LGBTQ Essential Data Act This bill directs the Centers for Disease Control and Prevention to more frequently collect information on the sexual orientation and gender identity of deceased individuals through the National Violent Death Reporting System.
This bill places restrictions on recurring political contributions or donations. Specifically, the bill prohibits any person from soliciting a recurring contribution or donation for a political committee, an independent expenditure, or an electioneering communication by any method that does not require the affirmative consent of the contributor or donor. In addition, the bill prohibits a political committee, a person funding an independent expenditure, or a person funding an electioneering communication from accepting a recurring contribution or donation unless the contributor or donor gave affirmative consent. This affirmative consent cannot be a passive action by the contributor or donor, such as failing to uncheck a prechecked box. Further, any person who accepts a recurring contribution or donation must (1) provide a receipt for the initial contribution or donation and for each recurrence that clearly and conspicuously discloses all material terms, (2) provide all information needed to cancel the recurring contribution or donation in each communication with the contributor or donor, and (3) immediately cancel recurring contributions or donations upon request of the contributor or donor.
Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex, which is defined to include pregnancy, sexual orientation, gender identity, and sex characteristics. Specifically, it limits an employer's defense that a pay differential is based on a factor other than sex to only bona fide job-related factors in wage discrimination claims, enhances nonretaliation prohibitions, and makes it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages. The bill also increases civil penalties for violations of equal pay provisions. Additionally, the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs must train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to (1) establish and carry out a grant program to provide training in negotiation skills related to compensation and equitable working conditions, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The bill establishes the National Award for Pay Equity in the Workplace for an employer who has made a substantial effort to eliminate pay disparities between men and women. It also establishes the National Equal Pay Enforcement Task Force to address compliance, public education, and enforcement of equal pay laws. Finally, the bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.
This resolution commends domestic and international efforts to combat human immunodeficiency virus/acquired immunodeficiency syndrome (HIV/AIDS) and calls for additional actions to address the disease.
State and Local General Sales Tax Protection Act This bill restricts the source of revenue for airport spending to local fuel excise taxes. Under current Federal Aviation Administration policy, state and local governments must also use general sales taxes collected on aviation fuel for airport spending.
Organ Donation Clarification Act of 2021 This bill specifies that certain payments and pilot programs relating to organ donation do not violate the National Organ Transplant Act, which prohibits the exchange of valuable consideration for human organs. Specifically, it excludes additional types of reimbursements and payments related to organ donation from the definition of valuable consideration , such as costs for (1) dependent care; (2) certain medical expenses for up to 10 years after a donation; (3) paperwork or legal services; and (4) term life insurance policies, subject to some limitations. In addition, the federal government, states, or local governments may carry out pilot programs to evaluate the effects of removing disincentives or providing noncash benefits on the availability of organs for transplant, provided these programs meet ethical and other conditions.
Social Media Disclosure And Transparency of Advertisements Act of 2021 or the Social Media DATA Act This bill requires consumer-facing websites and mobile applications with a large number of users to maintain advertisement libraries and make them available to academic researchers and the Federal Trade Commission (FTC). Each library must include, among other things, a digital copy of the advertisement content, a description of the target audience, and the number of views generated from the advertisement. The FTC and state attorneys general are authorized to enforce these requirements, and the FTC must use information from the advertisement libraries to enforce other laws within its jurisdiction. Additionally, the bill establishes a working group to address social media research access and make policy recommendations with respect to the information an interactive computer service (e.g., a social media company) should make available to academic researchers.
Veteran Education Empowerment Act This bill reauthorizes through FY2029 and otherwise revises a Department of Education (ED) grant program for student veteran centers. Specifically, ED must make grants to institutions of higher education (IHEs) or consortia of IHEs to establish, maintain, improve, or operate a student veteran center. A student veteran center is a dedicated space on a campus that provides students who are veterans or members of the Armed Forces with (1) a lounge or meeting space for themselves, their spouses or partners, their children, and veterans in the community; and (2) a centralized office for student veteran services that serves as a single point of contact to coordinate comprehensive support services for student veterans.
John Lewis Every Child Deserves a Family Act This bill prohibits discrimination on the basis of sexual orientation, gender identity, marital status, or religion in the provision of child welfare programs and services by entities receiving federal funding. The Department of Health and Human Services (HHS) must provide technical assistance to help states follow this requirement, including (1) guidance for bringing state laws into compliance, (2) developing training to increase cultural competency related to social identity, and (3) training for judges and attorneys involved in child welfare cases, among other supports. Additionally, HHS must establish the National Resource Center on Safety, Well-Being, Placement Stability, and Permanency for LGBTQ Children and Youth Involved with Child Welfare Services to provide training, technical assistance, and guidance to applicable state and local agencies and service providers. Further, the Religious Freedom Restoration Act may not be the basis for challenging the application or enforcement of this bill. The Government Accountability Office must study and report on states' compliance with the requirements of the bill no later than three years after enactment.
End Polluter Welfare Act of 2021 This bill limits or eliminates certain fossil fuel oil and gas subsidies for oil companies, including by (1) eliminating the limit on liability for offshore facilities and pipeline operators; (2) eliminating the authority of the Department of Energy to carry out the Fossil Energy Research and Development Program and prohibiting funds made available to the Advanced Research Project Agency from being used to carry out any project that supports fossil fuels; (3) terminating certain provisions relating to enhanced oil recovery, producing oil and natural gas from marginal wells, and limitations on percentage depletion for oil and natural gas wells; (4) terminating other deductions and accounting methods supporting oil, natural gas, and coal companies; (5) increasing the Oil Spill Liability Trust Fund financing rate; (6) denying a tax deduction for removal costs and damages relating to oil spills; (7) imposing an excise tax on the removal price of any taxable crude oil or natural gas; (8) increasing amortization periods for tertiary injectant expenses, development expenditures of a mine or other natural deposit, mining exploration expenditures, and intangible drilling and development costs for oil and gas wells and geothermal wells; (9) repealing the tax credits for the production of electricity from refined coal and for carbon oxide sequestration; and (10) requiring a study and elimination of certain other fossil fuel subsidies.
