This joint resolution requires the parties to the disputes between certain railroads and labor organizations to accept the recommendations in the report of the Presidential Emergency Board Numbered 250 that was issued on August 16, 2022, with respect to any such disputes that remain unresolved by 12:01 a.m. eastern daylight time on September 16, 2022.

Simplify Timelines and Assure Regulatory Transparency Act or the START Act This bill sets forth a variety of provisions to expedite the environmental review of energy projects, such as the Mountain Valley Pipeline project.

This bill prohibits the use of additional funds appropriated to the Internal Revenue Service under the Inflation Reduction Act of 2022 for audits of taxpayers with taxable incomes below $400,000.

Disaster Mitigation and Tax Parity Act of 2021 This bill excludes from gross income, for income tax purposes, any qualified catastrophe mitigation payment made under a state-based catastrophe loss mitigation program. A qualified catastrophe mitigation payment means any amount received for making improvements to an individual's residence for the sole purpose of reducing the damage that would be done to such residence by a windstorm, earthquake, or wildfire.

Recognizing the Protection of Motorsports Act of 2021 or the RPM Act of 2021 This bill authorizes the modification of a vehicle's air emission controls for vehicles that are not legal for operation on a street or highway and are used solely for competition. In relation to the exemption of competition vehicles from anti-tampering provisions, the Environmental Protection Agency (EPA) is prohibited from creating or authorizing a database of vehicle registration information that is required to be consulted at the point of manufacture, sale, installation, or use of parts or components. Additionally, the EPA may not require the registration of a vehicle, or part or component of a vehicle, by the manufacturer, seller, purchaser, installer, or user of the vehicle. The regulation prescribed by the EPA regarding the exemption must include certain components, including a description of the reasonable conditions for the applicability of the exemption.

This resolution expresses that the Senate has heard the announcement of the death of the Honorable Jacqueline R. Walorski, Congresswoman for the Second Congressional District of Indiana. The resolution also honors Representative Walorski for her service to Indiana and the United States. The resolution expresses that when the Senate adjourns today, it stands adjourned as a further mark of respect to the memory of Representative Walorski.

This bill authorizes the Department of Agriculture to relocate a memorial in North Carolina honoring the nine Air Force crew members who lost their lives in an airplane crash in the Cherokee and Nantahala National Forests during a training mission on August 31, 1982, with the consent of the owner of the private land where the memorial is currently located.

Recovering America’s Wildlife Act of 2022 This bill provides financial and technical assistance to states, territories, and the District of Columbia for the purposes of (1) recovering species listed as a threatened or endangered species under the Endangered Species Act or under state law, or (2) avoiding the need to list species under such laws. For example, the bill establishes the Endangered Species Recovery and Habitat Conservation Legacy Fund. A portion of the fund must be used to establish an Endangered Species Recovery Grant Program. It also provides funding for (1) the conservation or restoration of wildlife and plant species of greatest conservation need; (2) the wildlife conservation strategies of states, territories, or the District of Columbia; and (3) wildlife conservation education and recreation projects. The Department of the Interior must use a portion of the funding for a grant program. The grants must be used for innovative recovery efforts for species of greatest conservation need, species listed as endangered or threatened species, or the habitats of such species. In addition, the bill requires certain revenues generated from fees and penalties for violations of environmental requirements to be used as a source for the funding.

Maximize Americans' Retirement Security Act This bill revises the fiduciary duties for a retirement or employee benefit plan that is regulated under the Employee Retirement Income Security Act of 1974. The bill generally requires a fiduciary to select and maintain investments for a plan based solely on pecuniary factors. Under the bill, a pecuniary factor is a factor that is expected to have a material effect on the risk or return of an investment based on appropriate investment horizons that are consistent with the plan's investment objectives and funding policy. A fiduciary may only use nonpecuniary factors if the fiduciary is unable to distinguish between investment alternatives on the basis of pecuniary factors alone. In such a case, the fiduciary must provide specified documentation to the plan's participants and beneficiaries, including an explanation of how the chosen nonpecuniary factors are consistent with their interests.

Benjamin Berell Ferencz Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to Benjamin Berell Ferencz in recognition of his service to the United States and the international community during the post-World War II Nuremberg trials and his lifelong advocacy for international criminal justice and the rule of law.
