504 Credit Risk Management Improvement Act of 2021

504 Credit Risk Management Improvement Act of 2021 This bill revises the duties of the Office of Credit Risk Management to include oversight of a certified development company (CDC) that participates in the 504 Loan Program of the Small Business Administration (SBA), and it requires the SBA to issue rules related to certain environmental requirements. The 504 Loan Program provides a small business with SBA financing—through a CDC intermediary—for expansion or modernization. Specifically, the bill requires the office to oversee any CDC that participates in the program and to conduct file reviews with respect to loan closings under the program. Further, the bill authorizes the office to take formal and informal enforcement actions against a CDC for specified violations and to charge each CDC a fee. The SBA must issue rules to clarify the procedures necessary for an eligible CDC to comply with certain environmental requirements.

Section 331 Obligation Clarification Act

Section 331 Obligation Clarification Act This bill specifies that certain service obligations owed by the licensee of a commercial television broadcast station apply regardless of the broadcast frequency used by the licensee. Specifically, the bill provides that a licensee making a change from a very high frequency (VHF) broadcast station to an ultrahigh frequency (UHF) broadcast station must ensure the change does not affect its obligation to provide service to its customers. The bill also requires such a licensee to (1) broadcast at least 14 hours of common local programming per week, (2) include a substantial amount of particularized local content, and (3) maintain a studio in the station's community. The bill further provides for the reallocation of a station to a community where there is no VHF or UHF station. The Government Accountability Office must examine and report on the process used by the Federal Communications Commission for renewing broadcast television licenses to determine if that process meets specified obligations. In particular, the GAO must review how the process relates to television broadcast stations with specific obligations to serve the needs of their local communities.

504 Modernization and Small Manufacturer Enhancement Act of 2021

504 Modernization and Small Manufacturer Enhancement Act of 2021 This bill modifies the Small Business Administration (SBA) 504 Loan Program, which provides a small business with SBA financing—through a certified development company (CDC) intermediary—for expansion or modernization. Specifically, the bill adds policy goals, at least one of which a CDC must demonstrate to be eligible for assistance. These include (1) enhancing the ability of a small business to reduce costs by using energy efficient products and generating renewable energy, and (2) aiding the revitalization of any area for which a disaster has been declared or determined. The bill also authorizes a CDC to take specified actions to facilitate the closing of a 504 loan, such as correcting borrower or lender information on loan documents or reallocating up to 10% of the cost of a project. For small manufacturers, the bill (1) increases the maximum loan amount from $5.5 million to $6.5 million, (2) reduces the amount that they must contribute to project costs, (3) increases job retention requirements, and (4) revises collateral requirements and debt refinancing considerations. Further, each SBA district office must partner with a resource partner to provide certain training for small manufacturers.

Economic Inclusion Civil Rights Act of 2021

Economic Inclusion Civil Rights Act of 2021 This bill modifies the prohibition against intentional racial discrimination in the context of economic activity such as employment, contracts, or other commercial transactions. Specifically, the bill makes an action that has a discriminatory effect a violation of section 1977 of the Revised Statutes. It also states that all non-White persons within U.S. jurisdiction shall have the same right in every state and territory as is enjoyed by White citizens in certain respects. No person shall use a criterion, method of administration, practice, or policy that has a disparate impact in violation of that provision. Further, a plaintiff may prove intentional discrimination by showing only that the discriminatory intent was a motivating factor in the alleged violation. Under current law, a plaintiff must prove that the harm would not have occurred but for the defendant's unlawful conduct. Additionally, standing shall not be limited to victims who were parties to, or third-party beneficiaries of, a contract with the defendant. The bill provides for a right to jury trial and no joint-action waiver or pre-dispute arbitration agreement shall be enforceable with respect to any alleged violation. The bill provides for a four-year statute of limitations.

Veterans Visa and Protection Act of 2021

Veterans Visa and Protection Act of 2021 This bill provides permanent resident status and citizenship eligibility to certain noncitizen veterans and addresses related issues. The Department of Homeland Security (DHS) must establish a program that allows (1) eligible noncitizen veterans outside of the United States to be admitted as permanent residents, and (2) eligible noncitizen veterans in the United States to obtain permanent resident status.  Generally, an eligible noncitizen veteran under this bill is one who was not removed from the United States for certain crimes related to violence or national security. DHS may waive these eligibility requirements for humanitarian, family unity, public interest, or exceptional military service reasons. A noncitizen veteran who obtains permanent resident status under this bill shall be eligible for (1) naturalization through service in the Armed Forces, and (2) military and veterans benefits as if they had not been removed (or ordered removed) from the United States. For a noncitizen veteran in removal proceedings or subject to a final removal order, the Department of Justice (DOJ) must determine whether the veteran is eligible for permanent resident status under this bill. If the veteran is eligible, DOJ must adjust the veteran's status. The bill also protects noncitizen veterans or service members from being removed from the United States unless the veteran has been convicted of a crime of violence.
