Nondebtor Release Prohibition Act of 2021

Nondebtor Release Prohibition Act of 2021 This bill addresses the release by bankruptcy courts of creditor or other third-party claims against non-debtors. Complex bankruptcies may involve third-party claims against non-debtors associated with the debtor, such as the debtor's officers, directors, or employees. Currently, in carrying out a bankruptcy plan, bankruptcy courts may release non-debtors from liability (there is a split in the judicial circuits regarding this practice). The bill generally prohibits a bankruptcy court from (1) releasing or modifying a non-debtor's liability through the approval of a bankruptcy plan or through an order, or (2) enjoining a judicial proceeding or other act to collect or otherwise enforce such a claim or cause of action against a non-debtor. However, the bill provides for the release of such liability if express consent is given by the third party. The bill also generally limits an order or decree to temporarily enjoin a proceeding against a non-debtor to 90 days. Additionally, the bill gives appellate jurisdiction to the appropriate U.S. court of appeals regarding an order or decree to temporarily enjoin or stay a proceeding against a non-debtor in a Chapter 11 reorganization bankruptcy case. Currently, U.S. district courts have appellate jurisdiction for these matters. Upon request of an interested party, and after notice and a hearing, the court shall dismiss a Chapter 11 reorganization bankruptcy case if the debtor was involved in certain restructuring activity that (1) had the intent or foreseeable effect of separating a debtor's assets from a debtor's liabilities and the debtor assuming or retaining such liabilities, and (2) occurred in the 10-year period prior to the filing of the bankruptcy petition.

Pandemic Risk Insurance Act of 2021

Pandemic Risk Insurance Act of 2021 This bill establishes the Pandemic Risk Reinsurance Program within the Department of the Treasury. The program generally provides compensation to property and casualty insurers if they incur losses as a result of coverage related to pandemics and outbreaks of disease. All insurers as specified in the bill must participate in the program. These insurers must offer, in all property and casualty insurance policies, coverage of losses related to an outbreak of infectious disease or a pandemic for which a covered public health emergency is certified by the Department of Health and Human Services. Additionally, these insurers must offer, in all its commercial property insurance policies, coverage to compensate the insured for a portion of 180 days' fixed costs and payroll triggered upon the certification of a public health emergency and state or local government closure orders without requiring specific proof of losses. The bill establishes the share of insured losses covered by the program and conditions for payment to insurers. The bill also provides for the treatment of reinsurance, captive insurers, other self-insurance arrangements, and state residual market insurance entities. The Government Accountability Office must report on the availability and affordability of property and casualty insurance.

American Energy Worker Opportunity Act of 2021

American Energy Worker Opportunity Act of 2021 This bill establishes the Office of American Energy Workers in the Department of the Treasury to provide displaced coal workers with wage replacement, health care premiums, retirement savings contributions, and educational assistance. The bill also provides educational assistance for the children of displaced coal workers and provides an incentive for clean energy employers to hire displaced coal workers.

HELP Copays Act

Help Ensure Lower Patient Copays Act or the HELP Copays Act This bill requires health insurance plans to apply certain payments made by, or on behalf of, a plan enrollee toward a plan's cost-sharing requirements. Specifically, plans must apply third-party payments, financial assistance, discounts, product vouchers, and other reductions in out-of-pocket expenses toward the requirements.

Behavioral Health Crisis Services Expansion Act

Behavioral Health Crisis Services Expansion Act This bill establishes requirements, expands health insurance coverage, and directs other activities to support the provision of behavioral health crisis services along a continuum of care. Specifically, the Department of Health and Human Services (HHS) must establish standards for a behavioral health crisis continuum of care that health care providers and communities may use in responding to individuals experiencing a behavioral health crisis. This continuum of care must include 24-7 crisis hotlines, emergency treatment, stabilization services, and other specified components. In addition, the bill expands health insurance coverage for behavioral health crisis services. It also expands the Community Mental Health Services Block Grant to assist states and territories with developing the infrastructure to provide crisis response services. Furthermore, HHS, in consultation with the Department of Justice, must convene an expert panel to make recommendations concerning training for emergency services dispatchers and crisis call center personnel to respond appropriately to individuals experiencing a behavioral health crisis.

This resolution expresses that the House of Representatives applauds the Biden administration for reaffirming the U.S. commitment to the Paris Agreement on climate change and to our collective responsibility to globally combat climate change; encourages the Biden administration to implement measures to ensure global climate change remains a top priority for this and future administrations and to cement the United States as a global leader in the fight to mitigate its most severe consequences; voices strong commitment as legislators toward achieving the climate goals of the Paris Agreement, fulfilling the forthcoming pledges from the COP26 in Glasgow, Scotland, and advancing other international efforts to keep global warming to no more than 1.5 degrees Celsius and realize global net-zero carbon emissions by 2050 using a whole-of-government approach; and recognizes the critical responsibility of the United States and other developed nations to ensure all societies have the capabilities to transition to a clean energy economy, the resources to protect against climate-induced disasters, and the necessary assistance to endure climate-related challenges to food security, regional migration, and public health.

Cady Housh and Gemesha Thomas Student Suicide Prevention Act of 2021 This bill reauthorizes through FY2028, and otherwise revises, grants administered by the Substance Abuse and Mental Health Services Administration (SAMHSA) to support youth suicide early-intervention and prevention strategies. Specifically, the bill requires SAMHSA to award a portion of such grants for statewide training programs on emotional well-being, mental health, and suicide awareness and prevention for elementary and secondary school students and staff.

Booster Seat Safety Act

Booster Seat Safety Act This bill addresses labeling requirements and testing standards for booster seats used in motor vehicles. Specifically, the bill requires labels on booster seats to include the minimum recommended age (4 years) and weight (40 pounds) for a child to use the seat. It also requires that a label on a car seat or combination car seat list the maximum weight and height limits of the seat, as well as a recommendation to continue using the seat until the child exceeds the listed limits. Additionally, the National Highway Traffic Safety Administration (NHTSA) must either establish a minimum height recommendation for booster seats or a method for manufacturers to use to determine a minimum height recommendation. Once the minimum height or method is established, booster seat labels must also contain the minimum height recommendation. The NHTSA must also establish a standard for side-impact crash tests for booster seats and provide guidelines for creating a testing dummy that approximates a six-year old child for such crash tests. Further, the NHTSA must study systems for tethering child restraint systems in vehicles and make recommendations about using or modifying tether systems to maximize child safety.
