Marijuana presumption; driving or operatinga motor vehicle, etc., while intoxicated; penalty. Establishesa presumption of intoxication if a person has a blood concentrationequal to or greater than 0.004 milligrams of delta-9-tetrahydrocannabinolper liter of blood.
Firearms-related offenses; mandatory minimumsentences; penalty. Increases from five to 10 years for a secondor subsequent offense the mandatory minimum sentences for use ordisplay of a firearm during the commission of certain felonies.
Investigation prior to release; input from theattorney for the Commonwealth. Provides that when the ParoleBoard is conducting the required investigation to determine if aprisoner will be released on parole, the Board must notify the attorneyfor the Commonwealth in each jurisdiction in which an offense occurredfor which the prisoner is incarcerated, and the attorney for theCommonwealth may submit his input to the Board regarding the impactthat the release of the prisoner will have on public safety.
Enhanced earned sentence credits; exemptions;felony drug offenses. Removes any person convicted of a secondor subsequent felony drug offense from being eligible to earn enhancedearned sentence credits.
Line of Duty Act; campus police officers; privatepolice officers. Provides employees of contributing nonprofitprivate institutions of higher education, defined in the bill, andcontributing private police departments, defined in the bill, withthe benefits granted to employees of participating employers underthe Line of Duty Act. The bill clarifies that the Line of Duty Actshall not apply to any private institution of higher education orprivate police department that is not a contributing nonprofit private institution of higher education or contributing private police department, respectively.
State Air Pollution Control Board; motor vehicleemissions standards. Repeals the requirement that the State AirPollution Control Board implement a low-emissions and zero-emissionsvehicle program for motor vehicles with a model year of 2025 andlater. The bill prohibits the Board from adopting or enforcing anymodel year standards related to control of emissions from new motorvehicles or new motor vehicle engines, including low-emission vehicleand zero-emission vehicle standards pursuant to the federal CleanAir Act and prohibits the Commonwealth from requiring any new motorvehicle or new motor vehicle engine to be certified as compliantwith model year standards related to the control of emissions adoptedby California for which a waiver has been granted pursuant to thefederal Clean Air Act.
Selling, giving, or distributing a substancecontaining fentanyl; penalties. Provides that any person whosells, gives, or distributes a substance he knows contains two milligrams or more of any mixture or substance containing a detectable amountof fentanyl, including its isomers, esters, ethers, salts, and saltsof isomers, to another person without such person's knowledge thatthe substance sold, given, or distributed contains fentanyl is guiltyof attempted murder of the first degree by poison. The bill alsoprovides that if such sale, gift, or distribution results in the death of the other person from his use of the substance containingfentanyl, then the person who sold, gave, or distributed the substanceis guilty of murder of the first degree by poison.
