Relative to Data Privacy Week.

This measure would designate, in perpetuity, the 4th week of January as Data Privacy Week and the last Sunday of January as Data Privacy Day.

Voter registration database: Electronic Registration Information Center.

Existing law requires the Secretary of State to establish a statewide system to facilitate removal of duplicate or prior voter registrations to facilitate the reporting of election results and voter and candidate information and to otherwise administer and enhance election administration. Existing law also requires that certain voter registration information be provided to, among others, any person for election, scholarly, journalistic, or political purposes, or for governmental purposes, as determined by the Secretary of State. This bill would require the Secretary of State to apply for membership with the Electronic Registration Information Center and, if that application is approved, require the Secretary of State to execute a membership agreement with the Electronic Registration Information Center on behalf of the state. The bill would require the Secretary of State to ensure that any confidential information or data provided by another state remains confidential, and would authorize the Secretary of State to transmit confidential information or data pursuant to that agreement. The bill would prohibit the disclosure of any information or data related to citizenship and certain types of driver's licenses and identification cards, as specified. The bill would also authorize the Secretary of State to adopt regulations necessary to implement these provisions and would require the Secretary of State to receive a certification from the Department of Technology that all proper cybersecurity protections are in place prior to sending any data or information to the Electronic Registration Information Center.

Crimes: disorderly conduct.

Existing law defines specified behavior as disorderly conduct and prohibits that behavior. Under existing law, disorderly conduct includes, among other things, soliciting prostitution, prowling, peeping, surreptitious photographing or filming of an identifiable person, and the distribution of certain images of another person taken under circumstances in which the person understands that the image shall remain private, the distribution of which causes serious emotional distress. This bill would add to the definition of disorderly conduct the distribution of those images recorded, captured, or otherwise obtained without the authorization of the person depicted or by exceeding authorized access from the property, accounts, messages, files, or resources of the person depicted. Because the bill would expand the scope of a crime, it would establish a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.

Regional park and open-space districts: general manager: powers.

Existing law generally authorizes the general manager of a park or open-space district, with district board approval, to bind the district, in accordance with board policy, and without advertising, for the payment for supplies, materials, labor, or other valuable consideration for any purpose in amounts not exceeding $50,000. Existing law authorizes the district, by action of the board in an open meeting, to increase the amount by which the general manager of the district may bind the district above that limit. This bill would increase the amount by which the general manager of a district with a population of 200,000 or more may bind the district to not exceeding $200,000, as provided. The bill would authorize a park or open-space district with a population of 200,000 or more, by action of the board in an open meeting, to increase the amount by which the general manager of the district may bind the district above that limit, as specified.

Sentencing enhancements: property loss.

State law, repealed as of January 1, 2018, required a court to impose an additional term of imprisonment, as specified, on any person who takes, damages, or destroys any property in the commission or attempted commission of a felony, as specified. This bill would, until January 1, 2028, authorize the court, if a person takes, damages, or destroys property in the commission or attempted commission of a felony, with the intent to cause that taking, damage, or destruction, to impose an additional term of imprisonment of up to 2 years if the property loss exceeds $275,000, an additional term of imprisonment of up to 3 years if the property loss exceeds $1,750,000, or an additional term of imprisonment of up to 4 years if the property loss exceeds $4,400,000. Existing law provides for enhanced penalties against a person who commits 2 or more related felonies, a material element of which is fraud or embezzlement, that involve a pattern of related felony conduct, and the pattern of related felony conduct involves the taking or loss of more than $100,000. Existing law makes the additional punishment, if it involves the taking or loss of more than $500,000, a term of 2, 3, or 5 years in the state prison. Existing law, until January 1, 2018, due to an obsolete cross-reference to the repealed provisions described above, made the additional punishment, if it involves a taking or loss of more than $100,000 but less than $500,000, punishable by 2 years in the state prison if the loss was more than $200,000, and one year if the loss was less than that. This bill would remove that obsolete cross-reference and make that additional punishment equal to 2 years in the state prison. Because this bill would increase the penalty for existing felonies, it would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
