Alcoholic beverage control; sale and delivery of mixed beverages and pre-mixed wine.

Alcoholic beverage control; sale and deliveryof mixed beverages and pre-mixed wine for off-premises consumption.Allows distillers that have been appointed as agents of the Board of Directors (the Board) of the Virginia Alcoholic BeverageControl Authority (the Authority), mixed beverage restaurant licensees,and limited mixed beverage restaurant licensees to sell mixed beveragesfor off-premises consumption and deliver such mixed beverages toconsumers subject to requirements set forth in the bill. The billallows the Board to summarily revoke a licensee's privileges to selland deliver mixed beverages for off-premises consumption for noncompliancewith the requirements set forth in the bill or applicable provisionsof current law. The bill also allows farm winery licensees to sellpre-mixed wine for off-premises consumption. The bill directs theAuthority to convene a work group to study the sale and delivery of mixed beverages and pre-mixed wine for off-premises consumption andreport its findings to the Chairmen of the House Committee on GeneralLaws and the Senate Committee on Rehabilitation and Social Servicesby November 1, 2021. The provisions of the bill sunset on July 1,2022.

Voter registration; failure of online voter registration system, deadline extension.

Voter registration; failure of online voter registration system; deadline extension. Provides that in the event that a failure of the Virginia online voter registration system occurs prior to the close of registration records, the Governor has the authority to order the online voter registration system to be available for registration activities after the date for closing the registration records for a period of time equal to the amount of time during which the online voter registration system was unavailable for registration activities, rounded up to the nearest whole day, plus an additional day to allow for voter education efforts. The extension of registration activities shall apply to in-person registration and mail voter registration applications.

Children's Services Act; funds expended special education programs.

Children's Services Act; special education programs. Requires that funds expended for special education services under the Children's Services Act only be expended on educational programs that are licensed by the Department of Education. The bill adds children and youth previously placed in approved private school educational programs for at least six months who will receive transitional services, as that term is defined in the bill, in a public school setting to the target population for eligibility for the state pool of funds, provided, however, that such funds shall be allocated for such transitional services for no longer than 12 months. The bill requires the Secretary of Education, in conjunction with the Office of Children's Services and the Department of Education, to establish a work group (the Work Group) with, at minimum, certain identified stakeholders to develop a detailed plan to direct the transfer of Children's Services Act funds currently reserved for children requiring an educational placement in a private special education day school or residential facility to the Department of Education and to develop a standardized reporting process, template, and reporting requirement for private special education day school tuition rates to ensure that tuition rates can be accurately compared across schools and over time, among other duties. The bill requires that the Work Group submit its plan and recommendations to the Chairmen of the House Committee on Appropriations and Senate Committee on Finance and Appropriations by November 1, 2021.

Alcoholic beverage control; license fee reform;delay; emergency. Delays the effective date of the 2020 alcoholicbeverage control license and fee reform from July 1, 2021, to January1, 2022. During the period of delay and subject to certain requirements,the bill allows on-premises wine or beer licensees to sell wine orbeer for off-premises consumption and allows such licensees, as wellas off-premises wine or beer licensees, to deliver wine or beer thatthe licensee is authorized to sell without a delivery permit. The bill contains a technical amendment and an emergency clause.

Computer science standards, etc., in public schools; DOE to perform comprehensive review, report.

Department of Education; comprehensive reviewof computer science standards, courses, and pathways in public schools;report. Requires the Department of Education to perform a comprehensivereview of the ongoing implementation of mandatory computer sciencestandards in elementary schools and middle schools and the alignmentof middle school and high school computer science courses and coursepathways. The bill requires such review to include recommendationsfor implementation processes at the local level, profiles of implementationprocesses that have been successful for school divisions, a descriptionof opportunities for enhanced collaboration with relevant computer science stakeholders to expand computer science education opportunitiesfor all students in the Commonwealth and for relevant professionaldevelopment for teachers, and examining methods of data collectionannually from local school divisions pertaining to computer scienceimplementation. The bill requires the Department of Education toprepare a report on its comprehensive review and provide such reportto the Chairmen of the House Committee on Education and the SenateCommittee on Education and Health, the Secretary of Education, andthe Superintendent of Public Instruction no later than November 1,2021.

Electric utilities; triennial review, fair rate of return, customer bill credits.

Electric utilities; fair rate of return; customer bill credits. Provides that the State Corporation Commission may, in any triennial review, establish a range above or below the authorized rate of return such that if the combined rate of return on common equity earned by the generation and distribution services is within that range, such combined return is not to be considered either excessive or insufficient, respectively. The bill provides that during a triennial review period, if a utility's earned return on its generation and distribution services falls below that range due to certain costs, the Commission is required to authorize deferred recovery for such costs. Additionally, if during a triennial review period, if a utility's earned return on its generation and distribution services falls below that range due to revenue reductions related to energy efficiency measures or other programs, the Commission is required to order an increase to the utility's rates. The bill requires that the Commission direct 100 percent of the amount that a utility earns over its fair rate of return to customers' bills. Under current law, the Commission is required to direct 70 percent of any earnings that were more than a certain percentage above the utility's fair rate of return to customers' bills. The bill provides that if, during a triennial review period, a utility has earned above its fair combined rate of return, the Commission is required to order reductions to the utility's rates it finds appropriate. Under current law, the Commission is only required to order reductions to the utility's rates if the utility earned more than a certain percentage above its fair combined rate of return. The provisions of the bill apply to all triennial reviews, including the first triennial review of Dominion Energy Virginia conducted after January 1, 2021.
