Charitable gaming; violations; civil penalty. Provides for a civil penalty of not less than $25,000 and not more than $50,000 for any person or organization, whether permitted or qualified pursuant to applicable charitable gaming laws or not, that (i) conducts charitable gaming without first obtaining a permit to do so, (ii) continues to conduct such games after revocation or suspension of such permit, or (iii) otherwise violates any charitable gaming provisions. The bill provides that any such civil penalties collected shall be payable to the State Treasurer for remittance to the Department of Agriculture and Consumer Services. This bill is identical to HB 767.

Board of Education; COVID-19; test-to-stay guidelines. Requires the Board of Education, in collaboration with theDepartment of Health, to (i) recommend as best practice the shortestduration of quarantine possible, as recommended by the Centers forDisease Control and Prevention, for students and employees at publicschools who contract COVID-19 and (ii) develop test-to-stay guidelinesfor such schools and recommend such guidelines to schools for useas an alternative to quarantine for students and employees who contract COVID-19. The bill also provides that all guidelines established pursuant to the bill shall be immediately distributed to local schoolboards and shall reflect the most updated recommendations from theCenters for Disease Control and Prevention to limit the amount oftime out of the classroom to be as short as possible, including noquarantine, as recommended for asymptomatic individuals who havebeen fully vaccinated either within six months or have a boostedvaccination status. The bill contains an emergency clause.

Charitable gaming; registration of landlords;Texas Hold'em poker operations. Provides that the Departmentof Agriculture and Consumer Services may promulgate regulations thatrequire any landlord that leases to a qualified charitable organizationany premises devoted in whole or in part to the conduct of bingogames or any other charitable gaming to register with the Department.The bill also prohibits (i) an organization qualified to conductTexas Hold'em poker tournaments from conducting any Texas Hold'empoker games where the game has no predetermined end time and theplayers wager actual money or poker chips that have cash value, and(ii) a qualified organization from contracting with an operator to administer Texas Hold'em poker tournaments. The bill contains technical amendments.

Department of Health; triennial audit requirementfor hospices and home care organizations. Directs the Departmentof Health to remove the triennial audit requirement for hospicesand home care organizations.

Health insurance; definition of autism spectrum disorder. Provides that for the purposes of required health insurance coverage for the diagnosis and treatment of autism spectrum disorder, "autism spectrum disorder" means any pervasive developmental disorder or autism spectrum disorder, as defined in the most recent edition or the most recent edition at the time of diagnosis of the Diagnostic and Statistical Manual of Mental Disorders of the American Psychiatric Association and "medically necessary" means in accordance with the generally accepted standards of mental disorder or condition care and clinically appropriate in terms of type, frequency, site, and duration, based upon evidence and reasonably expected to do any of the following: (i) prevent the onset of an illness, condition, injury, or disability; (ii) reduce or ameliorate the physical, mental, or developmental effects of an illness, condition, injury, or disability; or (iii) assist to achieve or maintain maximum functional capacity in performing daily activities, taking into account both the functional capacity of the individual and the functional capacities that are appropriate for individuals of the same age. This bill is identical to HB 225.

Front and rear bumper height limits; emergency. Provides that no passenger car or pickup or panel truck shall be operated on a public highway if the suspension, frame, or chassis has been modified by any means so as to cause the height of the front bumper to be four or more inches greater than the height of the rear bumper. The bill contains an emergency clause.

Study; continuing the Joint Subcommittee on Coastal Flooding; report. Continues the Joint Subcommittee on Coastal Flooding as the Joint Subcommittee on Recurrent Flooding for two additional years, through the 2023 interim. The resolution expands the review of the joint subcommittee to include riverine and stormwater flooding and increases the membership of the joint subcommittee from 11 to 15 members, with three of the additional members to be local elected officials from three separate regions of the state representing Virginia's flood-prone communities and the fourth additional member to be a certified floodplain manager. The joint subcommittee is directed to recommend short-term and long-term strategies for minimizing the impact of flooding.
