Espionage Act Reform Act of 2022

Espionage Act Reform Act of 2022 This bill limits the scope of certain criminal offenses relating to classified information. Under the bill, the offense of disclosing classified information to an unauthorized person may be committed only by an individual who is authorized to receive the classified information and has signed a nondisclosure agreement regarding such classified information (i.e., a covered person), whereas under current law any individual may be charged with this offense. Under the bill, this offense shall not apply to disclosures of information to any Member of Congress, a federal court, an inspector general in the intelligence community, or certain bodies such as the Federal Trade Commission. Similarly, under the bill, certain offenses related to gathering, transmitting, or losing defense information may be committed only by a covered person or a foreign agent, whereas currently such offenses may be committed by any person. Under the bill, an individual who is not a foreign agent may not be criminally charged for such offenses unless the individual meets certain requirements, such as having committed a felony under federal law in the course of committing the offense. An offense related to obtaining and copying a document connected with the national defense shall apply only to an unlawfully obtained nonpublic document, whereas the current statute does not limit the scope of this offense to such documents. An offense related to dispensing certain public property of value shall apply only to tangible things, whereas the current statute does not limit the scope of this offense to tangible things.

Youth Voting Rights Act

Youth Voting Rights Act This bill expands voting access for youth. Specifically, the bill establishes a private right of action to enforce the Twenty-Sixth Amendment, which prohibits denying or abridging the right to vote based on age. Additionally, the bill directs each state to designate as voter registration agencies all offices within public institutions of higher education (IHEs) that provide assistance to students, implement a preregistration process to allow minors who are 16 years or older to register to vote in federal elections that take place when or after the preregistered individual turns age 18, and ensure the availability of polling places on campuses of IHEs (with the availability of waivers). The bill prohibits durational residency requirements for voting in all federal elections. Currently, this prohibition applies only to voting for the offices of President and Vice President. States and local jurisdictions with voter identification requirements must treat IHE-issued student identification cards as voter identification. The Election Assistance Commission (EAC) must make grants to states to increase the involvement of individuals under age 18 in public election activities. The Government Accountability Office must report to Congress on trends related to voter registration, absentee voting, and provisional voting. The EAC must also collect and make publicly available certain data from states.

ATF Data and Anti-Trafficking Accountability Act or the ATF DATA Act This bill directs the Bureau of Alcohol, Tobacco, Firearms and Explosives to report to Congress and make publicly available certain data sets regarding firearms tracing data.

Stealthing Act of 2022 This bill establishes a civil action for the nonconsensual removal of a sexual protection barrier (e.g., a condom). A person may recover compensatory and punitive damages, injunctive and declaratory relief, and such other relief as a court may deem appropriate.

Consent is Key Act This bill directs the Department of Justice to increase a state's allocation of funds under the Sexual Assault Services Program if the state has in effect a law that authorizes civil damages and equitable relief against a person who engages in the nonconsensual removal of a sexual protection barrier (e.g., a condom).

Food and Agribusiness Merger Moratorium and Antitrust Review Act of 20 22 This bill places a moratorium on certain acquisitions between large agricultural and retail-related businesses and establishes the Food and Agriculture Concentration and Market Power Review Commission. The commission shall report to Congress and the President on (1) the nature and consequences of market concentration in the U.S. food and agricultural economy, and (2) recommended legal and regulatory changes to address such market concentration.

Judicial Ethics and Anti-Corruption Act of 2022

Judicial Ethics and Anti-Corruption Act of 2022 This bill makes various changes to the federal framework governing judicial ethics. Among the changes, the bill prohibits federal judges and Supreme Court Justices from owning individual stocks and securities; requires the Judicial Conference of the United States to issue regulations restricting the solicitation or acceptance of gifts in connection with a private judicial seminar; expresses the sense of Congress that the Code of Conduct for U.S. Judges shall apply to Supreme Court Justices; requires federal judges and Supreme Court Justices to report on each association or interest that would require recusal, including any financial interest of a spouse or minor child who resides in the household; and establishes a committee to review complaints against the Supreme Court.

SAFE SEX Workers Study Act

SESTA/FOSTA Examination of Secondary Effects for Sex Workers Study Act or the SAFE SEX Workers Study Act This bill requires the Department of Health and Human Services (HHS) and the Department of Justice (DOJ) to study the impacts of the reduction in access to certain websites and other interactive computer services resulting from the Allow States and Victims to Fight Online Sex Trafficking Act of 2017 on individuals engaged in adult, consensual sex work. Specifically, HHS must study the impacts of the reduction on the health and safety of individuals engaged in transactional sex while DOJ must study the impacts of the reduction on human trafficking investigations and prosecutions.

Latonya Reeves Freedom Act of 2022

Latonya Reeves Freedom Act of 2022 This bill prohibits government entities and insurance providers from denying community-based services to individuals with disabilities that require long-term service or support that would enable such individuals to live in the community and lead an independent life. Specifically, these entities may not discriminate against such individuals in the provision of community-based services by such actions as imposing prohibited eligibility criteria, cost caps, or waiting lists or failing to provide a specific community-based service. Additionally, community-based services must be offered to individuals with such disabilities prior to institutionalization. Institutionalized individuals must be notified regularly of community-based alternatives. The bill requires the Department of Justice to issue regulations requiring government entities and insurance providers to offer community-based long-term services to individuals with such disabilities who would otherwise qualify for institutional placement. Government entities must ensure sufficient availability of affordable, accessible, and integrated housing that is not a disability-specific residential setting or a setting where services are tied to tenancy. Regulations shall also (1) require government entities and insurance providers to perform self-evaluation on current services, policies, and practices and concerning compliance with requirements of this bill; and (2) require government entities to submit a transition plan. The bill provides funds for FY2022 for the Department of Health and Human Services to provide technical assistance with respect to transition plans. The bill allows civil actions by individuals subjected to, or about to be subjected to, a violation of its requirements.
