks Day in California: 20th Anniversary.

This measure would memorialize the achievements of Rosa Parks in the Civil Rights Movement and would commemorate the 20th Anniversary of Rosa Parks Day in California on February 4, 2020.

Veterans' homes: leases.

Existing law authorizes the Director of General Services to lease or let any real property held by the Department of Veterans Affairs for a home, and not needed for any direct or immediate purpose of the home, to any entity or person upon terms and conditions determined to be in the best interests of the home. Existing law generally requires moneys received in connection with the leasing or letting of a home to be deposited in the General Fund. This bill would create the Veterans' Home Fund. The bill would require moneys received in connection with the leasing or letting of a home to be deposited in the Veterans' Home Fund. The bill would provide that money in the fund is available, upon appropriation by the Legislature, for the maintenance of existing homes and for the acquisition or construction of new or replacement homes, as specified.

Common interest developments: funds: insurance.

Existing law, the Davis-Stirling Common Interest Development Act, regulates common interest developments and requires a managing agent, at the written request of the board of directors of the association, to deposit funds the managing agent receives on behalf of the association into a bank, savings association, or credit union in the state if specified requirements are met. This bill would require the bank, savings association, or credit union to be insured by the Federal Deposit Insurance Corporation, National Credit Union Administration Insurance Fund, or the Securities Investor Protection Corporation. Existing law prohibits transfers of greater than $10,000 or 5% of an association's total combined reserve and operating account deposits, whichever is lower, without written approval from the board. This bill would instead prohibit transfers of $10,000 or greater without prior written approval from the board. Existing law requires the association to maintain fidelity bond coverage for its directors, officers, and employees, and requires the fidelity bond coverage to also include computer fraud and funds transfer fraud and, if the association uses a managing agent or management company, coverage for dishonest acts by that person or entity and its employees. This bill would specifically require the association to maintain crime insurance, employee dishonesty coverage, and fidelity bond coverage, or their equivalent, for the association and the association's managing agent or management company and would require the protection against computer and funds transfer fraud to be in an equal amount.
