International Human Rights Defense Act of 2021 This bill establishes in the Department of State a permanent Special Envoy for the Human Rights of LGBTQI (lesbian, gay, bisexual, transgender, queer, or intersex) Peoples who shall serve as the principal State Department advisor regarding human rights for LGBTQI people and represent the United States in diplomatic matters relevant to the human rights of LGBTQI people. The special envoy shall periodically provide Congress with a U.S. global strategy to prevent and respond to criminalization, discrimination, and violence against LGBTQI people. The State Department and the U.S. Agency for International Development may provide assistance to prevent and respond to such activities against LGBTQI people. The bill also requires that annual country reports on human rights practices include information on criminalization, discrimination, and violence based on sexual orientation and gender identity.

Living Donor Protection Act of 2021 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on live organ donation to include information about the benefits of live organ donation and about access to insurance for living organ donors.

Honduras Human Rights and Anti-Corruption Act of 2021 This bill temporarily imposes sanctions and other penalties on Honduran president Juan Orlando Hernandez and the government of Honduras for systemic corruption and human rights violations, with particular focus on the Honduran police and military. Specifically, the President must impose asset- and visa-blocking sanctions on Juan Orlando Hernandez due to his corrupt practices, including the use of the state apparatus to protect and facilitate drug trafficking. Additionally, the President must prohibit, within 30 days, the issuance of licenses to export defense articles and services and specified munitions to the Honduran police or military. The bill also (1) makes Honduras ineligible for security assistance to equip and train police and military, and (2) requires U.S. representatives at multilateral development banks to oppose any loans for Honduran police or military. Furthermore, the Department of the Treasury must instruct U.S. leadership of international financial institutions and the U.S. International Development Finance Corporation to promote human rights due diligence and risk management in any loan, grant, policy, or strategy related to Honduras. The sanctions and other penalties put in place under this bill terminate in five years but may be lifted earlier if specified conditions are met.

Medicare-X Choice Act of 20 21 This bill establishes and funds the Medicare Exchange health plan, which allows individuals who are not otherwise eligible for Medicare to enroll in a government-administered health insurance plan. The Centers for Medicare & Medicaid Services (CMS) must offer such plan in certain individual health insurance exchanges beginning plan year 2022 and offer it in all individual health insurance exchanges beginning plan year 2025. CMS must offer the plan in the small group market in all geographic areas for plan year 2025. The plan must cover primary care services without cost sharing and meet the same requirements, including essential health benefits, as existing health insurance exchange plans. Unless they opt out, health care providers enrolled under Medicare or under a state Medicaid plan must participate in the plan and are reimbursed at Medicare rates. The bill establishes a grants program for community organizations, educational institutions, and health agencies to create service partnerships and establish interactive data systems for health care providers. Additionally, the bill expands the premium tax credit available for plans purchased through an exchange and eliminates the restriction on the Department of Health and Human Services negotiating prescription drug prices for Medicare.

Equality Act This bill prohibits discrimination based on sex, sexual orientation, and gender identity in areas including public accommodations and facilities, education, federal funding, employment, housing, credit, and the jury system. Specifically, the bill defines and includes sex, sexual orientation, and gender identity among the prohibited categories of discrimination or segregation. The bill expands the definition of public accommodations to include places or establishments that provide (1) exhibitions, recreation, exercise, amusement, gatherings, or displays; (2) goods, services, or programs; and (3) transportation services. The bill allows the Department of Justice to intervene in equal protection actions in federal court on account of sexual orientation or gender identity. The bill prohibits an individual from being denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual's gender identity.

Telehealth Modernization Act This bill modifies requirements relating to coverage of telehealth services under Medicare. Specifically, the bill extends certain flexibilities that were initially authorized during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). Among other things, the bill allows (1) rural health clinics and federally qualified health centers to serve as the distant site (i.e., the location of the health care practitioner); (2) the home of a beneficiary to serve as the originating site (i.e., the location of the beneficiary) for all services (rather than for only certain services); and (3) all types of practitioners to furnish telehealth services, as determined by the Centers for Medicare & Medicaid Services.

Newborn Screening Saves Lives Reauthorization Act of 2021 This bill reauthorizes through FY2026 and revises several programs and activities relating to newborn screening for certain conditions and genetic, endocrine, and metabolic diseases. Among its changes, the bill reauthorizes and makes mandatory the Hunter Kelly Research Program at the National Institutes of Health, and national surveillance activities conducted by the Centers for Disease Control and Prevention. The bill also aligns statutory requirements for research on non-identified newborn blood spots with federal regulations governing research on human subjects. These blood spots are collected as part of newborn screening programs, and some states make them available for biomedical and public health research. Under current regulations, research on non-identified bio-specimens such as blood spots is not considered to be research on human subjects, to which additional protections apply.

COVID-19 Nursing Home Protection Act of 2021 This bill provides funds and establishes requirements for Medicare skilled nursing facilities (SNFs) and Medicaid nursing facilities (NFs) to address COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill provides FY2021 funding for COVID-19 strike teams that can be deployed to these facilities to help with vaccinations, clinical care, infection control, or staffing. The amounts provided by the bill are designated as an emergency requirement pursuant to the Statutory Pay-As-You-Go Act of 2010 (PAYGO) and the Senate PAYGO rule. (This excludes the budget effects from being counted for the purposes of enforcing the PAYGO rules.) In addition, the bill requires the Centers for Medicare & Medicaid Services (CMS) to ensure that, during the public health emergency relating to COVID-19, at least one of its contracts with Medicare quality improvement organizations requires that the organization assist SNFs with COVID-19 infection control (e.g., training materials). Finally, the bill provides statutory authority for the requirement that SNFs and NFs report data regarding COVID-19 preparedness, testing, infections, and deaths. Additionally, the CMS must publish on the Nursing Home Compare website certain demographic information, aggregated by state, with respect to COVID-19 infections and deaths in such facilities.

Federal Initiative to Guarantee Health by Targeting Fentanyl Act This bill places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Additionally, the bill prohibits the application of a mandatory minimum prison term for certain drug offenses involving fentanyl-related substances.

Data to Save Moms Act This bill expands data collection and research on maternal morbidity and mortality among minority populations. Specifically, the bill adds requirements to a program within the Centers for Disease Control and Prevention (CDC) that supports maternal mortality review committees. To the extent practicable, the committees must use the most up-to-date indicators of severe maternal morbidity; review deaths caused by suicide, overdose, or other behavioral health conditions attributed to or aggravated by pregnancy or childbirth; and consult with representatives of communities about nonclinical factors that may contribute to adverse maternal outcomes. The CDC may also award grants to committees to increase their engagement with local communities, such as by bringing on community representatives as committee members. Additionally, the Centers for Medicare & Medicaid Services and the Agency for Healthcare Research and Quality must consult with diverse stakeholders to review maternal health data collection processes and quality measures and make recommendations to improve them. The Indian Health Service and the Department of Health and Human Services must also arrange for studies on adverse maternal health outcomes among tribal and minority populations, respectively.
