American Critical Mineral Independence Act of 2021 This bill provides support for a domestic supply of critical minerals, establishes deadlines to complete the environmental review of critical mineral projects on federal land, and sets forth related requirements to expedite the review of such projects under the National Environmental Policy Act of 1969 (NEPA). Specifically, the National Science Foundation must award grants to support research to advance critical mineral mining strategies and technologies. The Department of Energy must also provide grants to research, develop, and assess technologies and techniques to recover critical minerals from mine waste and metallurgical activities. If an environmental assessment or environmental impact statement is required for a critical mineral project, then all necessary federal review and permit considerations must be completed within 18 or 24 months, respectively. However, the review may exceed the time limit if the project sponsor agrees. The lead agency of the environmental review of such project must allow a state or another appropriate entity to assume certain federal responsibilities regarding the environmental review of the project upon the request of such entity. Further, the bill authorizes a lead agency to determine that the requirements of NEPA have been satisfied if a state or federal agency acting under state or federal law has addressed specified factors. If the lead agency does not make such a determination, then the agency must enter into an agreement with the project sponsor to set time limits for each part of the permitting process.

Khalid Jabara and Heather Heyer National Opposition to Hate, Assault, and Threats to Equality Act of 2021 or the Jabara-Heyer NO HATE Act of 2021 This bill creates grants for state and local governments to combat hate crimes. It also authorizes additional penalties for hate crime offenses. Specifically, it establishes grants for states to create state-run hate crimes reporting hotlines. It also authorizes grants for states and local governments to implement the National Incident-Based Reporting System and to conduct law enforcement activities or crime reduction programs to prevent, address, or respond to hate crimes. Finally, in the case of an individual convicted of a hate crime offense and placed on supervised release, the bill allows a court to order that the individual participate in educational classes or community service as a condition of supervised release.
Healthcare Workforce Resilience Act This bill makes previously unused immigrant visas available to nurses and physicians who petition for such a visa before the date that is 90 days after the end of the declared national emergency relating to the COVID-19 (i.e., coronavirus disease 2019) outbreak. The number of visas available shall be the total number of unused employment-based immigrant visas from FY1992-FY2020, up to 40,000. Of such visas, 25,000 shall be reserved for nurses and 15,000 for physicians. Certain family members may accompany the principal beneficiary of a visa provided under this bill, and visas for such family members shall (1) be made available from the unused visas from FY1992-FY2020, and (2) not be counted against the 40,000 cap. Visas provided under this bill shall be exempt from per-country limitations.
Closing the Law Enforcement Consent Loophole Act of 2021 This bill establishes a framework to prohibit law enforcement officers at the federal, state, and local levels from engaging in sexual acts with individuals who are in custody. At the federal level, the bill makes it unlawful for a federal law enforcement officer who is acting under color of law to engage in a sexual act with an individual who is under arrest, in detention, or in custody. Consent is not a defense to prosecution for unlawful conduct. A violator is subject to criminal penalties—a fine, a prison term of up to 15 years, or both. At the state and local level, the bill conditions eligibility for funds under the Community Oriented Policing Services program on the enactment of a similar law.

Veterans Census-Enabled National Treatment Equitable Resource Supplement for Mental Health Act of 2021 or the Vet CENTERS for Mental Health Act of 2021 This bill requires the Department of Veterans Affairs (VA) to ensure the number of Vet Centers in certain states is increased by at least one additional center if the VA determines the state meets specified requirements. The VA must also establish a community-based outpatient clinic in each state that does not share a land border with another state, is located at least 2,000 miles from the contiguous United States, and contains no such clinic.
United States–Israel Artificial Intelligence Center Act This bill requires the Department of State to establish the United States–Israel Artificial Intelligence Center to leverage the experience, knowledge, and expertise of institutions of higher education and private sector entities in the United States and Israel to develop more robust research and development cooperation in specified areas (e.g., machine learning, object detection, and speech recognition).
NIST Plumbing Research Act of 2021 This bill directs the National Institute of Standards and Technology (NIST), in collaboration with the Environmental Protection Agency and the Department of Energy, to establish or designate a laboratory to conduct research on premise plumbing in relation to water safety, security, efficiency, sustainability, and resilience; conduct an organizational review of all research and other activities related to premise plumbing conducted by federal entities; and appoint one or more officers or employees of NIST to liaise with nonfederal entities that are conducting research or other activities related to premise plumbing. The bill defines premise plumbing as the water distribution system within the property lines of a property, including all buildings and permanent structures on such property. This term also includes building supply and distribution pipes, fixtures, fittings, water heaters, water-treating and water-using equipment; and all respective joints, connections, devices, and appurtenances.
Clarity for Digital Tokens Act of 2021 This bill excludes certain offerings of digital tokens (i.e., a digital representation of value or rights recorded on a publicly available ledger) from securities registrations. The exclusion from securities registration is in effect until the later of 3 years from the date of the first sale of a token or 3 years after the effective date of the bill. During this exclusionary period, the initial development team of a token must disclose every 6 months details of the network—the system of connected devices that create and validate the ledger of transactions. This includes disclosure of the source code, the transaction history, the economics of the token, the plan to achieve network maturity, prior token sales, information regarding the team, trading platforms used, and certain material transactions. On or before the end of this period, the team must report to the Securities and Exchange Commission regarding the maturity of the network. Network maturity is reached either through decentralization of the network or through network functionality, as specified by the bill. If network maturity is not reached within 3 years, the initial development team must register the tokens as a security.
