Existing law vests the Public Utilities Commission with regulatory authority over public utilities, including telephone corporations. Existing law requires the commission to design and implement a program to provide a telecommunications device capable of serving the needs of individuals who are deaf or hearing impaired, together with a single party line, at no charge additional to the basic exchange rate, to any subscriber who is certified as an individual who is deaf or hearing impaired by a licensed physician and surgeon, audiologist, or a qualified state or federal agency, as determined by the commission. Existing law also authorizes a physician assistant or nurse practitioner to certify the needs of an individual who has been diagnosed by a physician and surgeon as being deaf or hard of hearing to participate in the program after reviewing the medical records or copies of the medical records containing that diagnosis. Existing law additionally requires the commission to design and implement a program whereby specialized or supplemental telephone communications equipment may be provided to a subscriber who is certified to be disabled at no charge additional to the basic exchange rate. Existing law requires that the certification, including a statement of visual or medical need for specialized telecommunications equipment, be provided by a licensed optometrist, physician and surgeon, physician assistant, or nurse practitioner, acting within the scope of practice of the applicable license, or by a qualified state or federal agency as determined by the commission. Existing law additionally requires the commission to design and implement a program to provide access to a speech-generating device to a subscriber who is certified as having a speech disability at no charge additional to the basic exchange rate. Existing law requires that the certification be provided by a licensed physician, licensed speech-language pathologist, nurse practitioner, or qualified state or federal agency. This bill would remove all of the above-described certification requirements for a subscriber and would make conforming changes. Under existing law, a violation of an order, decision, rule, direction, demand, or requirement of the commission is a crime. Because a violation of a commission action implementing the bill's requirements would be a crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

This measure would strongly encourage the Congress of the United States to pass H.R. 1235 to establish a Federal Infrastructure Bank to facilitate the financing of urgently needed infrastructure projects in the United States.

Existing law establishes a system of public elementary and secondary schools in this state and provides for their funding and governance. Existing law establishes school districts throughout the state to administer the public elementary and secondary schools within their respective jurisdictions. This bill would authorize school districts to establish auxiliary organizations, as defined, for purposes of providing supportive services and specialized programs for the general benefit of schoolsites, as defined. The bill, among other things, would require a school district that establishes an auxiliary organization, in accordance with regulations adopted by the State Department of Education, to institute an accounting and reporting system for the operation of the auxiliary organization, and procedures to ensure that transactions of the auxiliary organization are within the educational mission of the school district, as specified.

If a citizens' initiative measure that imposes a retail transactions and use tax in the County of Fresno, as specified, is adopted by the electors of the County of Fresno and becomes effective, this bill would designate the Fresno Council of Governments as a local transportation authority for purposes of the citizens' initiative measure. The bill would authorize the Fresno Council of Governments to receive and allocate the proceeds of the retail transactions and use tax and to otherwise serve as the administering agency for purposes of that citizens' initiative. This bill would make legislative findings and declarations as to the necessity of a special statute for the Fresno Council of Governments.

Existing law, the Digital Age Assurance Act, requires, beginning January 1, 2027, an operating system provider to provide an accessible interface at account setup that requires an accountholder to indicate the birth date, age, or both, of the user of that device for the purpose of providing a signal regarding the user's age bracket to applications available in a covered application store, among other things related to providing a uniform system for obtaining age information about a user of certain software applications. Existing law defines "user" for these purposes to mean a child that is the primary user of the device. This bill would establish the e-Safety Commission, as specified, and would require the commission to develop minimum age compliance guidelines for covered entities, as defined, review age assurance technologies used to implement the minimum age verification, and establish procedures for noncompliance investigations. The bill would require, on or before January 1 of each year, the commission to report to the Legislature and the Governor on its activities pursuant to the bill, as specified.
