Safe haven protections; newborn safety device.

Safe haven protections; newborn safety device.Provides an affirmative defense in certain criminal prosecutionsand civil proceedings regarding child abuse or neglect to a parentwho safely delivers his child within the first 14 days of the child'slife to a newborn safety device located at a hospital that provides24-hour emergency services or at an attended emergency medical servicesagency that employs emergency medical services personnel. The billalso provides civil and criminal immunity to such hospitals and emergencymedical services agencies for injuries to children received throughsuch newborn safety devices, provided that (i) the injuries are notthe result of gross negligence or willful misconduct and (ii) the hospital or emergency medical services agency meets certain requirements regarding the establishment, functioning, and testing of the device.

Emergency Services and Disaster Law; limitation on duration of executive orders.

Emergency Services and Disaster Law; limitationon duration of executive orders. Limits the duration of any executiveorder issued by the Governor pursuant to his powers under the EmergencyServices and Disaster Law to no more than 45 days from the date ofissuance. The bill provides that if the General Assembly does nottake any action on the rule, regulation, or order within the 45 daysduring which the rule, regulation, or order is effective, the Governorshall thereafter be prohibited from issuing the same or a similarrule, regulation, or order relating to the same emergency. Under current law, once issued, such executive orders are effective untilJune 30 following the next regular session of the General Assembly.

Provides that in any proceeding where mental competenceor mental impairment is at issue, the court shall accept a properlyauthenticated computed tomography (CT) scan, computerized axial tomography(CAT) scan, or magnetic resonance imaging (MRI) scan that demonstratesthat the subject of such scan or image has a normal and uninjuredbrain as proof of competency and lack of impairment.
