Electric utilities; installation of small portable solar generation devices, local regulation.

Electric utilities; small portable solar generation devices; local regulation; Residential Landlord and Tenant Act. Permits any electric utility customer to own and operate a small portable solar generation device, defined in the bill as a nationally certified, plug-in solar photovoltaic device with a maximum power output of no more than 1,200 watts that is not designed to be interconnected with the electric grid and is intended primarily to offset part of the customer's electricity consumption, provided that such customer has submitted notice to its incumbent investor-owned utility, municipal utility, or electric cooperative. The bill prohibits an investor-owned utility, municipal utility, or electric cooperative from imposing interconnection requirements, charging any fee related to the device, or requiring that the customer obtain the utility's approval before installing or using the device. Under the bill, no electric utility or electric cooperative shall be liable for damage or injury caused by a small portable solar generation device. The bill also restricts (i) localities from prohibiting the use of a small portable solar generation device on a residential structure, provided that certain requirements are met, and (ii) landlords owning more than four rental dwelling units from prohibiting a tenant from installing a small portable solar generation device on the exterior of the tenant's premises, provided that reasonable restrictions may be established concerning size, manner, and placement.

Creates an exception from the requirement to obtain a certificate of public need for facilities for outpatient or ambulatory surgery with up to three operating rooms that are not affiliated with a hospital. The bill requires hospitals to obtain a certificate of public need before acquiring an excepted facility.

Electric utilities; retirement of certain electric generating units.

Electric utilities; retirement of certain electric generating units. Provides that, for the required retirement by December 31, 2045, of electric generating units that emit carbon as a by-product of combusting fuel to generate electricity, exceptions to such requirement include natural gas electric generating units with carbon capture capability and emissions-positive electric generating units. Under the bill, "emissions-positive generating unit" means an electric generating unit that produces a net reduction in greenhouse gas emissions by either preventing, capturing, or collecting such emissions from fuel combustion.

Virginia Consumer Protection Act; prohibited practices; kratom products. Prohibits the selling or offering for sale of (i) any kratom product containing any synthesized material, semi-synthetic alkaloid, or synthetic kratom-like compound; (ii) any kratom product containing 7-hydroxymitragynine in an alkaloid fraction exceeding two percent of total alkaloids in the container or providing more than one milligram of 7-hydroxymitragynine per serving; (iii) any kratom product adulterated with any dangerous, poisonous, or otherwise deleterious non-kratom ingredient, including any substance listed as a controlled substance under state or federal law; (iv) any kratom product that is combustible or intended for vaporization or injection; (v) any kratom product that is manufactured, packaged, or marketed in a manner attractive to children; or (vi) any kratom extract product containing residual solvent levels exceeding applicable statutory or pharmacopeial limits.

Income tax, state; real property tax relief credit.

Income tax; real property tax relief credit. Provides a refundable income tax credit in taxable years 2026 through 2030 to eligible taxpayers, defined in the bill, who incur real property taxes in an amount equal to or greater than four percent of their federal adjusted gross income for up to $500 for single individuals and $1000 for married persons filing jointly.

Va. Retirement System; enhanced retirement benefits for 911 dispatchers, delayed effective date.

Virginia Retirement System; enhanced retirement benefits for 911 dispatchers. Allows local governments to provide enhanced retirement benefits for hazardous duty service to full-time salaried 911 dispatchers. The bill provides that such enhanced retirement benefits apply only to service earned as a full-time salaried 911 dispatcher on or after July 1, 2027, but allows an employer, as that term is defined in relevant law, to provide such enhanced retirement benefits for service earned as a full-time salaried 911 dispatcher before July 1, 2027, in addition to service earned on or after that date. The bill has a delayed effective date of July 1, 2027.

Tangible personal property tax relief; rate of taxation.

Tangible personal property tax relief; rate of taxation. Requires, for tax year 2027 and all tax years thereafter, each county, city, or town to reduce its local tax rate on qualifying vehicles to no greater than $0.000001 per $100 of the eligible assessed value of the qualifying vehicle. The bill defines "eligible assessed value" as $5,000 of the assessed value of a qualifying vehicle. For tax year 2028 and all tax years thereafter, for any year in which the revenues of a county, city, or town grow by five percent or more, the bill provides that the eligible assessed value applied in such county, city, or town shall increase by an additional $5,000 until such time that the eligible assessed value equals $20,000.

Artificial Intelligence Chatbots and Minors Act; established, prohibited practices, penalties.

Artificial Intelligence Chatbots and Minors Act established; prohibited practices; penalties. Creates the Artificial Intelligence Chatbots and Minors Act to require that deployers that operate or distribute a chatbot in the Commonwealth (i) ensure that any chatbot operated or distributed by the deployer does not make human-like features, defined in the bill, available to minors to use, interact with, purchase, or converse with and (ii) implement reasonable age verification systems to ensure that chatbots with human-like features are not made available to minors. The bill also requires deployers operating or distributing a chatbot that is a social artificial intelligence companion, defined in the bill, to ensure such chatbot is not available to minors. The bill provides that a violation of its provisions constitutes a prohibited practice under the Virginia Consumer Protection Act.
