Zoning; by-right multifamily development. Requires local zoning ordinances to permit, on any parcel with an existing tree canopy coverage of at less than 60 percent, located within a city or town having a population of more than 20,000 or within a designated metropolitan planning area, multifamily and mixed-use residential development as a by-right use on at least 75 percent of all land contained in commercial or business zoning district classifications, including any land contained in commercial or business zoning district classifications that allow for the by-right development and construction of single-family residential uses. The bill stipulates that any application for a proposed development authorized pursuant to the bill shall be reviewed and acted upon administratively by a locality. The bill prohibits a locality from (i) requiring that a special exception, special use, or conditional use permit be obtained for such development or (ii) imposing more stringent land use requirements, enumerated in the bill, for such development than would otherwise be required. The bill has a delayed effective date of January 1, 2027.
Income tax credit; braille labeling program. Creates a nonrefundable individual and corporate income tax credit, as applicable, for taxable years 2026 through 2030 for up to $50,000 of expenditures incurred in the development and implementation of a braille labeling program on products, items, or packages sold in or shipped within the Commonwealth. The bill specifies that the aggregate amount of such credits allowed for all taxpayers in a taxable year is $500,000 and that any credit not usable for the taxable year in which it is first allowed shall not be carried over for credit in any succeeding taxable year.

Donor human milk banks; health insurance; coverage for donor human milk; penalties. Prohibits any person from establishing or operating a donor human milk bank, as defined in the bill, without first obtaining a license from the State Health Commissioner and makes it a Class 6 felony for any person to establish or operate a donor human milk bank in the Commonwealth without obtaining such license. The bill also establishes requirements, policies, and procedures for the operation and administration of licensed human donor milk banks, including procedures relating to disciplinary actions, application fees, and inspections and interviews related to such donor human milk banks. The bill directs (i) the State Board of Health to establish a regulatory and statutory scheme for the licensure and regulation of donor human milk banks operating or doing business in the Commonwealth and (ii) the Commissioner to implement and enforce numerous regulations relating to the issuance, renewal, denial, suspension, and revocation of such licenses. The bill requires (a) health insurers, corporations providing health care coverage subscription contracts, and health maintenance organizations to provide coverage for expenses and (b) the state plan for medical assistance services to include a provision for payment of medical assistance services incurred in the provision of pasteurized donor human milk for any infant that is younger than the age of six months and who satisfies certain criteria enumerated in the bill. The bill has a delayed effective date of July 1, 2027, or whenever the State Board of Health has promulgated regulations for the licensure of donor human milk banks, whichever is later.
Civil actions; assignment as business litigation action; requirements. Allows counsel for any party or the judge of the circuit court initially assigned to certain civil actions to request to have such action assigned by the Chief Justice of the Supreme Court of Virginia to have such civil action assigned as a business litigation action. The bill provides that an action to be eligible to be considered a business litigation action, the action shall (i) have a minimum amount in controversy of $1,000,000, (ii) present special complexity, including specialized issues or acute litigation management needs, and (iii) fall into one or more of several enumerated categories of civil actions. The bill has a delayed effective date of July 1, 2027.
