Directs the Department of Medical Assistance Services (the Department) to limit the operation of its estate recovery program to the recovery of only federally required costs. The bill directs the Department to make information on estate recovery available on its website in multiple languages. The bill directs the Department to adopt emergency regulations to implement the provisions of the bill.

Civilian deaths in custody; local and regional adult correctional facilities failure to report.

Civilian deaths in custody; failure to comply with annual report; funding for local and regional adult correctional facilities. Requires the State Board of Local and Regional Jails to notify the Office of the Governor if any local or regional correctional facility fails to send reports with information required by law regarding civilian deaths in custody within 10 days. If such facility fails to comply within 10 days, the bill allows the Governor discretion to direct the Comptroller to withhold all further payment to such facility of all funds, or of any part of them, appropriated and payable by the Commonwealth to such facility, for any and all purposes, until such correctional facility complies.

Indigent defendant; abolition of fees, legal representation, jury trial costs, report.

Abolition of fees; legal representation of indigent defendant; jury trial costs; report. Eliminates the fees for the cost of court-appointed counsel or public defender representation for persons who are determined to be indigent. The bill also eliminates fees for persons who utilize a jury trial. The bill contains a reenactment clause for such elimination of fees.The bill also directs the Indigent Defense Commission, in consultation with the Executive Secretary of the Supreme Court or his designee, to convene a work group with all relevant stakeholders, including the Attorney General or his designee, the Secretary of Health and Human Resources or his designee; representatives from the Compensation Board, the Virginia Crime Commission, the Virginia Joint Legislative Audit and Review Commission, the Virginia Court Clerk's Association, the Virginia Association of Commonwealth's Attorneys, staff from the House Appropriations and the Senate Finance and Appropriations Committees, and the Virginia Probation and Parole Association; and a minimum of two criminal justice reform organizations working on fees and other financial assessments imposed in criminal prosecutions in Virginia; on several topics, including current collection practices, use of funds received as a result of such collections, and the burden of a fee assessment on indigent individuals. The bill requires the work group to submit an executive summary and report of its findings and recommendations to the Governor and the General Assembly by November 1, 2026, and a final report by November 1, 2027.

Interstate Massage Compact; education and examination requirements, Compact Commission membership.

Interstate Massage Compact; education and examination requirements; Compact Commission membership. Modifies the education and examination requirements of the Interstate Massage Compact to clarify acceptable national examinations and expand acceptable education programs to include massage therapists with less than 625 clock hours of education but who have held a license in good standing for at least two years. The bill permits each state to choose its delegate to the Commission as either a member of the state's licensing board or its primary administrative officer of the state's licensing authority and the Compact Commission to elect up to two ex officio, nonvoting members of the Commission. As introduced, the amendments are statutory updates requested of participating states by the Interstate Massage Compact Commission.

Foster care; federal benefits, representative payees.

Foster care; federal benefits; representative payees. Requires local departments of social services to screen any child in foster care for eligibility for certain federal benefits and to apply for such benefits for which the child may be eligible. Under the bill, local departments are required to review existing representative payees to ensure that the representative payee is adequately representing the child's best interests and take appropriate actions necessary to appoint a different representative payee if necessary. The bill specifies that a local department shall only serve as representative payee when no other suitable candidate is available. The bill places limitations on the use of such federal benefits by local departments. Under the bill, if the local department serves as representative payee, it is required to provide an annual accounting detailing the use of such benefits to the child and certain individuals. The bill requires the Department of Social Services to develop and provide training sessions for (i) representative payees serving children in foster care regarding fiduciary obligations associated with serving as a representative payee and (ii) children in foster care who are age 14 and older regarding accessing, managing, and using certain federal benefits.

Dietitian Licensure Compact. Authorizes Virginia to be a signatory to the Dietitian Licensure Compact in order to increase public access to dietetics services and provide opportunities for interstate practice by licensed dietitians who meet uniform requirements. The Compact is presently in effect, as it has reached the enactment threshold of seven member states.

Agricultural Workforce Mental Health and Suicide Prevention Program; established, report.

Agricultural Workforce Mental Health and Suicide Prevention Program established; report. Requires the Department of Agriculture and Consumer Services (the Department) to establish and administer the Agricultural Workforce Mental Health and Suicide Prevention Program (the Program) to support the mental health and well-being of the agricultural workforce, as defined in the bill, in the Commonwealth. The bill requires the Program to (i) increase public awareness of mental health and suicide prevention, (ii) provide access to culturally and contextually appropriate mental health services, and (iii) address mental health challenges arising from certain stressors affecting agricultural communities in the Commonwealth. The bill directs the Department to submit a report on the Program's progress, including data collected and any recommendations, to the Chairmen of the House Committee on Agriculture, Chesapeake and Natural Resources and Senate Committee on Agriculture, Conservation and Natural Resources by September 1, 2027, and biennially thereafter.

Hampton Roads Interstate Highway Corridor Improvement Program and Fund; Hampton Roads Highway Coastal Resilience Program and Fund; Planning District 23. Creates (i) the Hampton Roads Interstate Highway Corridor Improvement Program and Fund for the purpose of planning, developing, financing, building, constructing, and otherwise making infrastructure and safety improvements to and maintaining the infrastructure of certain new or existing highway corridors, highways, bridges, and tunnels in Planning District 23 (Hampton Roads) and (ii) the Hampton Roads Highway Coastal Resilience Program and Fund for the purpose of planning, developing, financing, building, constructing, and maintaining infrastructure to address transportation infrastructure that is at risk due to recurrent and coastal flooding in Planning District 23.

Impersonation of certain licensed professionals by chatbot; definitions, notice, civil liability.

Professions and occupations; impersonation of certain licensed professionals by chatbot; notice; civil liability. Provides that a proprietor that owns, operates, or deploys a chatbot, defined in the bill, shall not permit such chatbot to provide any substantive response, information, or advice, or take any action that, if taken by a natural person, would (i) constitute the unlawful practice of architecture, engineering, surveying, landscape architecture, geology, dentistry, medicine, nursing, optometry, pharmacy, physical therapy, certain mental health professions, psychology, social work, or veterinary medicine; (ii) violate the provisions of law making it unlawful for any person to practice medicine, osteopathic medicine, chiropractic, or podiatry or as a physician assistant in the Commonwealth without a valid unrevoked license or to practice law without being authorized or licensed; or (iii) violate the provisions of law making it unlawful for a teacher to be employed without a license or provisional license or relating to division superintendents, members of a school board or other school officers, or principals or teachers in a public school. The bill allows a person injured by a proprietor who engages in any such conduct to sue therefor no more than two years after the cause of action accrues and recover compensatory damages and reasonable attorney fees and costs. The bill also requires a proprietor operating or deploying a chatbot to provide a clear, conspicuous, and explicit notice to users that they are interacting with a chatbot but specifies that the provisions of such notice shall not be a defense to liability.
