State Fiscal Flexibility Act of 2021 This bill removes a prohibition on states and territories using COVID-19 (i.e., coronavirus disease 2019) relief funding under the American Rescue Plan Act of 2021 to offset a reduction in revenue resulting from a reduction in taxes or a delay in the imposition of a tax or tax increase.
Strengthening Trade, Regional Alliances, Technology, and Economic and Geopolitical Initiatives concerning China Act or the STRATEGIC Act This bill contains provisions addressing China and foreign relations generally. The provisions include directing the Department of State to establish a program to facilitate dialogues between U.S. regulatory and technical agencies and their counterparts in partner countries to promote U.S. regulatory standards; authorizing the State Department to help U.S. companies address China-related supply chain management issues, including by relocating production to other countries; directing the President to establish an interagency working group to strengthen U.S. leadership in international standards-setting bodies for mobile telecommunications technology, including fifth generation (5G) technology; requiring the President to establish a process for a U.S. person to petition for sanctions against a foreign person involved in a significant act of intellectual property theft or the forced transfer of technology; prohibiting any individual who has directly represented the government of a country designated by the President as a country of national security concern from serving in a State Department position that requires Senate confirmation; directing the State Department to establish the Office of Integrity in the United Nations System to counter undue influence by authoritarian nations in the United Nations; and authorizing through FY2026 various State Department programs in Southeast Asia related to maritime security and diplomatic outreach activities.
Coordination Of Medicare Payments and Workers' Compensation Act or the COMP Act This bill alters provisions relating to Medicare secondary payer rules with respect to workers' compensation settlement arrangements. Among other things, the bill provides that a Medicare set-aside fulfills secondary payer obligations if the set-aside is included in the arrangement and meets certain other criteria.
This resolution expresses the sense of the Senate that the World Trade Organization (WTO) is in need of significant reforms and that the United States, acting through the U.S. Trade Representative, must lead efforts to achieve such reforms. Specifically, the Senate urges reforms to the negotiating and dispute settlement functions of the WTO, as well as to the rules for special and differential treatment for disadvantaged countries.
Girls' Leadership, Engagement, Agency, and Development Act of 2021 or the Girls LEAD Act This bill directs the Department of State and the U.S. Agency for International Development (USAID) to jointly report to Congress a strategy to strengthen the participation of adolescents, particularly girls, in democracy, human rights, and governance. The State Department and the USAID shall (1) implement activities to achieve this goal, including activities to increase adolescent girls' civic and political knowledge and skills and address barriers to political participation; and (2) prioritize foreign assistance funding for democracy, human rights, and governance programs toward achieving the goals in this bill.
Moving and Fostering Innovation to Revolutionize Smarter Transportation Act or the Moving FIRST Act This bill authorizes through FY2026 the Department of Transportation to award Strengthening Mobility and Revolutionizing Transportation grants to communities of varying sizes to promote technological innovation (e.g., autonomous vehicles, electric vehicles, and roadway electrification) in transportation systems.
Non-Opioids Prevent Addiction In the Nation Act or the NOPAIN Act This bill temporarily establishes separate payments for certain non-opioid treatments under the Medicare prospective payment system for hospital outpatient department services and the payment system for ambulatory surgical center services. The bill applies to pain management treatments that are able to replace or reduce opioid consumption, as shown through clinical trials or data.
VOCA Fix to Sustain the Crime Victims Fund Act of 2021 This bill adds a new source of revenue for the Crime Victims Fund and makes changes to formula grants supported by the fund. Specifically, the bill directs revenues collected from deferred prosecution and non-prosecution agreements to be deposited into the Crime Victims Fund. Currently, such revenues are deposited into the general fund of the Treasury. Additionally, the bill increases the percentage—from 60% to 75%—of state compensation payments to crime victims in the prior fiscal year used to calculate formula grants for state victim compensation programs. Finally, the bill directs states to waive the matching requirement for recipients of state victim assistance formula grants during and for one year after a pandemic-related national emergency. It also allows states to waive the matching requirement pursuant to a policy established by the state.
This resolution supports the designation of February 2021 as Career and Technical Education Month to celebrate career and technical education across the United States.
Foreign Influence Transparency Act This bill addresses foreign influence in higher education and in certain other academic, religious, and artistic pursuits. Current law exempts from foreign agent registration requirements a person engaging in activities in furtherance of religious, scholastic, academic, or scientific pursuits or of the fine arts. The bill specifies that this exemption applies only to those activities that do not promote the political agenda of a foreign government. Under current law, an institution of higher education (IHE) must disclose to the Department of Education (ED) a gift or contract that is from a foreign source and is valued at $250,000 or more, considered alone or in combination with all other gifts from or contracts with the foreign source. The bill instead requires an IHE to disclose such a gift or contract that is valued at $50,000 or more, considered alone or in combination with all other gifts or contracts. An IHE must include in its disclosure report the contents of any such contract and make the contents available for public disclosure. Additionally, an IHE that enters into an agreement with a Confucius Institute (i.e., a cultural institute directly or indirectly funded by the Chinese government) must immediately make available the full text of the agreement to the public, ED, and Congress. Finally, the bill prohibits an IHE that does not comply with these disclosure requirements from enrolling foreign students under the Student and Exchange Visitor Program.
