Claims; David Wayne Kingrea; compensation forwrongful inclusion on sex offender registry. Provides that anyindividual wrongfully incarcerated or wrongfully required to registeron the sex offender registry may be awarded compensation for everysuch year of wrongful incarceration or wrongful registration. Thebill grants relief in an amount to be appropriated to David WayneKingrea, who was wrongly convicted of indecent liberties with a minor,and as a result of such wrongful conviction, required to registeron the sex offender registry.
Special license plates; 250th anniversary of the American Revolution. Authorizes the issuance of revenue-sharing special license plates marking the 250th anniversary of the American Revolution. The bill provides that the prepaid application requirements for special license plates shall not apply to such plates, that the provisions of the bill expire on July 1, 2032, that such plates shall not be newly issued on or after such date, and that such plates may continue in use for a period of time determined by the Commissioner of the Department of Motor Vehicles. This bill is identical to HB 840.
Adult day care centers; name change. Renames "adult day care centers" as "adult day centers" throughout the Code of Virginia. This bill is identical to SB 173.
Moving violations; highway work zones. Createsa traffic infraction for any moving violation in a highway work zonepunishable by a fine of not less than $300 for the first offenseand not less than $500 for any subsequent offense. The bill provides that for any subsequent offense that occurs within the same 12-monthperiod as another such offense such fine shall be not less than $750.
Center for Rural Virginia; name change. Renames the Center for Rural Virginia as the Senator Frank M. Ruff, Jr. Center for Rural Virginia. This bill is identical to HB 1381.
Board of Education; through-year growth assessment system; alternatives during 2024-2026 school years. Requires the Board of Education to permit school boards to administer, during the 2024-2026 school years, assessments as alternatives to the through-year growth assessment system established by the Board, provided that any such alternative assessment is aligned to the Standards of Learning. This bill is identical to SB 435.
State hospitals; discharge planning; report. Provides that (i) when an individual is to be discharged from Central State Hospital, Southwestern Virginia Mental Health Institute, or Southern Virginia Mental Health Institute in 30 days or less after admission, the appropriate community services board shall implement the discharge plan developed by the state facility and (ii) when an individual is to be discharged from any other state facility in 30 days or less after admission, or from a state hospital more than 30 days after admission, the appropriate community services board or behavioral health authority shall be responsible for the individual's discharge planning. Under current law, community services boards and behavioral health authorities provide discharge planning for all individuals discharged from state hospitals, regardless of the duration of their stay. The bill requires the Department of Behavioral Health and Developmental Services to make certain annual reports by August 1 to the Governor and the General Assembly and to provide the General Assembly with a one-time evaluation of the impacts of the changes to discharge planning implemented by the bill by November 1, 2025. The bill has a delayed effective date of January 1, 2025. This bill is identical to HB 314.
Mineral mining and processing; use of cyanideor a cyanide compound prohibited. Prohibits any miner or otherperson from using cyanide or a cyanide compound in any mineral miningor processing operation.
Real property tax; notice of assessment changes. Provides that in certain localities, in the event that the total assessed value of real property would result in an increase of one percent or more in the total real property tax levied, the notice of assessment changes shall state the tax rate that would levy the same amount of real estate tax as the previous year when multiplied by the new total assessed value of real estate. This bill is identical to SB 677.
Manufacture, importation, sale, etc., of auto sears; prohibition; penalty. Prohibits the manufacture, importation, sale or offer to sell, possession, transfer, or transportation of an auto sear, defined in the bill as a device, other than a trigger activator, for use in converting a semi-automatic firearm to shoot automatically more than one shot, without manual reloading, by a single function of the trigger. A violation is punishable as a Class 6 felony. The bill also provides for the forfeiture of any auto sear concealed, possessed, transported, or carried in violation of the prohibition. This bill is identical to SB 210.
Board of Education; Imagination Library of Virginia Program and Fund established. Establishes the Imagination Library of Virginia Program and the Imagination Library of Virginia Fund for the purpose of encouraging preschool-age children to learn to read by providing one reading selection, defined by the bill as any high-quality, age-appropriate book, monthly to the home of each registered child from birth to age five at no cost to the child's family. The bill provides that each school board in the Commonwealth shall serve as the local partner for the administration of the Program in its respective school division and requires the Board of Education to establish the Dolly Parton's Imagination Library Affiliate to collaborate with each school board in (i) mailing monthly reading selections directly to the residence of each child, beginning as early as such child's birth month through the month in which such child reaches five years of age, (ii) identifying and locating families with an eligible child within such school division and encouraging them to register such child for the Program, and (iii) handling any undelivered monthly reading selections. The bill provides that the costs incurred by each school board shall, subject to appropriation, be reimbursed to each such school board. The bill establishes that the Board is responsible for the administration of the Program, including (a) managing the Program's daily operations or delegating such management to the Department of Education, the Dolly Parton's Imagination Library Affiliate, or such other entity as the Board may deem appropriate; (b) coordinating with local organizations and each school board to advance and strengthen the Program; (c) developing, promoting, and coordinating a public awareness program to increase awareness of the Program; (d) ensuring the appropriation of sufficient funds by including in any budget request each year a plan to ensure the distribution of sufficient funds to each school division; and (e) providing an annual report to the Senate Committee on Education and Health and the House Committee on Education detailing the activities of the Program and Fund for the immediately preceding year. The provisions of the bill expire on January 1, 2029.
