Prohibits remote sales of inhalant delivery systems. Defines "inhalant delivery system." Declares emergency, effective on passage.
Requires city that provides disability or retirement system for firefighters and police officers by ordinance or charter that is not subject to workers' compensation law to apply provisions requiring presumption that condition or impairment of health is occupational disease that results from employment if firefighter took physical examination upon gaining or during employment that failed to reveal evidence of occupational disease that existed before employment. Requires that city's denial of claim for compensation for occupational disease must be on basis of clear and convincing medical evidence that condition or impairment of health is unrelated to employment. Establishes that time limitations for filing claim are one year from date claimant first discovered or should have discovered occupational disease, one year from date claimant becomes disabled or is informed by physician that claimant is suffering from occupational disease or one year from date that worker's beneficiary first discovered or reasonably should have discovered that cause of worker's death was occupational disease.
Modifies allocation formula for grants to children's advocacy centers. Establishes Child Abuse Assessment Account within State Treasury for purpose of grant program for children's advocacy centers. Appropriates moneys from General Fund to Department of Justice for purpose of funding program. Limits biennial expenditures by department for grant program from Child Abuse Assessment Account. Modifies authority of Advisory Council on Child Abuse Assessment to deposit contributions to Child Abuse Multidisciplinary Intervention Account and Child Abuse Assessment Account. Permits Department of Justice to use moneys from Criminal Injuries Compensation Account to pay for medical services provided by children's advocacy center in cases of suspected child sexual abuse or child physical abuse. Directs University of Oregon to conduct Oregon child abuse prevalence study and to submit report regarding study to interim committees of Legislative Assembly related to human services. Appropriates moneys from General Fund to Higher Education Coordinating Commission for study. Appropriates moneys from General Fund to Department of Education for purposes of developing curricula and providing educator training for instructional requirements that relate to child sexual abuse prevention, human sexuality education, teen dating violence and domestic violence, and similar instructional requirements that relate to child safety. Establishes product stewardship program for mattresses. Establishes Mattress Stewardship Fund. Establishes mattress stewardship program advisory committee. Requires stewardship organizations to submit plans for mattress stewardship programs to Department of Environmental Quality. Imposes civil penalties for violation of program provisions not to exceed, per day for each day of violation, $100 for violation by retailer, $1,000 ] $10,000 for violation by producer or renovator and $1,000 for violation by stewardship organization. Becomes operative January 1, 2021. Declares emergency, effective on passage. ] Takes effect on 91st day following adjournment sine die.
Requires certain persons that service student loans in this state to obtain or renew license. Specifies license application and renewal procedures, required fees and persons that are exempt from requirement. Prescribes duties of licensee and requires licensee to maintain specified liquidity, operating reserves and tangible net worth. Prescribes civil penalty against person that engages in business as student loan servicer without license. Permits Director of Department of Consumer and Business Services to participate in multistate examinations under specified circumstances. Becomes operative on July 1, 2021. Removes requirement that physician assistant practice under supervising physician. Requires physician assistant to enter into collaboration agreement with physician, podiatric physician or qualified physician assistant. Defines "collaboration agreement. ] Requires supervising physician, or supervising physician organization, to enter into practice agreement with physician assistant in order to use services of physician assistant. Prohibits Oregon Medical Board from requiring minimum number of hours during which supervising physician must be physically present to provide supervision. Requires that physician assistant have appropriate access to supervising physician. Requires physician assistant who prescribes and dispenses prescription drugs to maintain specified records and follow specified prescription labeling requirements. Becomes operative January 1, 2021. Limits cost-sharing for health benefit plan coverage of insulin prescribed for treatment of diabetes.
Requires health care providers, including coordinated care organizations, and ] companies providing health care interpreters to health care providers to use health care interpreters who are listed on health care interpreter registry as being qualified or certified by Oregon Health Authority. Specifies ] Requires authority to adopt by rule exceptions. Directs Commissioner of Bureau of Labor and Industries to establish by rule standards, policies and processes to monitor compliance with and enforce requirements. Requires authority to cooperate with Oregon Council on Health Care Interpreters to ] establish registry of qualified and certified health care interpreters and provide statewide health care interpreter training . Requires authority, by September 15, 2020, to make recommendations ] report to interim committee of House of Representatives related to health on design of health care interpreter program meeting specified criteria ] costs to implement establishment of health care interpreter registry and to provide health care interpreter training . Requires companies providing health care interpreters to register with authority and meet certain requirements. ] Makes health care interpreters subject workers for purposes of workers' compensation benefits. Modifies protective proceedings to permit vulnerable youth guardianships for adults between 18 and 21 years of age who are not citizens or lawful permanent residents of United States ] eligible for special immigrant status and who are unable to be reunified with parent due to abuse, neglect or abandonment that occurred before adult attained 18 years of age. Creates exceptions to certain protective proceeding procedural requirements in vulnerable youth guardianships. Exempts vulnerable youth guardianships from court fees. Takes effect on 91st day following adjournment sine die.
