Attorney General; Pharmacy Benefits Managerand Third-Party Administrator Oversight Work Group; report. Directsthe Attorney General to convene the Pharmacy Benefits Manager andThird-Party Administrator Oversight Work Group to examine the impactof Rutledge v. Pharmaceutical Care Management Association,141 S. Ct. 474 (2020), and to formulate legislative recommendationsfor reducing prescription drug costs, minimizing health care expenses,reducing bureaucratic impediments to affordable health care, enhancingtransparency, and improving overall health outcomes for residentsof the Commonwealth. The bill requires such work group to submit areport of its findings and recommendations to the General Assemblyby November 1, 2025.

Department of Behavioral Health and DevelopmentalServices; community services boards; quarterly stakeholder meetings.Provides that every community services board shall conduct stakeholdermeetings at least four time per year to discuss challenges, identifyopportunities for improvement, and collaboratively work towards effectivesolutions. The bill requires each community services board to submitan annual report of such meetings to the Department of BehavioralHealth and Developmental Services and authorizes the Director ofthe Department to provide guidance and recommendations to such boardsand to revise funding in response to such reports.

Therapeutically equivalent drug products; provisionsfor return of outdated drugs. Requires drug manufacturers toimplement provisions for the return of drugs past their expiration date by pharmacies in order for their products to be eligible for dispensing as a therapeutically equivalent drug.

Secretary of Natural and Historic Resources;coastal resilience policy; research university collaborative.Requires the Secretary of Natural and Historic Resources and all relevantagencies, when setting coastal resilience policies, issuing permits,and evaluating grant proposals to seek input and consultation fromthe Commonwealth's research university collaborative. Current lawpermits the Secretary to seek input and consultation from such collaborativewhen setting coastal resilience policies. The bill removes the VirginiaCoastal Policy Center from such collaborative and provides that suchcollaborative may include any other institution in the Commonwealth conducting coastal resilience research. The bill also requires theSecretary to utilize such collaborative's expertise, research, and data analysis for the implementation of water management techniquesand coastal resilience strategies. Under current law, such requirementsby the Secretary are permissive.

Golf carts and utility vehicles; certain ruralcommunities. Authorizes localities located within the Rural CoastalVirginia Community Enhancement Authority to authorize by ordinancethe operation of golf carts or utility vehicles on designated publichighways where the posted speed limit is 35 miles per hour or less.Existing law authorizes such operation on designated public highwayswhere the posted speed limit is 25 miles per hour or less.

Virginia Port Authority; Virginia WaterwayMaintenance Grant Program; grant funding; projects. Clarifiesthe circumstances under which the Virginia Port Authority may awardgrant funding from the Virginia Waterway Maintenance Grant Program for the construction and management of dredged material. The billprovides that such funding may be used for the lease, purchase, ordevelopment of upland containment areas where dredged material canbe selectively excavated and used beneficially for environmentalrestoration or for mitigation of coastal erosion. The bill also amendsan existing provision allowing funding for the mitigation of coastalerosion or flooding of dredged materials to require such dredgedmaterials be from an approved waterway dredging project conductedby the Commonwealth.

Health insurance; employee welfare benefit plans;pharmacy audit protections. Requires contracts and provider contractsbetween an entity providing or administering self-insured or self-fundedemployee welfare benefit plans and an intermediary or a participatingpharmacy provider or its contracting agent, pursuant to which suchentity or intermediary has the right or obligation to conduct auditsof participating pharmacy providers, to contain certain terms andprovisions relating to such audits.
