Public employees' retirement: pension fund management.

Existing law establishes the Public Employees' Retirement System and the State Teachers' Retirement System. These systems provide defined pension benefits to public employees based on age, service credit, and final compensation. The California Constitution confers upon the retirement boards of public retirement systems plenary authority and fiduciary responsibility for the investment of moneys of those systems. Existing law authorizes these public retirement system boards, consistent with their fiduciary duties and the standard for prudent investment, to prioritize investment in an in-state infrastructure project over a comparable out-of-state infrastructure project. This bill would require specified staff of the Public Employees' Retirement System to work with appropriate state agencies to produce an annual list, that may be provided to each board, of priority infrastructure projects most suitable for funding.

Relative to smoke-free multiunit housing.

This measure would encourage the construction and designation of smoke-free multiunit housing by local jurisdictions across the state to reduce health disparities and improve the health and well-being of all Californians.

Relative to the 68th anniversary of the Korean War.

This measure would, among other things, mark June 25, 2018, as the 68th anniversary of the Korean War and encourage participants in specified discussions regarding North and South Korea to have a sincere intention of achieving peace in the region.

Dolores Huerta Day.

Existing law requires the Governor to proclaim certain days each year for specified reasons. Existing law also designates particular days each year as having special significance and encourages all public schools and educational institutions to observe those days and to conduct suitable commemorative exercises on those days. This bill would require the Governor to annually proclaim April 10 as Dolores Huerta Day, would designate and set apart that date each year as having special significance, and would encourage all public schools and educational institutions to observe that date by conducting exercises remembering the life of Dolores Huerta and recognizing her accomplishments and the contributions she made to the state.

Guardianship: special immigrant juveniles.

The Guardianship-Conservatorship Law generally establishes the standards and procedures for the appointment and termination of an appointment for a guardian or conservator of a person, an estate, or both. Existing law authorizes a nonprofit charitable corporation to be appointed as a guardian or conservator of the person or estate, or both, if certain conditions are met, including, if the corporation is incorporated in this state. Existing law requires a nonprofit charitable corporation appointed as a guardian or conservator to meet specific requirements, including, notifying the court of a change in the person who is the responsible corporate officer for compliance with the legal requirements of acting as guardian, as specified. Existing law limits the compensation for a nonprofit charitable corporation or its attorney to compensation for services actually rendered. This bill would, until January 1, 2022, enact comparable provisions authorizing a nonprofit charitable corporation that was not incorporated in this state to be appointed as a guardian of a minor in connection with a petition regarding special immigrant juvenile status, if the nonprofit charitable corporation otherwise meets the requirements described above, is licensed by the state, as specified, and is contracted by a specific federal office to provide care and custody for the minor. The bill would state findings and declarations of the Legislature relative to special immigrant juveniles.

Relative to World Oceans Day.

This measure would recognize June 8 as World Oceans Day, and would declare that the Legislature intends to act decisively in 2018 in regard to passing legislation aimed at reducing plastic pollution in California rivers, beaches, and ocean, and would further declare that the State of California is determined to seek additional ways to curb plastic pollution on those waterways and beaches, and in other natural spaces and communities.

Relative to Philippine Independence Day.

This measure would recognize June 12, 2018, as the 120th Anniversary of Philippine Independence and would call upon the people of the state to observe the month of June with appropriate ceremonies, programs, and activities.

Insurance: policy documents.

Existing law requires an insurer, after a covered loss under a fire insurance policy, to provide the insured with a free copy of his or her policy within 30 calendar days of receiving a request from the insured, but allows the Insurance Commissioner to extend this period. Existing law also provides that an insured who does not experience a covered loss shall, upon request, be entitled to one free copy of his or her policy annually. This bill would specify that the copy of the policy provided shall be a complete copy of the policy in effect at the time of the loss and shall include the full policy, any endorsements to the policy, and the policy declarations page. The bill would authorize an insurer that is not compliant with specified electronic document transmission requirements to provide a copy of the entire policy in electronic form if the covered loss is the result of a state of emergency and the electronic copy is requested by an insured who has not elected to receive electronic documents. The bill would require an insurer that is compliant with those requirements to provide an electronic copy of the entire policy if the same criteria are met. The bill would provide that request by an insured under these circumstances is not a request to receive future electronic communications.

Disability compensation: paid family leave.

Existing law establishes, within the state disability insurance program, a family temporary disability insurance program, also known as the paid family leave program, for the provision of wage replacement benefits to workers who take time off work to care for a seriously ill family member or to bond with a minor child within one year of birth or placement, as specified. Existing law, before January 1, 2018, deemed an individual to be eligible for family temporary disability benefits if, among other things, the individual was unable to perform his or her regular or customary work for a 7-day waiting period during each disability benefit period, and prohibited payments for benefits during this waiting period. Existing law, on and after January 1, 2018, removes the 7-day waiting period for these benefits. Existing law authorizes an employer to require an employee to take up to 2 weeks of earned but unused vacation before, and as a condition of, the employee's initial receipt of these benefits during any 12-month period in which the employee is eligible for these benefits. Existing law specifies that if an employer so requires an employee to take vacation leave, that portion of the vacation leave that does not exceed one week is to be applied to the waiting period. This bill would delete that application of vacation leave to the waiting period, consistent with the removal of the 7-day waiting period for these benefits on and after January 1, 2018.
