Public elementary and secondary schools; curriculaand instruction including inherently divisive concepts prohibited.Requires each public elementary or secondary school principalto ensure that no curriculum utilized or instruction delivered inthe school includes inherently divisive concepts, as that term isdefined in the bill, regardless of whether such curriculum or instructionis provided by a school board employee or any other individual orentity.

Local school boards; requirement for studentsto wear masks or other face coverings; evidentiary substantiation.Prohibits any local school board from requiring any student enrolledat a public elementary or secondary school in the local school divisionto wear a mask, face covering, or other covering of the student'snose and mouth at school, on a school bus, or at a school-sponsoredactivity unless the local school board substantiates such requirementwith evidence that (i) such requirement is necessary to suppress a nuisance dangerous to the public health or a communicable, contagious,or infectious disease or other danger to the public life and health;(ii) no reasonable alternatives to such requirement exist in lightof the impact on quality of life and economic well-being; and (iii)such requirement is narrowly tailored to address the nuisance dangerousto the public health or the communicable, contagious, or infectiousdisease or other danger to the public life and health.

Family life education instruction; school yeartime limit. Requires each school board that offers a family lifeeducation curriculum to limit instruction delivered to students pursuantto such curriculum to one hour per school year in each grade level.

Fund to Assist Localities with Translation ofEssential Information; established. Establishes the Fund toAssist Localities with Translation of Essential Information to beadministered by the Department of Housing and Community Developmentfor the purpose of making grants to local governments to addressthe lack of translated documents for those citizens and taxpayersof the Commonwealth and its localities for whom English is a secondlanguage. The bill provides that the Fund shall make grants to local governments for the purpose of translating essential documents intoforeign languages.

Abortion; born alive human infant; treatment and care; penalty. Requires every physician licensed by the Board of Medicine who attempts to terminate a pregnancy to (i) exercise the same degree of professional skill, care, and diligence to preserve the life and health of a human infant who has been born alive following such attempt as a reasonably diligent and conscientious health care practitioner would render to any other child born alive at the same gestational age and (ii) take all reasonable steps to ensure the immediate transfer of the human infant who has been born alive to a hospital for further medical care. A physician who fails to comply with the requirements of this act is guilty of a Class 4 felony and may be subject to disciplinary action by the Board of Medicine. The bill also requires every hospital licensed by the Department of Health to establish a protocol for the treatment and care of a human infant who has been born alive following performance of an abortion and for the immediate reporting to law enforcement of any failure to provide such required treatment and care.

Carrying a firearm or explosive material withinCapitol Square and the surrounding area, into building owned or leasedby the Commonwealth, etc.; penalty. Repeals the prohibition oncarrying a firearm or explosive material within (i) the Capitol ofVirginia; (ii) Capitol Square and the surrounding area; (iii) anybuilding owned or leased by the Commonwealth or any agency thereof;or (iv) any office where employees of the Commonwealth or any agencythereof are regularly present for the purpose of performing theirofficial duties. Current law makes it a Class 1 misdemeanor for anyperson to carry a firearm or explosive material within these areas, subject to certain exceptions, including the following individualswhile acting in the conduct of such person's official duties: anylaw-enforcement officer, any authorized security personnel, any activemilitary personnel, any fire marshal when such fire marshal has beengranted police powers, or any member of a cadet corps while suchmember is participating in an official ceremonial event for the Commonwealth.

Limitations on use or transfer of firearms.Provides that certain provisions related to the sale or transferof firearms do not prohibit the lawful transfer of firearms betweencertain family members. The bill also removes the brandishing ofa firearm in such manner as to reasonably induce fear in the mindof another while assembled with one or more persons for the purposeof and with the intent to intimidate any person or group of personsfrom actions constituting the offense of unlawful paramilitary activity.

Paternity; genetic tests to determine parentage;relief from paternity; certain actions; penalty. Provides thatany person who knowingly gives any false information or makes anyfalse statements for the purpose of determining paternity is guiltyof a Class 6 felony. The bill further requires an alleged fatherof a child be informed of his option to request the administeringof a genetic test prior to being entered as the father on a birthcertificate. The bill further states that, in addition to any otheravailable legal relief, an individual relieved of paternity who previouslypaid support pursuant to a child support order entered in conjunctionwith the set-aside paternity determination may file an action againstthe other party for repayment of any such support.

Income tax; military benefits subtraction; emergency. Establishes an income tax subtraction for up to $20,000 of militarybenefits in taxable year 2021, up to $30,000 in taxable year 2022,and up to $40,000 in taxable year 2023 and each year thereafter.The bill defines military benefits to include military retirementincome and benefits paid to the surviving spouse of a veteran. The bill contains an emergency clause.
