Virginia Economic Development Partnership Authority; Division of Incentives; due diligence for major projects. Requires the due diligence review performed by the Division of Incentives at the Virginia Economic Development Partnership Authority for proposed economic development projects to include whether and to what extent the business involved has executed a labor peace agreement, as defined in the bill, with its employees if the project is a major one for which (i) incentives require a change to the law, (ii) incentives involve cash payments in excess of $3.5 million prior to any performance, or (iii) the aggregate amount of state incentives exceeds $10 million in value.

Income tax, state; creates child tax credit.

Child tax credit; Virginia adjusted gross income. Creates a one-time tax credit in taxable years 2026 through 2030 for taxpayers whose households include dependents younger than 13 years of age and whose family Virginia adjusted gross income, defined in the bill, does not exceed $100,000. Such credit shall be in an amount equal to $300 for each such dependent and only one credit may be claimed for each such dependent. The bill provides that if the taxpayer is a resident of the Commonwealth for the full taxable year, the credit is refundable. Otherwise, the credit is nonrefundable.

Electric utilities; request for proposals required for certain facilities. Requires Appalachian Power and Dominion Energy Virginia, at least 15 months prior to seeking approval to construct or purchase a generating facility that emits carbon dioxide, to conduct a thorough evaluation of non-carbon-emitting electric generation options through an independent administrator selected by the State Corporation Commission and retained by such utility. The bill directs the Commission to review the framework and schedule of the request for proposals designed by the independent administrator and accept feedback from relevant stakeholders. The bill provides that if the results of the request for proposals indicate that a cost-effective set of proposed resources can meet the identified energy and capacity needs, such utility shall petition the Commission for approval of such resources.

School crossing zones; large children's sports complexes; Planning District 8. Expands the definition of "school crossing zone" to include areas surrounding schools where the presence of students, in addition to children, reasonably requires a special warning to motorists. The bill also defines "school" and provides that, in Planning District 8, the term "school" includes large children's sports complexes, defined in the bill. Existing provisions of law allowing photo speed monitoring devices to be installed in school crossing zones will apply to any location that meets the expanded definition.

Employment decisions; automated decision systems; civil penalty. Provides that the Director of the Department of Human Resource Management shall require any state agency that uses an automated decision system as a substantial factor in any employment decision, as those terms are defined in the bill, to (i) ensure that such system and the use of such system complies with federal and state law, (ii) make certain disclosures, (iii) provide an opt-out mechanism, (iv) annually test such system, (v) ensure data security, and (vi) train agency staff on such system. The bill requires the Department and local government employers to establish and publicize a process for applicants for employment and employees to file concerns and complaints regarding the use of automated decision systems in such employment decisions and a process for the investigation and resolution of any such concerns and complaints. The bill also provides that no final employment decision shall be made by an employer without the involvement of a human decision maker, and no employer shall solely use any recommendation or prediction from an automated decision system to make a final employment decision. The bill subjects violating employers to civil penalties.

A BILL to amend and reenact §§ 33.2-359, 33.2-371, 33.2-1526, 33.2-1526.1, 33.2-3102, 33.2-3401, 33.2-3402, 33.2-3403, 33.2-3502, 46.2-774, and 46.2-2099.48 of the Code of Virginia; to amend the Code of Virginia by adding in Article 2 of Chapter 19 of Title 33.2 a section numbered 33.2-1904.1, by adding in Article 11 of Chapter 19 of Title 33.2 a section numbered 33.2-1937, by adding in Chapter 24 of Title 33.2 a section numbered 33.2-2402, by adding in Chapter 7 of Title 46.2 a section numbered 46.2-775, by adding a section numbered 58.1-603.3, and by adding in Chapter 17 of Title 58.1 articles numbered 13, 14, and 15, consisting of sections numbered 58.1-1749, 58.1-1750, and 58.1-1751; and to repeal § 33.2-3100.1 of the Code of Virginia, relating to transportation funding.

Administration of government; language access equity; report. Requires each public-facing state agency, defined in the bill, to designate a language access coordinator who will be responsible for the agency's annual language access report, the requirements of which are set out in the bill. The Secretary of Health and Human Resources is directed to establish criteria for state agencies to procure language interpretation and translation services and to establish a policy for compensating multilingual state employees who are required as part of their job to provide interpretation, translation, or other bilingual skills at least once a month.

Virginia College Access and Affordability Scholarship Fund; established, report.

Commonwealth Savers Plan; State Council of Higher Education for Virginia; Virginia College Access and Affordability Scholarship Fund established; work group; report. Directs the transfer of actuarial surplus defined benefit prepaid tuition contract funds from the Commonwealth Savers Plan (the Plan) Fund into a DB529 Fund established by the bill to be deposited into the Virginia College Access and Affordability Scholarship Fund (the Access Fund) established by the bill. Under the bill, the DB529 Fund and the Access Fund operate as subfunds of the Commonwealth Savers Plan Fund. The bill further provides that the Plan shall initially deposit $500 million from the DB529 Fund into the Access Fund to be invested and managed by the Plan. The Joint Legislative Audit and Review Commission shall no less than biennially complete an independent evaluation and risk assessment of the Plan's risk assessment model, assumptions, and other measures employed by the Plan related to the DB529 Fund and the Access Fund. Funds in the Access Fund shall be used to establish a scholarship program that is managed and administered by the State Council of Higher Education for Virginia (the Council). The scholarship program provides scholarship awards to students enrolled in an eligible education program, defined in the bill, and a portion of the funds are to be devoted to college access resources or programs to assist low-income students, first generation college students, students from underrepresented communities, or other at-risk students with their introduction to the higher education system in Virginia, college applications, financial aid applications, and resources assisting with a successful transition from high school to college. The Council is required to report on the Access Fund and scholarship program no later than December 31 of each year. Finally, the bill (i) directs the Council to establish a work group of higher education stakeholders to make recommendations on allocations of funds available through the Access Fund and scholarship program and directs the work group to report to the House Committees on Education and Appropriations and Senate Committees on Education and Health and Finance and Appropriations no later than November 1, 2026, and (ii) prohibits the Plan from implementing or taking part in any initiatives relating to the aforementioned college access programs on or after July 1, 2026, except for existing access programs related to a prepaid tuition contract entered into on or before June 30, 2026, and existing program offerings made available for SOAR Virginia and GEAR UP Virginia.
