Property insurance; use of aerial or satellite imagery.

Property insurance; use of aerial or satellite imagery. Prohibits an insurer from refusing to renew a policy written to insure an owner-occupied dwelling based on information obtained through the use of aerial or satellite imagery unless (i) such imagery has been captured not more than 12 months prior to the nonrenewal notice; (ii) the nonrenewal notice includes date-stamped aerial or satellite images of the insured property identifying the specific conditions that form the basis for nonrenewal and specifies any action that the insured may take to remedy such conditions; (iii) the insurer provides the insured a period of not less than 90 days to cure the identified conditions before the nonrenewal takes effect; and (iv) the insurer establishes a point of contact for the insured to submit documentation and a process to review such documentation. The bill requires the insurer to offer to renew coverage if the insured provides documentation, within the 90-day period, demonstrating that the identified conditions have been cured to the insurer's reasonable satisfaction.

Child Care Subsidy Program; income-based eligibility for assistance.

Early childhood care and education; Child Care Subsidy Program; income-based eligibility for assistance; development and implementation of phased reduction model. Requires the Department of Education (the Department) to develop and implement a phased reduction model for the Child Care Subsidy Program (the Program) that provides for an assistance phase-out period during which the assistance for which a given family is eligible is incrementally reduced in proportion to the increase in such family's income for the purpose of ensuring that no family receiving child care assistance under the Program experiences a sudden loss in eligibility for assistance as a result of an increase in family income. The bill requires the phased reduction model developed and implemented by the Department to consist of incremental income tiers, with each increase in income tier corresponding to a proportional reduction in the percentage of assistance for which a given family is eligible under the Program. The bill directs the Board of Education to (i) promulgate regulations for the development and implementation of the phased reduction model in accordance with the provisions of the bill and (ii) submit to the U.S. Department of Health and Human Services any amendments to the current Child Care and Development Fund Plan for Virginia as are necessary to implement the provisions of the bill.

Future of redevelopment and housing authorities; DHCD, et al., to examine, report.

Department of Housing and Community Development; work group to examine the future of redevelopment and housing authorities in the Commonwealth established; report. Directs the Department of Housing and Community Development to establish in collaboration with the Virginia Housing Development Authority a work group to examine the future of redevelopment and housing authorities in the Commonwealth for the purpose of examining the need to repurpose and find a new mission for redevelopment and housing authorities that serve the goals of promoting housing affordability, effectuating redevelopment, and conserving land where deemed appropriate, and to develop a plan to address the diminishing role of the federal government in supporting housing authorities. The bill requires the work group to meet at least six times between July 1, 2026, and September 30, 2027, and to submit a report of its findings and recommendations no later than September 30, 2027.

Virginia Minimum Wage Act; enforcement, penalties.

Virginia Minimum Wage Act; enforcement; penalties. Provides that an employer that violates provisions relating to minimum wage is liable to the employee for the applicable remedies, damages, penalties, and other relief available in a proceeding brought pursuant to the civil action provisions currently available for the nonpayment of wages. Such provisions currently available provide that an employee may bring an action in a court of competent jurisdiction to recover payment of the wages, and the court is required to award the wages owed, an additional equal amount as liquidated damages, plus prejudgment interest thereon, and reasonable attorney fees and costs. Under current law, if the court finds that the employer knowingly failed to pay wages to an employee, the court is required to award the employee an amount equal to triple the amount of wages due and reasonable attorney fees and costs. The bill provides that criminal and civil penalties currently applicable to the nonpayment of wages shall apply to an employer that violates the Virginia Minimum Wage Act.

Teachers; timeline and process for increasing salaries to at least national average.

Average teacher salary in the Commonwealth; national average. Requires the Governor's introduced budget bills for the 2027 and 2028 Regular Sessions of the General Assembly to propose funding for, and state funding to be provided pursuant to the general appropriation act enacted during any regular or special session of the General Assembly during 2027 or 2028 to fund, the Commonwealth's share of compensation supplement incentives for Standards of Quality-funded instructional and support positions sufficient to increase the average teacher salary in the Commonwealth to at least the national average teacher salary by the end of fiscal year 2029 and establishes a detailed timeline and process for satisfying such requirement.

Mental health service providers; use of artificial intelligence system, civil penalty.

Use of artificial intelligence system by mental health service providers; civil penalty. Permits the use of an artificial intelligence system by mental health service providers for administrative support and supplementary support, as those terms are defined in the bill, and prohibits the use of an artificial intelligence system to provide therapy or counseling services without a mental health service provider. The bill specifies that records kept by mental health service providers must comply with health records privacy requirements; creates an exception for religious counseling, peer support, or self-help materials and educational resources; and establishes a civil penalty not to exceed $10,000 for violations of the statute.

Virginia Creative Economy Grant Program established. Establishes the Virginia Creative Economy Grant Program, to be administered by the Virginia Innovation Partnership Corporation, for the purpose of awarding grants to independent content creators and creative economy entrepreneurs, as those terms are defined in the bill, for the purpose of developing and expanding the creative economy, as defined in the bill, in the Commonwealth. The bill provides for the award of grants of no more than $20,000 to any recipient.

Department of Health; Department of Social Services; publicly accessible nursing home information portal; publicly accessible assisted living facility information portal; reporting of incidents involving emergency medical services. Directs the Department of Health to establish a nursing home information portal and the Department of Social Services to establish an assisted living facility information portal to consolidate publicly available information on nursing homes and assisted living facilities, respectively. The bill requires operators of nursing homes and assisted living facilities to submit a quarterly report to the Department of Health or the Department of Social Services, respectively, with information on incidents involving emergency medical services.

Digital Right to Repair Act; access to diagnostics, tools, service documentation, and firmware.

Digital Right to Repair Act; access to diagnostics, tools, service documentation, and firmware; penalties. Requires an original equipment manufacturer (OEM) of digital electronic equipment to make available to owners of such equipment and to independent repair providers, on fair and reasonable terms, documentation, parts, and tools for purposes of diagnosis, maintenance, or repair of such equipment. The bill requires, for digital electronic equipment that contains an electronic security lock or other security-related function, OEMs to make available to the owners of such equipment and to independent repair providers, on fair and reasonable terms, any special documentation, parts, and tools needed to disable such lock or function and to reset it when disabled. A violation of the bill's provisions is a prohibited practice under the Virginia Consumer Protection Act.
