Jobs and Opportunity with Benefits and Services for Success Act This bill renames the Temporary Assistance for Needy Families (TANF) program as the Jobs and Opportunity with Benefits and Services (JOBS) program, reauthorizes the program through FY2027, and makes changes relating to work requirements for beneficiaries. States providing aid under the program shall create an individual opportunity plan for each beneficiary. States shall impose work requirements on all work-eligible beneficiaries and shall reduce benefits for noncompliance. (Currently, individual plans are optional under TANF, and states have discretion as to whether to reduce benefits for noncompliant individuals.) States providing aid shall meet annual performance targets related to the number of beneficiaries who exit the program and find unsubsidized employment. The Department of Health and Human Services (HHS) shall reduce grants to states that fail to meet such targets. States shall provide data related to beneficiary employment and wages to HHS, which shall be publicly available. The bill modifies certain limitations that restrict the use of funds for case management and other purposes and requires states to spend at least 25% of funds from various grants on core activities. Certain existing laws relating to monitoring and recovering improper benefits payments shall apply to the JOBS program. The bill eliminates programs providing (1) supplemental grants for population increases, (2) bonuses for high performance states, (3) welfare-to-work grants, and (4) contingency funds for state welfare programs.
Facilitating Innovative Nuclear Diagnostics Act of 2021 This bill establishes separate payment requirements for diagnostic radiopharmaceuticals under the Medicare prospective payment system for hospital outpatient department services. The bill's requirements apply to diagnostic radiopharmaceuticals that have an average daily cost of $500 or more in 2022 and as adjusted based on a specified fee schedule factor in each year thereafter.
IRS Customer Service Improvement Act This bill prohibits the use of official time for specified union activities by employees of the Internal Revenue Service during the period each year beginning on February 12 and ending on April 15.
This bill allows a tax deduction for the investment advisory expenses of certain funeral trusts and cemetery perpetual care funds during the period in which the allowance of miscellaneous itemized deductions is suspended (i.e., 2018 through 2025).
Promotion and Expansion of Private Employee Ownership Act of 2021 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an ESOP business concern for purposes of the Small Business Act as a business concern that was eligible for a loan, preference, or other program under such Act before more than 49% of the business concern was acquired by an ESOP.
Non-Opioid Directive Act This bill requires the Department of Health and Human Services (HHS) to develop a non-opioid pain management directive. This is a form that an individual may use to inform health care providers of the individual's choice to avoid opioid medications for pain management. The bill also sets out requirements for the execution, use, and revocation of these forms. HHS must make the form available on its website, and health insurers must make it available to their plan enrollees. Insurers must also share an enrollee's choice about opioid treatment with health care providers during pre-authorization processes. The bill allows health care providers to override a patient's form in specified circumstances. It also extends liability protections for providers who reasonably and in good faith administer or prescribe an opioid to a patient with an executed form in place.
Save Rural Hospitals Act of 2021 This bill establishes an area wage adjustment floor for Medicare hospital payments in states that are not frontier states and excludes such adjustments from certain budget neutrality rules.
Foreign Gain-of-Function Research Prevention Act of 2021 This bill prohibits the use of federal funds to conduct or support gain-of-function research involving potential pandemic pathogens by China, Russia, Iran, North Korea, or other foreign adversaries. Gain-of-function research is any research that is anticipated to confer an attribute on a pathogen to enhance its pathogenicity or transmissibility in mammals. If the Department of State finds that an entity has used funds for prohibited research, the entity may not receive any federal funding for a period of five years.
Trade Preferences and American Manufacturing Competitiveness Act of 2021 This bill reauthorizes and revises specified U.S. trade programs and provisions. Specifically, the bill extends through January 1, 2027, the Generalized System of Preferences (GSP), which provides duty-free treatment to products imported from designated beneficiary countries. The bill makes various changes to the GSP, including by (1) adding human rights, environmental, and other criteria for designation as a beneficiary developing country; (2) requiring an assessment of how the GSP supports worker and gender rights; and (3) requiring a study on rules of origin and GSP utilization rates. Additionally, the bill provides through December 31, 2023, and retroactively applies to 120 days before this bill's enactment, temporary duty suspensions or reductions to eligible imported products. This authorization is commonly known as the Miscellaneous Tariff Bill (MTB). The last version of the MTB was enacted in September 2018 and the temporary treatment for those products listed in the MTB expired on December 31, 2020. The bill also extends the American Manufacturing Competitiveness Act of 2016 for two future MTB cycles (one in 2022 and one in 2025). This extension allows the U.S. International Trade Commission to conduct the MTB petition, review, and recommendation process for those additional cycles. The bill extends customs user fees through June 21, 2031.
