Sen. James Manning

Permits employees of certain state agencies to refuse to work additional mandatory overtime shift scheduled by employer when employee has already worked mandatory overtime in same month. Prohibits employer from requiring employee to take unpaid leave or use paid time off to make up for refusing to work additional overtime shift, or from taking adverse employment action against employee.

Establishes state policy regarding natural climate solutions. Establishes Natural and Working Lands Fund and provides for transfer of moneys from fund to certain state agencies. Prescribes uses of moneys from fund and requires Oregon Global Warming Commission to report to legislature on uses of moneys from fund. Directs State Department of Energy and commission to prepare inventory, baseline, activity-based metrics and community impact metrics for net carbon sequestration and storage in natural and working lands and establish carbon sequestration and storage goals. Directs State Department of Energy, in coordination with commission, to study workforce training programs needed to support adoption of natural climate solutions and provide results to committees of Legislative Assembly related to environment no later than September 15, 2024. Authorizes commission to appoint natural and working lands advisory committee. Takes effect on 91st day following adjournment sine die.

Excludes hours of overtime worked for Oregon State Police from limitations on inclusion of overtime in final average salary for purposes of Oregon Public Service Retirement Plan.

Requires State Board of Pharmacy to study prescription drugs. Directs board to submit findings to interim committees of Legislative Assembly related to health care not later than September 15, 2024. ] Requires pharmacy benefit managers and group purchasing organizations to annually report to Department of Consumer and Business Services information relating to prices, rebates, fees and similar information. Requires Prescription Drug Affordability Board to develop plan for establishing upper payment limits on certain drugs and to conduct specified analyses regarding establishing upper payment limits. Requires prescription drug manufacturers to separately report to department price and other information regarding certain prescription drugs each calendar year. Increases and modifies membership of board. Requires department to report to board list of drugs that increased in price and were required to be reported to department. Modifies fees paid to department by prescription drug manufacturers. Requires insurers to separately report annually to department specified information regarding prescription drugs covered by insurers. Takes effect on 91st day following adjournment sine die.

Appropriates moneys from General Fund to Oregon Department of Administrative Services for purposes of deposit in Universal Representation Fund. Appropriates moneys from General Fund to Judicial Department for purposes of transfer to Oregon State Bar for purposes of use by Legal Services Program to provide legal services to individuals on immigration matters. Declares emergency, effective on passage.

Requires Department of Education to annually designate whether each school district is conditionally standard, nonstandard or standard. Prescribes requirements for designations and reporting requirements for designations. Directs Department of Education to investigate allegations of noncompliance with prohibition on discrimination by public elementary or secondary education provider. Prescribes actions department may take upon determination of noncompliance. Directs State Board of Education to adopt requirements for process and criteria for district school board or education service district board to select textbooks and other instructional materials that are not on list adopted by State Board of Education. Directs Department of Education to review department's statutes, rules and internal policies to identify how best to incorporate suggestions made by Secretary of State following audit of education in this state. Declares emergency, effective July 1, 2023.

Establishes income tax credit for volunteer firefighters. Applies to tax years beginning on or after January 1, 2024, and before January 1, 2030. Takes effect on 91st day following adjournment sine die.

Modifies definition of "employment relations" to exclude standards, requirements or procedures relating to body-worn cameras for purposes of law enforcement officer collective bargaining. Prohibits labor organization that represents sworn law enforcement officers of law enforcement agency from negotiating over matters related to standards, requirements or procedures relating to body-worn cameras. Provides that such matters are prohibited subjects of bargaining.

Requires professional licensing boards to provide culturally responsive training to specified staff members, publish guidance on pathways to professional authorization for internationally educated individuals and waive requirement for English proficiency examination for specified internationally educated individuals. Prohibits Oregon Medical Board from imposing time limitation on completion of United States Medical Licensing Examination. Allows board to issue limited license to practice medicine to specified individuals for practice under supervision of other licensed physician. Establishes Internationally Educated Workforce Reentry Grant Program within Higher Education Coordinating Commission to award grants to local workforce development boards that contract with specified entities that provide eligible career guidance and support services to internationally educated residents of Oregon who are seeking to enter Oregon workforce in certain professions. Declares emergency, effective July 1, 2023.

Modifies Senate Rules to permit parking permits supplied to staff and staff reimbursement for costs incurred by staff in parking at or near State Capitol building to be paid for out of members' services and supplies accounts.
