Zoning; traffic impact statements. Prohibitsa locality from requiring a local traffic impact statement as a conditionfor approval of a rezoning application that involves a multifamilyresidential use of fewer than 50 residential units.
Computer trespass; elementary and secondaryschools; school board; penalty. Makes it a Class 6 felony forthe offense of computer trespass when such offense is committed againstany elementary or secondary school or school board.
Consumer Data Protection Act; social media;parental consent. Requires social media platforms, defined inthe bill, that are subject to the provisions of the Children's OnlinePrivacy Protection Act to obtain verifiable parental consent priorto permitting any minor to create an account with such social mediaplatform and, with such account, use the social media platform. Thebill requires such social media platforms to give the parent or guardianthe option to consent to the collection and use of the minor's personaldata without consenting to the disclosure of such minor's personaldata to third parties.
Release of developer performance guarantees.Provides that no governing body or administrative agency shall refuseto make a periodic partial or final release of a bond, escrow, letterof credit, or other performance guarantee for the actions of anyonenot under contractual agreement with a subdivider or developer orunder the direct supervision and control of the subdivider or developer.
Window tint; emergency vehicles. Authorizeswindow tinting on all emergency medical services vehicles and vehiclesused to fight fire, including publicly owned state forest wardenvehicles. Current law authorizes tinting on the rear and rear sidewindows of emergency medical services vehicles used to transportpatients.
Department of Human Resource Management; recruitmentpolicy; direct work experience. Requires the Department of HumanResource Management to develop a statewide recruitment policy designedto provide guidance to state agencies on how to remove postsecondarydegree requirements from hiring considerations and recruit qualifiedemployees utilizing appropriate baseline requirements, the specificsof which are outlined in the bill.
Release of developer performance guarantees.Clarifies that existing provisions related to the periodic partialand final release of developer performance guarantees also appliesto performance guarantees for erosion and sediment control measures,stormwater management facilities, and fill and borrow areas.
Local planning commission; action on proposedplats, site plans, and development plans; residential use. Requireslocal planning commissions to use the same approval process for residentialdevelopment projects as is currently required for commercial developmentprojects.
Virginia Law Officers' Retirement System; conservation officers. Extends membership in the Virginia Law Officers' Retirement System (VaLORS) to conservation officers of the Department of Conservationand Recreation. The bill has a delayed effective date of July 1,2025, and provides that such membership would apply only to serviceearned on or after July 1, 2025.
Eligible educator income tax deduction; homeschool instruction income tax credit. Increases from $500 to$1,500 for tax years 2024 through 2026 the amount of income tax deductioncertain eligible educators may deduct for qualifying expenses. The bill also creates a nonrefundable taxcredit for taxable years 2024 through 2028 for amounts paid by anindividual or married couple filing jointly for their child receivinghome instruction for (i) instruction-related materials, includingtextbooks, workbooks, and supplies, or (ii) courses or programs used in home instruction. The bill provides that the credit equalsthe lesser of the amount actually paid during the year for such costsor $3,000.
