Department of Veterans Affairs Post-Traumatic Stress Disorder Processing Claims Improvement Act of 2021 This bill requires the Veterans Benefits Administration (VBA) within the Department of Veterans Affairs (VA) to update an ongoing national training program for claims processors who review compensation claims for service-connected post-traumatic stress disorder (PTSD). Such claims processors will be required to participate in the training at least once a year starting in their second year of being a VA claims processor. The training program must be standardized at regional offices of the VBA and include instruction on stressor development and verification. The VBA must establish a formal process to annually analyze training needs based on identified processing error trends. Additionally, the VBA must establish a formal process to conduct annual studies to help guide the national training program for claims processors. Finally, the VBA must evaluate the guidance relating to PTSD to determine if updates are warranted to provide claims processors with better resources regarding best practices for claims processing, including specific guidance regarding development of claims involving compensation for service-connected PTSD.

Sickle Cell Disease Comprehensive Care Act This bill establishes and provides funds for a demonstration project for state Medicaid programs to improve outpatient care for individuals with sickle cell disease, with a focus on young adults and pregnant women. The Centers for Medicare & Medicaid Services must award planning grants to at least 10 states and must select between 5 and 10 states to participate in the project. Protecting Medicare and American Farmers from Sequester Cuts Act This bill makes several budgetary, technical, and procedural changes, particularly in relation to Medicare and increasing the debt limit. Specifically, the bill continues to exempt Medicare from sequestration until March 31, 2022. (Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals.) The bill also establishes expedited Senate procedures for considering legislation to increase the debt limit. The procedures limit debate, waive points of order, and prohibit amendments. The procedures may only be used once and expire after January 16, 2022. Additionally, the bill (1) temporarily extends other provisions under Medicare, including a payment increase under the physician fee schedule; and (2) requires any debits recorded for FY2022 on the statutory pay-as-you-go (PAYGO) scorecards to be deducted from the scorecards for 2022 and added to the scorecards for 2023.
Elementary and Secondary School Counseling Act This bill directs the Department of Education to award formula grants to state educational agencies and, through them, subgrants to local educational agencies to increase access to school-based, mental-health-services providers at high-need public elementary and secondary schools.
Maddy summaryThe COPS Reauthorization Act of 2021 reauthorizes the COPS ON THE BEAT grant program, which provides federal funding to state and local law enforcement agencies for hiring additional police officers. It sets the annual funding level at $651 million for fiscal years 2022 through 2027, replacing the prior level of $1.05 billion that applied to fiscal years 2006-2009. This change directly affects participating law enforcement agencies by determining the amount of federal support available for officer recruitment and retention in their communities. The bill focuses solely on adjusting the program’s funding structure without altering its core purpose or eligibility criteria.
Protecting Community Television Act This bill revises the definition of a franchise fee that is paid by a cable operator or cable subscriber to encompass only a tax, fee, or other monetary assessment that is imposed by a franchising authority or other governmental entity.
Preserve Access to Affordable Generics and Biosimilars Act This bill authorizes the Federal Trade Commission (FTC) to initiate proceedings against parties to any agreement resolving or settling a patent infringement claim in connection with the sale of a drug or biological product. Such an agreement is presumed to have anticompetitive effects and is a violation of this bill if the filer of the generic drug or biosimilar application receives anything of value and agrees to limit or forego research, development, manufacturing, marketing, or sales of the generic drug or biosimilar. An agreement is exempted if the only consideration granted to the generic manufacturer is (1) the right to market and secure final approval for its product prior to the expiration of any statutory exclusivity, (2) a payment for reasonable litigation expenses, or (3) a covenant not to sue on any claim that the generic drug or biosimilar infringes a patent. An agreement is also exempt if the agreement's pro-competitive benefits outweigh the anticompetitive effects. When a generic or biosimilar drug manufacturer enters into an agreement with another drug manufacturer related to the manufacturing, marketing, or sale of a drug, the manufacturers must certify that the material they have given the FTC concerning the agreement contains the complete agreement and any agreements related to that main agreement, including descriptions of any oral agreements or representations. The bill imposes penalties for violations of this bill, including the forfeiture of the 180-day marketing exclusivity period for a generic drug.
